AN ORDINANCE AMENDING SECTIONS 1, 3 AND
5 OF ORDINANCE NO, 402 OF THE CITY OF
MIAMI BEACH, FLORIDA, ENTITLED: "AN
ORDINANCE REGULATING AND RESTRICTING
THE LOCATIONS WHEREIN THE BUSINESS FOR
THE SALE OF LIQUOR, AS HEREIN DEFINED,
MAY BE CONDUCTED: PRESCRIBING PENALTIES
FOR THE ENFORCEMENT HEREOF" : AND AMEND-
ING SAID ORDINANCE AND THE MAP THERETO
ATTACHED BY PLACING CERTAIN LANDS IN "C"
DISTRICT AS DEFINED THEREIN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That that portion of Section 1 of Ordinance
No. 402 of the City of Miami Beach, Florida,
reading as follows:
"The term "Vendor" as used in this ordinance
shall mean any person, firm or corporation
selling or offering for sale, or keeping with
the intention of selling liquor as defined herein. "
be and the same is hereby amended so as to read as follows:
"The term "Vendor" as used in this ordinance
shall mean any person, firm or corporation
selling or offering for sale, or keeping with
the intention of selling, beer or wine, or
liquor, as defined herein".
SECTION 2. That Section 1 of Ordinance No. 402 of the
City of Miami Beach, Florida, be and the same
is hereby amended by adding thereto, at the end thereof, the
following:
"The term "Wine" as used in this ordinance shall
mean the product of the fermentation of the
juice of grapes or other fruits containing more
than 3.2 per cent of alcohol by weight. "
"The term "Beer" as used in this ordinance shall
mean an alcoholic fermented beverage made from
malt and hops and containing more than 3.2 per
cent alcohol by weight. "
SECTION a. That Section 3 of Ordinance No. 402 of the City
of Miami Beach, Florida, reading as follows:
"Section 3. In all of the districts mentioned in
Section 2, the sale of liquor by li-
censed vendors is permitted, except as hereinafter
limited" .
be and the same is hereby amended so as to read as follows:
"Section 3. In all of the districts mentioned in
Section 2, the sale of liquor, wine and
beer by licensed vendors is permitted, except as in
this ordinance hereinafter limited" .
SECTION 4. That Section 5 of Ordinance No. 402 of the
City of Miami. Beach, Florida, be and the same
is hereby amended so as to read as. follows:
"Section 5. In "0" District, the sale of liquor, or
wine, or beer, is prohibited, except in
clubs and in hotels having 100 or more guest rooms, pro-
vided the exterior of the hotel in which the business
is carried on shall not contain a store front in con-
nection with said business and provided that the business
so licensed shall only be entered from within the build-
ing. "
SECTION t. That Ordinance No. 402 of the City of Miami
Beach, Florida, and the map thereto attached
and made a part thereof, be and the same are hereby amended so
as to include in "C" District, as defined in said ordinance, the
following described parcels situate, lying and being in the City
of Miami Beach, Florida, to-wit:
"Lots One (1) to Eight (8) , inclusive, of Block One
(1) ; Lots One (1) to Eight (8) , inclusive, of Block
Four (4) ; Lots One Cl) to Four (4) inclusive, of
Block Five (5) and Lots One (1) to Light (8) , inclu-
sive, of Block Eight (s) , all in 41st Street Business
Subdivision as recorded in Plat Book 34, page 92, of
the Public Records of Dade County, Florida; and also
Lots Eleven (11) , Twelve (12) and Twelve A (12A) of
Forty First Street Block according to plat thereof
recorded in Plat Book 40, page 47, of the Public
Records of Dade County, Florida" .
SEQTIONN .6. All ordinances and parts of ordinances in con-
flict herewith shall be, and the same are,
hereby repealed.

upon its becoming a law.

NO. 402 OF THE CITY OF MIAMI BEACH, FLORIDA ENTITLED: "AN ORDINANCE
REGULATING AND RESTRICTING THE LOCATIONS WHEREIN THE BUSINESS FOR
THE SALE OF LIQUOR, AS HEREIN DEFINED, MAY BE CONDUCTED; PRESCRIB-
ING PENALTIES FOR THE ENFORCEMENT HEREOF" : AND AMENDING SAID
ORDINANCE AND THE MAP THERETO ATTACHED BY PLACING CERTAIN LANDS
IN " C" DISTRICT AS DEFINED THEREIN" , having been passed and
adopted by the City Council of the City of Miami Beach, Florida,
has been posted by me in three conspicuous places in the City
of Miami Beach, one of which was at the door of the City Hall
in said City on the 21st day of January, A. D. , 1943 and that
said Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter of
the said City of Miami Beach.
IN WITNESS WHHEREOF, I have hereunto set my

Florida, on this 3rd day of March, A. D. , 1943.
