AN ORDINANCE AMENDING ORDINANCE NO.
335 OF TIS'. CITY OF MIAMI BEACH, FLORIDA,
ENTITLED: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA, REGULATING THE OPERATION OF
TAXICABS IN THE CITY OF MIAMI BEACH,
FLORIDA; FIXING THE RATES TO BE
CHARGED FOR THE SERVICES OF TAXICABS
IN THE CITY OF MIAMI BEACH, FLORIDA;
PROVIDING FOR THN INSTALLATION OF
METERS UPON TAXICABS IN THE CITY OF
MIAMI BEACH, FLORIDA; PROVIDING A
PENALTY FOR TUE VIOLATION OF THIS
ORDINANCE, AND DEFINING TAXICABS FOR
THE PURPOSE OF THIS ORDINANCE."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 1 of Ordinance No. 335 of the City of
Miami Beach, Florida, be and the same is hereby
amended by adding thereto, at the end thereof, the
following:
"No additional charge shall be made for
the transportation of luggage or baggage
and the rates set forth shall apply re-
gardless of the number of passengers
carried. "
SECTION 2. That Section 2 of Ordinance No. 335 of the City of
Miami Beach, Florida, be and the same is hereby
amended by adding thereto, at the end thereof, the
following:
"Provided, however, that when any taxicab
is, with the permission of the City Manager,
operating without an accurate usable meter,
as in this ordinance hereinafter provided,
the rates set by this ordinance shall not
be displayed upon the exterior of the taxi-
cab but the words "flat rate" shall be con-
spicuously displayed upon the exterior of
the taxicab. "
SECTION 3. That Section 5 of Ordinance No. 335 of the City of
Miami Beach, Florida, be and the same is hereby
amended so as to read as follows:
"SECTION 5. No operator of any taxicab shall,
after accepting employment from or on behalf
of any person or persons, accept employment
from or on behalf of any other person or persons
without the consent of the first person or
persons, unless and until the first employment ,
in point of time, shall have been terminated,
and in no event shall any taxicab carry more
than five (5) persons in addition to the opera-
tor thereof. "
SECTION 4. That Section 6 of Ordinance No. 335 of the City of
Miami Beach, Florida, be and the same is hereby
amended, by adding thereto, at the end thereof, ad-
ditional sub-paragraphs (f) and (g) to read as follows :
"(f) No taxicab shall be operated on the
streets of the City of Miami Beach for the
private use of its owner or operator.
(g) Lvery owner of a taxicab shall, on the
first day of each and every month, file with
the City bianager a list containing the names
and addresses of all drivers, operators and
employees employed by said owner."
SECTION 5. That Section 7 of Ordinance No. 535 of the City of
Miami Beach, Florida, be and the same is hereby a-
mended so as to read as follows :
"SECTION 7. Except as hereinafter provided in
this Section, no taxicab shall be allowed to
operate on the streets of the City of Miami Beach
without a meter, which said meter shall conform
to the type of meter usually maintained on taxi-
cabs and shall be maintained and used for the
purpose of correctly measuring and computing the
distance travelled by such taxicab while employed
and shall be operated by mechanical means, the
power of which is derived by cable from the trans-
mission of such taxicab or by star gear attached
to the front wheels of such taxicab, and before
such taxicab may be operated on the streets and
thoroughfares of the City of Miami Beach, Florida,
said taxicab and such meter or meters shall be
inspected by the Police Department of the City
of Miami Beach and shall thereafter be subject to
inspection at any time by said Police Department.
Whenever a meter shall have been repaired, it shall
be again inspected before being placed in operation.
After any meter shall have been inspected, as herein
provided, and before being put in operation, the
meter shall be sealed by the Police Department .
Provided, however, that if the City Manager finds
that the meters required hereby to be maintained
on taxicabs cannot be kept in repair or that es-
sential parts thereof cannot be secured, he may
permit taxicabs not having usable meters in good
repair to operate without such meters and in such
event such unusable meters shall be removed from
the taxicabs ; provided further, when any taxicab
is, with the permission of the City Manager, opera-
ting without an accurate usable meter, then the
taxicab driver or operator shall, upon the entering
of such taxicab by any person, before setting
said taxicab in motion, inquire of said person
his destination and inform him of the fare
from the point of entrance of said passenger into
the said taxicab to the point of his destination.
The City Manager shall prepare and cause
mimeographed copies to be furnished each
driver or taxicab operator applying therefor,
of maximum charges to be made in accordance
with this Section, for the carriage of pas-
sengers between various principal points within
the City of Miami Beach and from various prin-
cipal points in the City of Miami Beach to
principal points outside of said City, and the
information so prepared and furnished by the
City Manager shall be printed upon a card to
be approved by the City manager and such card
shall at all times be kept posted in every
taxicab operating in said City of Miami Beach,
in the passenger compartment and in a position
directly in front of the passenger' s seat,
and the same shall not be permitted to be
covered up or concealed in any manner but shall
at all times be readily and easily visible to
passengers, in order that persons entering any
taxicab operated in the City of Miami Beach
may readily consult the card carrying such
inf ormt ion and may easily estimate the pro-
bable amount properly chargeable to them. "
SECTION 6. That Section 8 of Ordinance No. 335 of the City of Miami
Beach, Florida, be and the same is hereby amended so as
to read as follows :
"SECTION 8. For the purpose of this Ordinance,
a taxicab shall be defined as a vehicle conveying
passengers for hire at a rate to be determined
upon the basis of the distance involved in such
transportation, and for which vehicle the opera-
tor and/or owner thereof provides a person to
direct, drive and operate such vehicle. Provided,
however, that this definition shall not include
vehicles conveying passengers for hire upon a
particular schedule and over particular desig-
nated streets of the City of Miami Beach. "
SECTION 7. That Section 9 of Ordinance No. 335 of the City of Miami
Beach, Florida, be andthe same is hereby amended so as
to read as follows:
"SECTION 9. Any person violating any of the
provisions of this Ordinance, upon conviction
thereof, shall be punished by a fine not ex-
ceeding Two Hundred Dollars (4200.00) , or by
imprisonment for not more than Thirty (30)
days, or by both such fine and imprisonment,
in the discretion of the Municipal Judge of
the City of Miami Beach, Florida, and upon
such conviction the City Manager may revoke
or temporarily suspend, for such period as.
said City Manager may fix, any permit there-
tofore issued by the said City Manager for
the operation of the taxicab involved in said
violation. "
SECTION 8. That all ordinances, or parts of ordinances, in conflict
herewith are hereby r epealed.
SECTION 9. That this ordinance shall become effective immediately
upon its passage and posting as required by law.

of the City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one of
which was at the door of the City Hall in said City on the
21st day of October, A. D. , 1943, and that said Ordinance
remained posted for a period of at least thirty days in accord—
ance with the requirements of the City Charter of the said City
of Miami Beach.
