2017-29960 ResolutionRESOLUTION NO. 2017-29960 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE FINANCE AND CITYWIDE PROJECTS COMMITTEE RELATING TO THE ANNUAL PERFORMANCE EVALUATION OF THE CITY CLERK; AND, IN CONSIDERATION OF THE CITY CLERK'S EXEMPLARY PERFORMANCE DURING CONTRACT YEAR MAY 1, 2016 THROUGH APRIL 30, 2017, AMENDING THE CITY CLERK'S EMPLOYMENT AGREEMENT OF APRIL 22, 2015, BY GRANTING A SALARY INCREASE OF THREE PERCENT (3%), EFFECTIVE AS OF AND RETROACTIVE TO MAY 1, 2017; INCREASING THE CITY'S CURRENT CONTRIBUTION TO THE CITY CLERK'S 457(b) DEFERRED COMPENSATION PLAN BY $18,000 A YEAR; ISSUING THE CITY CLERK A DESIGNATED PARKING SPOT AT THE CITY HALL GARAGE; AND EXTENDING THE CITY CLERK'S EMPLOYMENT AGREEMENT FOR AN ADDITIONAL ONE (1) YEAR, WITH A NEW EXPIRATION DATE OF APRIL 30, 2020. WHEREAS, at its meeting on April 11, 2012, the Mayor and City Commission appointed Rafael E. Granado to the position of City Clerk of the City of Miami Beach effective April 11, 2012; and WHEREAS, Mr. Granada's engagement is reflected in an Employment Agreement dated April 22, 2015, and unanimously approved by the City Commission pursuant to Resolution No. 2015-28994 (the Employment Agreement); and WHEREAS, on July 13, 2015, Mr. Granada's Employment Agreement was further amended pursuant to Resolution No. 2016-29513; and WHEREAS, the Employment Agreement provides for an annual performance review and evaluation of the City Clerk, at which time the City Commission shall review the annual salary and/or other benefits of the City Clerk, and shall make adjustments in such amounts and to such extent as the City Commission may determine it is desirable to do so; and WHEREAS, the Employment Agreement further provides that an annual salary review of the City Clerk will be made every year within thirty (30) days after May 1st of each Contract year; and WHEREAS, Commissioner Ricky Arriola, as Chair of the City's Finance and Citywide Projects Committee, was charged with and has conducted Mr. Granada's annual performance evaluation and salary/benefits review; and WHEREAS, in consideration and recognition of the City Clerk's exemplary performance and achievements for Contract year May 1, 2016 through April 30, 2017, the Mayor and City Commission hereby deem that it is in the best interest of the City to approve an amendment to the City Clerk's Employment Agreement, all as further set forth below. 1 of 2 NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that, in consideration and recognition of the City Clerk's exemplary performance during Contract year May 1, 2016 through April 30,' 2017, the Mayor and City Commission hereby approve the following amendments to the City Clerk's Employment Agreement of April 22, 2015: Term: A One-year extension of the Employment Agreement, with a new termination date of April 30, 2020. Salary: A one-time 3% merit increase of $5,930, effective May 1, 2017; for a new base salary of $203,586.94. 457(b) Funding: An increase to the City's current contribution to the City Clerk's 457(b) Deferred Compensation Plan, from $6,000 to $24,000 a year. Parking: Issuance of a designated parking spot at the City Hall Garage. All compensation listed herein shall be paid bi-weekly according to the usual payroll practices of the City. Mr. Granada's engagement as City Clerk shall continue under and pursuant to the terms and conditions of the April 22, 2015 Employment Agreement, as approved pursuant to Resolution No. 2015-28994; amended by pursuant to Resolution No. 2016-29513; and as further amended by this Resolution, until the same is modified, amended or terminated by action of the Mayor and City Commission. ANALYSIS On May 17, 2017, the City Commission referred to the Finance and Citywide Projects Committee a discussion relating to City Clerk Rafael E. Granada's annual performance evaluation. On May 19, 2017, the Finance and Citywide Projects Committee met, and directed Vice-Mayor Ricky Arriola, as the Chairperson of the Committee, to conduct Mr. Granada's annual performance evaluation and salary/benefits review. On June 2, 2017, Vice-Mayor Arriola met with Mr. Granado and discussed his performance and achievements in the past year. Based on Mr. Granada's diligent and thorough discharge of his duties, Vice-Mayor Arriola recommended that the Finance and Citywide Projects Committee approve the business terms that he negotiated with the City Clerk, which are outlined hereto in the term sheet attached as Exhibit "A". All other terms and conditions remain unchanged from those included in the City Clerk's current Employment Agreement. On June 30, 2017, the Finance and Citywide Projects Committee favorably recommended the approval of the business terms that Vice-Mayor Arriola negotiated with the City Clerk.
