RESOLUTION NO. 628
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH,
FLORIDA, AS TO THE CANVASS OF
THE RETURNS OF A SPECIAL ELEC-
TION HELD MAY 20th, 1924.
WHEREAS, the City Council of the City of Miami Beach,
Florida, has heretofore passed and adopted Ordinances No. 204
and 205 and entitled "AN ORDINANCE GRANTING TO S. R. INCH,
HIS HEIRS, LEGAL REPRESENTATIVES AND ASSIGNS, THE RIGHT, PRIVI-
LEGE, OR FRANCHISE FOR THE PERIOD OF THIRTY YEARS, TO CONSTRUCT,
MAINTAIN AND OPERATE IN, UNDER, UPON AND ACROSS THE PRESENT AND
FUTURE STREETS, AVENUES, ALLEYS, HIG 'trWAYS, BRIDGES, EASEMENTS
AND OTHER PUBLIC PLACES IN THE CITY OF MIAMI BEACH, FLORIDA, AND
ITS SUCCESSORS, ELECTRIC LIGHT AND POWER LINES, TOGETHER WITH ALL
THE NECESSARY OR DESIRABLE APPURTENANCES, FOR THE PURPOSE OF SUP-
PLYING ELECTRICITY TO SAID CITY, AND ITS SUCCESSORS, THE INHABI-
TANTS THMEOF, AND TO PERSONS AND CORPORATIONS BEYOND THE LIMITS
THEREOF, FOR LIGHT, HEAT, POWER AND OTHER PURPOSES, AND IMPOSING
PROVISIONS AND CONDITIONS RELATING THERETO: -" and "AN ORDINANCE
GRANTING TO THE MIAMI BEACH RAILWAY COI;PANY, ITS SUCCESSORS AND
ASSIGNS , THE RIGHT, PRIVILEGE OR FRANCHISE FOR THE PERIOD OF THIRTY
YEARS, TO CONSTRUCT, EQUIP, OPERATE AND MAINTAIN, ON,. OVER, ALONG
AND ACROSS CERTAIN SPECIFIED STREETS, AVENUES , ALLEYS, HIGH`fdAYS,
BRIDGES AND PUBLIC PLACES IN THE CITY OF MIAMI BEACH, FLORIDA,
AND ITS SUCCESSORS, A STREET RAILWAY, OR OTHER TRANSPORTATION SYS-
TEM, . AND IMPOSING PROVISIONS AND CONDITIONS RELATING THERETO: -"
respectively, and
WHEREAS , the said City Council has heretofore passed and
adopted Ordinance No. 206 entitled "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING AN ELECTION
FOR THE PURPOSE OF SUB.:ITTING TO TN's; QUALIFIED VOTERS OF SAID
CITY FOR THEIR APPROVAL ORDINANCE NO. 204 AND ORDINANCE NO. 205,
OF SAID CITY, AND MAKING PROVISIONS RELATIVE TO THE HOLDING OF
SAID ELECTION," which said ordinance called a special election to
be held on May 20th, 1924, for the purpose of submitting questions
mentioned in said Ordinance No. 206, to the duly registered and
qualified voters of said City.
N0W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that said City Council has this day
publicly canvassed the returns of the aforesaid election, which
canvass was made solely, exclusively and entirely from the re-
turns of certificates of the inspectors and clerk, heretofore
appointed to hold and conduct said election and this City Council,
acting as a Canvassing Board, has found that upon the question
"Shall Ordinance No. 204, adopted by the city Council of the City
of Miami Beach, Florida, April 9, 1924 , and entitled "AN ORDINANCE
GRANTING TO S. R. INCH, HIS HEIRS, LEGAL REPRESENTATIVES AND AS-
SIGNS, THE RIGHT, PRIVILEGE, OR FRANCHISE FOR THE PERIOD OF THIRTY
YEARS, TO CONSTRUCT, MAINTAIN AND OPERATE IN, UNDER, UPON AND ACROSS
THE PRESENT AND FUTURE STREETS, AVENUES, ALLEYS, HIGHWAYS, BRIDGES,
EASEMENTS AND OTHER PUBLIC PLACES IN THE CITY OF MIAMI BEACH,
FLORIDA, AND ITS SUCCESSORS , ELECTRIC LIGHT AND POWER LINES , TO-
GETHER WITH ALL THE NECESSARY OR DESIRABLE APPURTENANCES, FOR THE
PURPOSE OF SUPPLYING ELECTRICITY TO SAID CITY, AND ITS SUCCESSORS,

and become a law?" , 118 votes were cast of which 112 voters
voted "Yes" and 6 voters voted "No". and that upon the ques-
tion "Shall Ordinance No. 205, adopted by the City Council
of the City of Miami Beach, r'lorida, April 9 , 1924, and en-
titled "AN ORDINANCE GRANTING TO THE MIAMI BEACH RAILWAY COM-
PANY, ITS SUCCESSORS AND ASSIGNS , THE RIGHT, PRIVILEGE OR
FRANCHISE FOR THE PERIOD OF THIRTY YEARS, TO CONSTRTJCT,EQUIP,
OPERATE AND MAINTAIN, ON, OVER, ALONG AND ACROSS CERTAIN SPECI-
FIED STREETS, AVENUES, ALLEYS , HIGHWAYS, BRIDGES AND PUBLIC
PLACES IN THE CITY OF MIIAMI BEACH, FLORIDA, AND ITS SUCCESSORS,
A STREET RAILWAY, OR OTHER TRANSPORTATION SYSTEM, AND IMPOSING
PROVISIONS AND CONDITIONS RELATING THERETO: -" be approved and
become a law?", 114 votes were cast of which 109 voters voted
"Yes" and 5 voters voted "No" , and that a majority of the votes
upon each of the aforesaid questions was that said ordinances
No. 204 and 205 be approved and become laws and said Lity Council
does hereby declare the result of said election upon each of
said questions to be that said Ordinances No. 204 and 205 be
approved and become laws of the city of Miami Beach, Florida.
PASSED AND ADOPTED this 21st day of May, A. D. , 1924.
