A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE AN UNDERGROUND EASEMENT
AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY (FPL),
ATTACHED HERETO AS COMPOSITE EXHIBIT A, ALONG THE
PROPOSED TEN (10) FOOT WIDE EASEMENT AREA BETWEEN
75TH STREET AND 76TH STREET, ALONG THE WESTERN PORTION
OF ATLANTIC (AIROSO) WAY, IN ORDER TO UNDERGROUND
EXISTING ABOVE GROUND UTILITIES AND UTILITY LINES, AND TO
GRANT FPL A NON-EXCLUSIVE UNDERGROUND UTILITY
EASEMENT AT THE MUNICIPAL PARKING LOT, P106, AND AT THE
NORTH SHORE BRANCH LIBRARY, LOCATED AT 7515 AND 7505
COLLINS AVENUE, AND ALONG LOTS 2 AND 3, OF BLOCK 8 OF
THE "CORRECTED PLAT ALTOS DEL MAR NO. 1," CONSISTING OF
APPROXIMATELY 3,552 SQUARE FEET FOR THE OPERATION AND
MAINTENANCE OF UNDERGROUND CABLES, CONDUITS, AND
APPURTENANT EQUIPMENT.
WHEREAS, the Office of Capital Improvement Projects is proceeding with the
redevelopment of Altos Del Mar Park, and the construction of a new restroom building
adjacent to Parking Lot 106, located on Collins Avenue between 76th and 77th Streets;
and
WHEREAS, on July 23`d, 2014, subsequent to a series of community and staff
workshops, presentations and a unanimous recommendation for approval from the
Neighborhood/Community Affairs Committee, the Altos Del Mar Master Plan was
presented to, and adopted by the City Commission; and
WHEREAS, RFQ 2015-016-YG, for Architectural and Engineering Design
Services was issued in November, 2014, and pursuant to Resolution No. 2015-28978,
the City Commission approved the manager to negotiate a final design services contract
with Stantec; and
WHEREAS, the park will provide a defined entry plaza, pedestrian beach access
and walkways, amphitheater type seating, open lawn area, sand volleyball courts, a
designated area for future playground, Florida Native landscaping and environmentally
sensitive pathway lighting, with parking to support the park in the adjacent municipal
parking lot, Lot P106; and
WHEREAS, the Historic Preservation Board approved the Master Plan and
thereafter, Stantec began to prepare construction documents; and
WHEREAS, over the years, prior to the 2016 vacation of the Atlantic Way right-
of-way between 76th and 77th streets pursuant to Resolution no. 2016-29340, utility lines
had been installed, without the dedication of an easement, to service the surrounding
community and parking, including switch gear cabinets on the east side of the parking
lot; and
WHEREAS, as part of the Altos Del Mar Park project, existing overhead power
lines are proposed to be undergrounded including, but not limited to cables, conduits,
transformers and poles, will require the City to dedicate a non-exclusive utility easement
to Florida Power & Light Company (FPL); and
WHEREAS, the proposed utility easement will have a total area of approximately
3,552 square feet, running along the west side of Atlantic (Airoso) Way, between 75th
and 76th Streets and along the center median, generally, of the parking lot to the switch
gear cabinet; and
WHEREAS, the granting of the easement will occur entirely on City owned land,
and in the area of Atlantic Way (Airoso Way); and
WHEREAS, no funding is required in order to grant the easement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA authorizing the Mayor and
the City Clerk to execute an underground easement agreement with Florida Power &
Light Company (FPL), attached hereto as Composite Exhibit A, along the proposed ten
(10) foot wide easement area between 75th Street and 76th Street, along the western
portion of Atlantic (Airoso) Way, in order to underground existing above ground utilities
and utility lines, and to grant FPL a non-exclusive underground utility easement at the
municipal parking lot, P106, and at the North Shore Branch Library, located at 7515 and
7505 Collins Avenue, and along Lots 2 and 3, of Block 8 of the "Corrected Plat Altos Del
Mar No. 1," consisting of approximately 3,552 square feet] for the operation and
maintenance of underground cables, conduits, and appurtenant equipment.

The Administration recommends adopting the Resolution and granting the easement.
ANALYSIS
The Office of Capital Improvement Projects is proceeding with the redevelopment of Altos Del Mar
Park, and the construction of a new restroom building adjacent to Parking Lot 106, located on Collins
Avenue between 76th and 77th Streets.
On July 23rd, 2014, pursuant to a series of community and staff workshops, presentations and a
unanimous recommendation for approval from the Neighborhood/Community Affairs Committee, the
Master Plan for the redeveloped park was presented to and adopted by the City Commission. RFQ
2015-016-YG, for Architectural and Engineering Design Services was issued in November, 2014,
and per Resolution No. 2015-28978, the City Commission approved the negotiations of a contract for
design services with Stantec. The park will provide a defined entry plaza, pedestrian beach access
and walkways, amphitheater type seating, open lawn area, sand volleyball courts, a designated area
for future playground, Florida Native landscaping and environmentally sensitive pathway lighting.
Parking to support the new facility will be available in the adjacent parking lot P106.
Pursuant to duly advertised presentations to the community and Historic Preservation Board, the site
plan was approved and construction documents prepared.

As part of the Altos Del Mar Park project, existing overhead and underground utility facilities
(including cables, conduits, transformers and poles) will require the dedication of a non-exclusive
utility easement.
Over the years, prior to the vacation of the Atlantic Way right-of-way between 75th and 76th streets,
utilities were installed to service the surrounding community and parking, including switch gear
cabinets on the east side of the parking lot. At that time, easements were not properly declared or
recorded. In order to provide FPL and other affected utility companies with the ability to operate and
maintain their utilities, the City must establish and record a non-exclusive ten (10) foot wide utility
easement (Exhibit A). The proposed utility easement will have a total area of approxdmately 3,552
square feet, running along the west side of Atlantic(Airoso) Way, between 75th and 76th Streets and
along the center median, generally, of the parking lot to the switch gear cabinet.
On April 13, 2016, the City Commission adopted Resolution No. 2016-29340, granting FPL a non-
exclusive underground utility easement through the Altos Del Mar Park, located between 76th Street
and 77th Street, along the western portion of Atlantic(Airoso)Way.
The granting of the easement will occur entirely on City owned land, and in the area of Atlantic Way
(Airoso Way).
No funding is required in order to grant the easement.
CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the Resolution granting
the non-exclusive utility easement.
