A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY
MANAGER TO EXECUTE AN INTERGOVERNMENTAL AGENCY
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND MIAMI-
DADE COUNTY, ACCEPTABLE TO THE CITY MANAGER AND THE
CITY ATTORNEY, FOR THE INSTALLATION AND MAINTENANCE
OF CERTAIN IMPROVEMENTS ON LOCAL ROADWAYS FOR
DELINEATORS AND GREEN PAINT ON BIKE LANES.
WHEREAS, as part of the Transportation Master Plan and Bicycle-Pedestrian Master Plan
process, the City of Miami Beach Commission adopted a new modal hierarchy consisting of:1-
Pedestrians, 2- Bicycles, Transit, and Freight, and 3- Private Vehicles; and
WHEREAS, through the master planning process, staff received support from the
community and City Commission for segregating and protecting bicycle facilities to reduce conflict
with vehicular traffic; and
WHEREAS, in March 2017, City staff met with members of the West Avenue
Neighborhood Association (WAVNA) to discuss various operation issues on the bicycle lanes
along West Avenue between Lincoln Road and 17th Street; and
WHEREAS, staff observed various vehicles parking on the West Avenue bicycle lanes to
access businesses on the east side of the street and deliveries occurring from the bicycle lanes
on the west side of the street; and
WHEREAS, the site conditions observed were forcing bicyclists to enter travel lanes to
bypass the obstruction, thus increasing the likelihood of conflicts with vehicular traffic; and
WHEREAS, following the review of the site conditions, staff determined that the
installation of delineators was warranted to protect the bicycle lanes and eliminate parking
violations on the bicycle lanes; and
WHEREAS, to transfer its installation and maintenance responsibilities for delineators
and green painted bike lanes, Miami-County is proposing an Intergovernmental Agency
Agreement; and
WHEREAS, given the aesthetic appearance of delineators in an urban environment,
staff will develop a process consisting of both engineering analysis and public input for future
installations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission
hereby authorize the City Manager to execute of an Intergovernmental Agency Agreement
between the City of Miami Beach and Miami-Dade County, acceptable to the City Manager and
the City Attorney, for the installation and maintenance of certain improvements on local roadways
for delineators and green paint on bicycle lanes.

SUBJECT A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE EXECUTION OF AN
INTERGOVERNMENTAL AGENCY AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND MIAMI-DADE COUNTY, ACCEPTABLE TO THE CITY MANAGER
AND THE CITY ATTORNEY, FOR THE INSTALLATION AND MAINTENANCE OF
GREEN BIKE LANES AND DELINEATORS ON LOCAL ROADS.
RECOMMENDATION
The Administration recommends that the Mayor and City Commission approve the Resolution.
BACKGROUND
As part of the Transportation Master Plan and Bicycle-Pedestrian Master Plan process, the City Commission
adopted,by Resolution,a new modal hierarchy consisting of: 1. Pedestrians;2.Bicycles,Transit,and Freight;and 3.
Private Vehicles. Following this new transportation paradigm, staff has been pursuing various projects to enhance
bicycle facilities citywide.Some of these efforts include the implementation of green-painted bicycle lanes along eight
(8) local roadways, advancing the design of parking-protected bicycle lanes and shared-use paths, installation of
bicycle repair stations, installation of more than 600 bicycle racks citywide, and other improvements to enhance the
safety and connectivity of the Citys bicycle network and increase the viability of bicycling as a commuting option.
Through the master planning process, staff received support from the community and City Commission for
segregating and protecting bicycle facilities to reduce conflicts with vehicular traffic. As such, the City has been
pursuing the implementation of protected and buffered bicycle lanes to reduce conflicts and crashes involving
bicycles with pedestrians and vehicles.
In March 2017, Transportation Department staff met with members of the West Avenue Neighborhood Association
(WAvNA)to discuss various operational concerns with the existing bicycle lanes along West Avenue between Lincoln
Road and 17th Street. During an on-site visit,staff observed various vehicles parking on the bicycle lanes to access
businesses on the east side of West Avenue. In addition,staff observed that delivery trucks and ride-share vehicles
frequently block the bicycle lanes on the west side of the street to deliver to and serve the residential buildings on the
west side of West Avenue. The violations were forcing bicyclists to use travel lanes and maneuver around the
obstructions,thus increasing the likelihood of conflicts and accidents with vehicular traffic. Following the review of the
site conditions, staff determined that the installation of plastic tubular delineators was warranted to protect bicyclists
and eliminate parking violations on the bicycle lanes. In addition, staff collaborated with WAvNA in reviewing the
southwest corner of the intersection of West Avenue and 17th Street to look for ways to protect the bicycle lanes and
reduce potential conflicts with eastbound right turning vehicles-a heavy movement at this intersection.
Following the determination to install delineators to protect the integrity of the existing bicycle lanes on West Avenue,

City staff reached out to the County for approval of the installation. County staff was supportive of the concept and
consulted with the Federal Highway Administration to obtain approval for the installation of the delineators. The
delineators were installed in April 2017. Following the installation, the County advised the City that execution of an
Intergovernmental Agency Agreement would be required for this installation as well as for future installations of
delineators on bicycle lanes on local roads in the City.
ANALYSIS
Pursuant to Section 2-96.1 of the Miami-Dade County Code, all traffic control and traffic engineering
services in Miami-Dade County, even within incorporated areas, are under the exclusive jurisdiction
of the County. County Code, however, provides for a municipality to assume certain traffic control
functions through execution of an Intergovernmental Agency Agreement with the County. These
functions can include, but are not limited to, the installation and maintenance of traffic control
devices, such as striping/pavement markings, traffic calming, signage, and delineators, on local
roads, which are considered enhancements above the standard service level provided by the
County.
In July 2017, pursuant to the City's desire to install tubular delineators intended to enhance bicycle
safety on local roads, including West Avenue, the County provided the City with a draft
Intergovernmental Agency Agreement. The Agreement transfers to the City the responsibility of
installing and maintaining green bicycle lanes and delineators on local roadways in the City. By way
of this Agreement, the City assumes all liability of accidents occurring as a result of the installation of
green bicycle lanes and delineators on local roads.
It is worth noting that on July 8, 2015, the City Commission passed and adopted Resolution No.
2015-29082 approving and authorizing the City Manager to negotiate and execute an
Intergovernmental Agency Agreement with Miami-Dade County for painting green all existing bicycle
lanes on local roadways in the City. Said Agreement was not executed by Miami-Dade County. At
this time, both parties have agreed to execute a new Intergovernmental Agency Agreement that
consolidates the installation and maintenance of green bicycle lanes and delineators on local roads.
Additionally, on May 17, 2017, the City Commission passed and adopted Resolution No. 2017-29869
authorizing the execution of a Covenant Agreement with Miami-Dade County for the maintenance of
green bicycle lanes on the Venetian Causeway between Dade Boulevard and the Miami Beach city
limits. This Covenant Agreement was specific to the Venetian Causeway and required by the County
because the Venetian Causeway is under County jurisdiction and not considered to be a "local"
roadway. The City anticipates painting the bike lanes on the Venetian Causeway within City limits in
green during Summer 2017.
Transportation Department staff will continue to apply engineering judgement and seek community
input to determine the suitability of installing delineators to protect the integrity of bicycle lanes on
local roads in the City.
