2017-29940 Resolution RESOLUTION NO. 2017-29940 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FOLLOWING A DULY NOTICED PUBLIC HEARING, AS REQUIRED PURSUANT TO SECTION 82-93(b), OF THE CITY CODE, APPROVING A REVOCABLE PERMIT REQUEST BY 901 ALTON ROAD, INC., TO ALLOW THE REMOVAL AND REPLACEMENT OF THE EXISTING STAIRCASE (25'-6" x 5'-10") WITH A NEW STAIRCASE (28'-6" x 5'-6") FOR THE SERVICE WINDOW AT THE SAME LOCATION ON 9TH STREET FOR THE 901 ALTON ROAD PROPERTY; AND RELOCATION OF THE EXISTING ADA ACCESS RAMP (23'-9" x 7'-11") EAST OF THE STAIRCASE, WITH A NEW ACCESS RAMP OF THE SAME DIMENSIONS, ALL WITHIN THE PUBLIC RIGHT-OF-WAY, TO IMPROVE PUBLIC ACCESSIBILITY TO THE CAFE; WHICH PERMIT IS CONSISTENT WITH THE CRITERIA OF SECTION 82-94, OF THE CITY CODE; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE REVOCABLE PERMIT WHEREAS, 901 Alton Road Inc., (Applicant) is the owner of the building, located at 901 Alton Road, and is requesting a revocable permit for the removal and replacement of the existing staircase measuring 25'-6" x 5'-10" with a new staircase measuring 28'-6" x 5'-6" at the service window of David's Café, extending the staircase by approximately three (3) feet, and relocation of the existing ADA access ramp east measuring 23'-9 x 7'-11" east of the staircase, with a new access ramp of the same dimensions, all within the public right-of-way, to improve public accessibility to the Café; and WHEREAS, the Applicant is requesting to encroach into the public right-of-way and has applied for a revocable permit to allow for the removal and replacement of the staircase, and relocation of the ADA access ramp east of the staircase; and WHEREAS, at its June 7, 2017 meeting, pursuant to Section 82-93(a) of the City Code, the City Commission approved the Resolution on First Reading, and scheduled a public hearing to consider the request for a revocable permit; and WHEREAS, additionally, in accordance with Section 82-93(b) of the City Code, to mail notice of the public hearing to owners of land lying within 375 feet of the existing permit area; and WHEREAS, Public Works has analyzed the criteria contained in Sections 82-94 and believes the application to be consistent with the criteria therein and has provided the City Commission with a report analyzing the relevant criteria; and WHEREAS, pursuant to Section 82-94, of the City Code, entitled "Criteria for granting/denying revocable permits," the City's decision to grant or deny a revocable permit is based upon the following criteria: (1) That the applicant's need is substantial. (2) That the applicant holds title to an abutting property. (3) That the proposed improvements comply with applicable codes, ordinances, regulations, neighborhood plans and laws. (4) That the grant of such application will have no adverse effect on governmental/utility easements and uses on the property. (5) Alternatively: a. That an unnecessary hardship exists that deprives the applicant of a reasonable use of the land, structure or building for which the revocable permit is sought arising out of special circumstances and conditions that exist and were not self-created and are peculiar to the land, structures or building involved and are not generally applicable to other lands, structures or buildings in the same zoning district and the grant of the application is the minimum that will allow reasonable use of the land, structures or building; or b. That the grant of the revocable permit will enhance the neighborhood and/or community by such amenities as, for example, enhanced landscaping, improved drainage, improved lighting, and improved security. (6) That granting the revocable permit requested will not confer on the applicant any special privilege that is denied by this article to other owner of land, structures or buildings subject to similar conditions located in the same zoning district. (7) That granting the revocable permit will be in harmony with the general intent and purpose of this article, and that such revocable permit will not be injurious to surrounding properties, the neighborhood, or otherwise detrimental to the public welfare; and WHEREAS, consistent with 82-94, of the City Code, the Administration, through the Public Works Department, recommends granting the revocable permit, as the new ramp along the right-of-way ensures that the existing structure provides ADA access to the disabled; that the applicant's need is substantial; that the applicant holds title to an abutting property; that the proposed improvements comply with applicable codes, ordinances, regulations, neighborhood plans and laws; that the grant of such application will have no adverse effect on governmental/utility easements and uses on the property; that the permit does not provide a special privilege that is denied to other land, structures or buildings; that the permit is in harmony with the general intent of Chapter 83; is not otherwise detrimental to the public welfare; that an unnecessary hardship exists that deprives the applicant of a reasonable use of the land, structure or building for which the revocable permit is sought arising out of special circumstances and conditions that exist and were not self-created and are peculiar to the land, structures or building involved and are not generally applicable to other lands, structures or buildings in the same zoning district and the grant of the application is the minimum that will allow reasonable use of the land, structures or building; and that the grant of the revocable permit will enhance the neighborhood and/or community by such amenities; and WHEREAS, the conditions for the revocable permit comply with the requirements of Section 82-95, as it relates to the terms and conditions for the issuance of the permit, and conditions for its termination; and WHEREAS, the City Manager and the Public Works Director Administration recommend approval of the revocable permit request. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission, following a duly noticed public hearing, as required pursuant to Section 82-93 of the City Code, approving a revocable permit request by 901 Alton Road, Inc., to allow the removal and replacement of the existing staircase (25'-6" x 5'-10") with a new staircase (28'-6" x 5'-6") for the service window at the same location on 9th Street for the 901 Alton Road property; and relocation of the existing ADA access ramp (23'-9" x 7'-11") east of the staircase, with a new access ramp of the same dimensions, all within the public right-of-way, to improve public accessibility to the café; which permit is consistent with the criteria of Section 82-94, of the City Code; and authorizing the Mayor and City Clerk to execute the revocable permit. ANALYSIS 901 Alton Road Inc., (Applicant) is the owner of the building, located at 901 Alton Road, and is requesting a revocable permit for the removal and replacement of the existing staircase measuring 25'-6" x 5'-10" with a new staircase measuring 28'-6" x 5'-6" at the service window of David's Café, extending the staircase by approximately three (3) feet, and relocation of the existing ADA access ramp east measuring 23'-9" x 7'-11" east of the staircase, with a new access ramp of the same dimensions, and all within the public right-of-way, to improve public accessibility to the Café. The Applicant is requesting to encroach into the public right-of-way and has applied for a revocable permit to allow for the removal and replacement of the staircase, and relocation of the ADA access ramp east of the new staircase. The City Code provides the ability to obtain a revocable permit for encroachment into the public right- of-way. The Applicant satisfies the revocable permit criteria stated in Section 82-94 of the City Code a follows: • The Applicant's need is substantial. The revocable permit will allow the Property to maintain its current function, and improve public accessibility. •The Applicant holds title to an abutting property. The proposed improvements will be installed per applicable codes under a separate Building Department permit, allow for free pedestrian access and does not obstruct the right-of-way. The improvements will have no adverse effect on governmental/utility easements on the property. • That the grant of the revocable permit will enhance the neighborhood and/or community by such amenities as, for example, enhanced landscaping, improved drainage, improved lighting, and improved security. The proposed improvements will promote pedestrianism and general access in the area. The introduction of the improvements will increase the value of the Property, and in turn that of the neighborhood. Furthermore, it will be desirable to visitors by enhancing the appearance of the public walkway and the property. • That granting the revocable permit requested will not confer on the applicant any special privilege that is denied by this article to other owners of land, structures or buildings subject to similar conditions located in the same zoning district. Granting the revocable permit will not confer any special privilege upon the Applicant. Any property owner within the City of Miami Beach can apply for a revocable permit; provided that the application meets the criteria stated in the Code does not interfere with the utilization of public property, and enhances the community. • That granting the revocable permit will not devalue any of the adjacent properties and will not have a detrimental effect on the public welfare. In fact it will improve the historic character of the property and the surrounding area.
