OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AND AUTHORIZING THE CITY MANAGER TO ISSUE A
CERTIFICATION OF CONSISTENCY WITH THE CITY'S
CONSOLIDATED PLAN TO DOUGLAS GARDENS
COMMUNITY ME NT AL HEALTH CENTER OF MIAMI

BY THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT TO CONTINUE PROVIDING
TRANSITIONAL HOUSING TO FORMERLY HOMELESS
PERSONS WITH DISABILITIES AT THE MAYFAIR HOTEL,
1960 P ARK AVENUE, MIAMI BEACH.
WHEREAS, on July 1, 1998, the Mayor and City Commission approved the City's
Consolidated Plan; and
WHEREAS, Douglas Gardens Community Mental Health Center of Miami Beach, Inc.
(Douglas Gardens) currently operates a transitional housing program at the Mayfair Hotel, 1960 Park
A venue, Miami Beach, providing twenty (20) units of supportive housing for persons with
disabilities; and
WHEREAS, Douglas Gardens has applied for funding under the Supportive Housing
Program, sponsored by U.S. Department of Housing and Urban Development (U.S. HUD) to
continue operating this facility; and
WHEREAS, U.S.HUD requires that applicants for Federal funding under the Supportive
Housing Program obtain and submit a Certification of Consistency with the Consolidated Plan from
the entitlement jurisdiction where the proposed activity is located; and
WHEREAS, in accordance with the City's adopted Consolidated Plan, each request for a
Certification of Consistency with the Consolidated Plan requires City Commission review and
approval; and
WHEREAS, 1:he Administration has reviewed the proposed activity and found it to be
consistent with the Consolidated Plan.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager is
authorized to issue a Certification of Consistency with the City's Consolidated Plan to Douglas
Gardens Community Mental Health Center of Miami Beach, Inc. to utilize funds provided directly
by the U.S. Departmtmt of Housing and Urban Development to continue providing transitional
housing to formerly homeless persons with disabilities at the Mayfair Hotel, 1960 Park Avenue,
Miami Beach.

ADMINISTRA TION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
On April 19, 1999, Douglas Gardens Community Mental Health Center of Miami Beach, Inc.,
(Douglas Gardens) requested a Certification of Consistency with the City's Consolidated Plan as part
of an application for funds from the U.S. Department of Housing and Urban Development (U.S.
HUD) under the Supportive Housing Program. Douglas Gardens is submitting a grant application
to U.S. HUD for $300,000 annually for a period of three years. This grant will be utilized by
Douglas Gardens to continue to offer twenty (20) units of transitional housing for formerly homeless
persons with disabilities at the Mayfair Hotel, 1960 Park Avenue, Miami Beach.
The proposed application from Douglas Gardens is to be included in an application to be submitted
to U.S. HUD by the Miami-Dade Homeless Trust (Homeless Trust) in response to the annual Notice
of Funding Availability ("Super NOF AU). The Homeless Trust is submitting one application on
behalf of local housing providers seeking funds under the Supportive Housing Program.
U.S. HUD requires that applicants for funding under the Supportive Housing Program obtain and
submit a Certification of Consistency with the Consolidated Plan from the entitlement jurisdiction
where the activity is to be located. In accordance with the Consolidated Plan adopted by the City,

each request for a Certification of Consistency with the Consolidated Plan requires City Commission
review and approval.
On May 1, 1996, a Douglas Gardens representative appeared before the City Commission requesting
a Certification of Consistency with the City's Consolidated Plan for a proposal to acquire,
rehabilitate and operate the Mayfair Hotel as a residence for formerly homeless persons with
disabilities. The City Commission did not act to issue the Certification of Consistency.
On May 29, 1996, Douglas Gardens filed a complaint with the Department of Housing and Urban
Development (U.S. HUD) , styled Douglas Gardens Community Mental Health Center of Miami
Beach. Inc. v. City of Miami Beach C.D.. et ai, U.S. HUD Case No. 04-96-0292-8, alleging
violations of the Fair Housing Act, involving the Mayfair Hotel. The case alleged discrimination
on the part of the City against Special Needs groups.
On January 22, 1997, the City Commission adopted Resolution No. 97-22269, approving and
authorizing the Mayor and City Clerk to execute a Conciliation Agreement by and between the City
of Miami Beach, Douglas Gardens and U.S. HUD, in settlement of the lawsuit. As part of the
settlement, the City issued a Certification of Consistency with the Consolidated Plan to Douglas
Gardens to provide housing services, including 20 units of transitional housing at the Mayfair Hotel.
Also as part of the settlement, the City provided Douglas Gardens with $750,000 in HOME Program
funds to acquire the Mayfair Hotel. Subsequently, Douglas Gardens acquired the property and
completed a rehabilitation of the building in 1998.
ANALYSIS:
Every year, since 1995, Douglas Gardens has been providing twenty (20) units of transitional
housing to forty (40) formerly homeless individuals with disabilities at the Mayfair Hotel.
Supportive services for the residents of the Mayfair Hotel are provided at the Douglas Gardens
Clinical Offices at 701 Lincoln Road.
The Administration has reviewed the documentation submitted by Douglas Gardens describing the
activity, and has concluded that the continuation of this activity is consistent with the City's
Consolidated Plan. The Consolidated Plan identifies long term objectives in Chapter 4, "Five Year
Strategy". Under the Homelessness Strategy (Continuum of Care), page 54, the Plan specifies that
Douglas Gardens will continue to provide supportive housing for the formerly homeless. The Plan
also supports efforts to assist special needs populations in general.
CONCLUSION:
The Administration recommends adoption of the attached Resolution of the Mayor and City
Commission of the City of Miami Beach, Florida, approving and authorizing the City Manager to
issue a Certification of Consistency with the City's Consolidated Plan to Douglas Gardens
Community Mental Health Center of Miami Beach, Inc. to utilize funds provided directly by the
