Ordinance 1048 ORDINANCE NO . 1048
AN ORDINANCE MAKING IT UNLAWFUL TO PUBLISH,
CIRCULATE OR CAUSE TO BE PUBLISHED OR CIR-
CULATED DURING THE EIGHTEEN DAYS PRECEDING
ANY MUNICIPAL ELECTION, ANY CHARGE OR AT-
TACK UPON ANY CANDIDATE UNLESS A COPY OF
SUCH CHARGE OR ATTACK HAS BEEN PERSONALLY
SERVED UPON SUCH CANDIDATE AT LEAST EIGHTEEN
DAYS PRIOR TO SUCH ELECTION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: It shall be unlawful during the eighteen (18) days
preceding the day of any municipal election in
Miami Beach, Florida, to publish or circulate or cause to be
published or circulated, any charge against, or attack upon,
any candidate who is to be voted upon at such election unless
a copy of such charge or attack has been served personally
upon the candidate against whom made at least eighteen (18)
days prior to the day of the election. Any answer to a charge
or attack that contains defensive matter, or any statement
which consists of the citation of, reference to, or quotation
from a public record, shall not be construed to be a charge
or attack.
SECTION 2: That all ordinances and parts of ordinances in
conflict herewith be and the same are hereby re-
pealed .
SECTION 3: Pursuant to the authority granted by Senate Bill
No . 610, Laws of Florida, Acts of 1953, the three
readings of this ordinance shall be had at one session of the
City Council and this ordinance shall go into effect immediately
upon its passage .

of Miami Beach, Florida, do hereby certify that Ordinance No.
1048, entitled: "AN ORDINANCE MAKING IT UNLAWFUL TO PUBLISH,
CIRCULATE OR CAUSE TO BE PUBLISHED OR CIRCULATED DURING THE
EIGHTEEN DAYS PRECEDING ANY MUNICIPAL ELECTION, ANY CHARGE OR
ATTACK UPON ANY CANDIDATE UNLESS A COPY OF SUCH CHARGE OR
ATTACK HAS BEEN PERSONALLY SERVED UPON SUCH CANDIDATE AT LEAST
EIGHTEEN DAYS PRIOR TO SUCH ELECTION", having been passed and
adopted by the City Council of the City of Miami Beach, Florida,
has been posted by me in three conspicuous places in the City
of Miami Beach, one of which was at the door of the City Hall
in said City on the 13th day of May, A. D. 1953, and that said
Ordinance remained posted for a period of at least thirty days
in accordance with the requirements of the City Charter of the
said City of Miami Beach.

affixed the official seal of the City of Miami Beach, Florida,
on this the 1st day of July, A. D. 1953.
