AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS "TIE ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH".
BE IT ORDAINED BY THE CITY COUNCIL CF TIE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Ordinance leo. 289 of the City of Miami Beach,
Florida, and the maps attached thereto and made a
part thereof, be and the same are hereby amended
so as to place and include in Area District No. 13,
as said. District is therein set forth and defined, the following
described lands, situate, lying and being in Miami Beach, Dade
County, Florida, to wit:
All of Blocks 11 and 12 of Biscayne Point,
according to the Plat thereof, recorded in
Plat Book 14, at page 35, of the Public Rec-
ords of Dade County, Florida.
SECTION 2. That Ordinance No. 289 of the City of Miami Beach,
Florida, and the maps attached thereto and made a
part thereof, be and the same are hereby amended
so as to place and include in Area District No. 7,
as said district is therein set forth and defined, the following
described lands, situate, lying and being in Miami Beach, Dade
County, Florida, to-wit :
Lots 1 to 7, inclusive, of a subdivision of
Lot 5, Block 31 of Lake View Subdivision, ac-
cording to Plat thereof, recorded in Plat Book
43, at page 77, of the Public Records of Dade
County, Florida.
SECTION 3. That Ordinance No. 289 of the City of Miami Beach,
Florida, and the maps attached thereto and made a
part thereof, be and the same are hereby amended
so as to place and include in Area District No. 13,
as said district is therein set forth and defined, the following
described lands, situate, lying and being in Miami Beach, Dade
County, Florida, to-wit ;
Lot 8 of a subdivision of Lot 5, Block 31,
of Lake View Subdivision, according to Plat
thereof, recorded in Plat Book 43, at page
77, of the Public Records of Dade County,
Florida.
SECTION 4 . That Ordinance No. 289 of the City of Miami Beach,
Florida, and the maps attached thereto and made a
part thereof, be and the same are hereby amended
so as to place and include in Area District No. 19,
as said district is therein set forth and defined, the following
described lands, situate, lying and 'Ding in Miami Beach, Dade
County, Florida, to-wit :
Lots 1 and 2 of Block "C" ;
Lots 1 and 7 of Block "D" ;
Lots 1 and 2 of Block 2;
Lot 1 of Block 3; The East 60 feet of
"Wireless Station" property in Block 3;
The East 60 feet of Lot 12, Block 3;
The East 60 feet of that portion of
Block 3 lying North of said Lot 12;
All in Miami Beach Improvement Company' s

Ocean Front Property, according to the
Plat thereof, recorded in Plat Book 5,
at pages 7 and 8, of the Public Records
of Dade County, Florida.
SECTION 5. That that portion of Section 16 of Ordinance No. 289
of the City of Miami Beach, Florida, reading as follows:
"DISTRICT NO. 19. There shall be a rear
yard having a depth of not less than five
( 5) feet provided, however, on a lot whose
rear abuts on a street, waterway or alley,
no rear yard will be required, and provided
further that where any building is to be
constructed allowing no rear yard, adequate
provisions shall be made within the building
for the storage and handling of garbage cans
and refuse . Lots zoned for business uses
which adjoin lots zoned for residential uses
shall provide a five ( 5) ft. side yard on
the side adjoining the residential lot"
be and the same is hereby amended by adding thereto, at the end
thereof, the following :
"On the West side of Collins Avenue between
19th Street and 24th Street, there shall be
a set-back from Collins Avenue having a depth
of not less than sever and one half ( 7i) feet."
SECTION 6. That Section 21 of Ordinance No. 289 of the City of
Miami Beach, Florida, be and the same is hereby amended
to read as follows:
"upon its own initiative, or upon the petition
of the owners of a majority of frontage in any
area, the City Council may, after having held
a public hearing following at least fifteen days'
notice of a time, place and object of such hear-
ing, published in an official paper, or a paper
of general circulation in said City, amend,
supplement , change, modify or repeal the regu-
lations and boundaries herein established, pro-
vided, however, that no amendment shall become
effective except by the favorable vote of five-
sevenths ( 5/7) of all of the members of the City
Council.
The provisions relative to public hearings and
official notices shall apply equally to all
changes and amendments. "
SECTION 7. That this Ordinance shall go into effect immediately upon
its passage and posting as required by law.

entitled "AN ORDINANCE AMENDING ORDINANCE NO. 2g9, COMMONLY KNOWN AS
"THE ZONING ORDINANCE OF THE CITY OF MIAMI BEACH" , having been passed
and adopted by the City Council of the City of Miami Beach, Florida,
has been posted by me in three conspicuous places in the City of
Miami Beach, Florida, one of which was at the door of the City Hall
in said City on the lst day of August, A.D. , 1945, and that said
Ordinance remained posted for a period of at least thirty days in
accordance with the requirements of the City Charter of the said City
of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida, on
this the 5th day of September, A.D. , 1945..
