AN ORDINANCE AMENDING SECTION 1,02.02 AND
SECTION 1,03.05.02 OF ORDINANCE NO, 592
OF THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY
- KNOWN AS THE "MIAMI BEACH BUILDING CODE".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 1,02.02 of Ordinance No. 592 of the City
of Miami Beach, Florida, commonly known as the "Miami
Beach Building Code" be and the same is hereby amended by adding
thereto, at the end thereof, the following:
".09 Any person desiring a permit to be
issued by the Building, Division, as required
hereby, shall, in addition to filing an ap-
plication therefor, pay to the City of Miami
Beach, Florida, before such permit is issued,
a fee as required in this Section, based on
the estimated cost of construction, as follows:
New building, additions, alterations
and/or remodelling:
Up to $200.00 $ 2,50
$201.00 to $1,000.00 5.00
For each additional $1,000.00 or
fraction thereof - 2000
Repairs:
Up to $1,000.00 - 2,00
For each additional $1,000.00 or
fraction thereof - 2.00
House moving:
House moving 10.00
Demolitions:
Each structure demolished,
for each 51,000.00 or fraction thereof- - -- - - _ 1,00
Concrete and/or hard surfaced
Walks, Driveways, Paving, etc.
on Private Property:
For each $1,000.00 or fraction thereof 1.00
Elevator Installations:
For each elevator installed
or replaced 5.00
".10 No building permit shall be issued to any
person, firm or corporation unless the applicant
therefor shall, at the time of issuance of such
permit, make a deposit with the proper official
of said city authorized to issue such permit, of
the sum of Fifty Dollars ($50.00) , and at the
same time entering into an agreement with said
City that he will immediately upon completion of
the construction or repair, for which such permit
is to be issued, clear the street and all property
used by such applicant in such construction or re-
pair, of all building material, equipment, rubbish
and other things placed or used by him in such con-
struction or repair, and will repair any and all
damage to any street or sidewalk which he shall have
caused, and agreeing that, if he does not so clear
such premises and make such repairs, that said City
may appropriate such part or all of said Fifty Dol-
lars (50.00) as may be necessary in the clearing of
such premises and making such repairs as aforesaid
and that, after such premises are so cleared and
such repairs mad,, if done by said City, then that
partof it not �iused in rags ng the exre2r7 of such
clearance and such repairs, shall be returned to
said applicant,
For the purposes of this Code such construction or
repair shall be deemed to have been completed when
such building shall be occupied in part or in whole,
after such construction or repair, or when such com-
pletion shall have been accomplished, or have been
accomplished except for the doing of some minor
thing which may necessitate a delay.
Said agreement shall be in substantially the follow-
ing form:
"KNOW ALL MEN BY THESE PRESENTS: That I,

upon the following described property in said City:-
, do hereby deposit with

Dollars ($50.00) , and I agree with said City that,
when such construction shall have been completed by
me within the meaning of the ordinances of said City,
I will clear all premises used by me for the deposit
of material or equipment in the construction or re-
pair, and will repair any and all damages to any
street or sidewalk which I shall cause, and that, if
I do not so clear such premises and make such repairs
immediately upon the completion of such construction
within the meaning of such ordinances, the said City
may clear the same and make such repairs, and pay the
cost of such clearance and such repairs out of the
aforesaid Fifty Dollars ($50,00) , and return the re-
mainder to me; and that if I shall clear said property
and make such repairs immediately as aforesaid, then
said Fifty Dollars ($50.00) shall be returned to me.

day of A. D. 19__.

".11.+ The City of Miami Beach, The County of Dade,
the State of Florida, and the United States of America,
shall be exempt from paying any fee for any building
permit, Permits to such governmental units shall be
issued and marked "no charge". Churches and charitable
organizations shall be exempt from paying any fee for
any building permit, provided the proposed work is
done only on structures to be devoted to religious or
charitable purposes.
".12 Applications for building permits shall contain an
estimate of the cubic contents of the building as a basis
for determining the proper fee to be charged. The cubic
contents shall be taken as the area of the building in
square feet multiplied by the height in feet, taking the
height from the grade level or cellar or basement floor
to the average height of the roof. "
SECTION 2. That Section 1.03.05.02 of Ordinance No. 592, reading as
follows:
"BUILDERS: For the purpose of examining General Contrac-
tors and Building Supervisors, there shall
be appointed by the City Manager, by and with the consent
of the City Council, an Examining Board consisting of the
Chief Building Inspector, as ex-officio secretary, and in
addition thereto, one registered practicing architect,
one registered practicing structural engineer and one com-
petent licensed general contractor, each of whom shall
have had at least ten (10) years of responsible exper-
ience in his respective field, and an established place
of business in the City of Miami Beach. The Chief Build-
ing Inspector shall hold office during his incumbency as
such, and the other members shall be appointed for over-
lapping terms of three (3) years, subject to removal by
the City Council on charges of misconduct and after an
opportunity for a public hearing. Examinations shall be
written, and shall be conducted with due regard to the
responsibilities attaching to the classification for
which examination is taken."

SECTION 3. That all ordinances, or parts of ordinances, in conflict
herewith be and the same are hereby repealed.
SECTION 4. That this ordinance shall go into effect immediately upon
its passage and posting as required by law.

having been passed and adopted by the City Council of the City
of Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, Florida, one of
which was at the door of the City Hall in said City on the 22nd
day of September, A. D. , 1945, and that said Ordinance remained
posted for a period of at least thirty days in accordance with
the requirements of the City Charter of the said City of Miami
Beach.
