AN ORDINANCE AMENDING ORDINANCE NO. 402
OF THE CITY OF MIAMI BEACH, FLORIDA, EN-
TITT D: "AN ORDINANCE REGULATING AND
RESTRICTING THE LOCATIONS WHEREIN THE
BUSINESS OF THE SATE OF LIQUOR, AS HEREIN
DEFINED, MAY BE CONDUCTED; PRESCRIBING
PENALTIES FOR THE VIOLATION HEREOF AND
PROVIDING FOR THE ENFORCEMENT HEREOF. "
BE IT ORDAINED BY TIIE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Ordinance No. 402 of the City of Miami Beach,
Florida, be and the same is hereby amended by adding
thereto, immediately after Section 9 thereof, an
additional section reading as follows:
"SECTION 92: In "H" District the sale of
liquor is prohibited except from service
bars in bona fide restaurants and in hotels
having one hundred or more sleeping rooms,
provided that each of said hotel sleeping
rooms shall meet the requirements of
Section 5. 18.06.01 of Ordinance No. 592
of the City of Miami Beach, Florida, and
provided that the exterior of the hotel
in which the business is carried on shall
not contain a store front in connection with
said business and the business so licensed
shall only be entered from within the build-
ing. "
SECTION 2. That Ordinance No. 402 and the maps attached thereto and
made a part thereof be and the same are hereby amended
so as to remove from "F" District as therein referred to and
described, and to place in "I" District as therein referred to and
described, the following described property situate in Miami Beach,
Dade County, Florida, to-wit :
All that parcel of land described as follows:
Beginning at the Southeast Corner of
GOLF COURSE SUBDIVISION of Alton Beach
Realty Company, as shown on amended plat
of same; thence Easterly along the North
line of Lincoln Road produced Easterly, for
a distance of 70 feet; thence Northerly
along a line parallel to and 70 feet Easterly
of. said Golf Course Subdivision for a dis-
tance of 150 feet ; thence Westerly along
a line parallel to and 150 feet Northerly
of said North line of Lincoln Road, produced
Westerly, for a distance of 70 feet to the
said Easterly line of Golf Course Subdivision;
thence Southerly along the said Easterly line
of Golf Course Subdivision for a distance of
150 feet to the point of beginning as said
road and subdivision are shown on a plat re-
corded in Flat Book 6, at page 26, of the
Public Records of Dade County, Florida, and
that part of bridle path lying East , except
the South 75 feet thereof;
AND
All that parcel of land described as follows :

From a concrete monument located at the
intersection of the West line of Jefferson
Avenue and the North line of Lincoln Road,
more particularly described as being 1350
feet East and 270 feet North of the South-
west corner of the NW- of Section 34, Town-
ship 53 South, Range 42 East ; run Easterly
along the North line of Lincoln Road a dis-
tance of 794.10 feet to the point of beginning;
from said point of beginning run Northerly
along a line perpendicular to the last men-
tioned course a distance of 105 feet to a
point; thence run Easterly along a line paral-
lel with the North line of Lincoln Road a dis-
tance of fifty feet to a point; thence run
Southerly along a line perpendicular to the
North line of Lincoln Road a distance of 105
feet to a point ; thence run Westerly along
the North line of Lincoln Road a distance of
fifty feet to the point of beginning of the
parcel of land herein described, except the
South seventy-five feet thereof;
AND
All that parcel of land described as follows:

more particularly described as being 1350
feet East and 270 feet North of the Southwest
Corner of the NV,1 ,; of Section 34, Township
53 South, Range 42 East ; run Easterly along
the North line of Lincoln Road a distance of
744. 10 feet to the point of beginning of the
parcel of land herein described; from said
point of beginning run Northerly along a line
perpendicular to the last mentioned course
a distance of 125 feet to a point; thence
run Easterly along a line parallel with the
North line of Lincoln Road a distance of 50
feet to a point ; thence run Southerly along
a line perpendicular to the North line of
Lincoln Road a distance of 125 feet to a
point ; thence run Westerly along the North
line of Lincoln Road to point of beginning
of the parcel of land herein described, ex-
cept the South 75 feet thereof;

of COMMERCIAL SUBDIVISION, according to
the Plat thereof, recorded in Plat Book
6, at page 5, of the Public Records of
Dade County, Florida, except the South
75 feet thereof;
AND

46 of COMMERCIAL SUBDIVISION, according to
the Plat thereof, recorded in Plat Book 6,
at page 5, of the Public Records of Dade
County, Florida, except the North 75 feet
thereof;

Lots 1 to 6, inclusive, of Block 51;
Lots 1 to 4, inclusive, of Block 52; of

to the Plat thereof, recorded in Plat Book

County, Florida, except the North 75 feet
thereof;

FISHER'S FIRST SUBDIVISION of Alton Beach,
according to the Plat thereof, recorded
in Plat Book 2, at page 77, of the Public
Records of Dade County, Florida,except the
South 75 feet thereof;
AND
Allof Lot 1 of Block 35; and Lot 1 of
Block 36, of AMENDED GOLF COURSE SUBDIVISION,
according to the Plat thereof, recorded in
Flat Book 6, at page 26, of the Public Records
of Dade County, Florida, except the South 75
feet thereof;
AND
All of Lots 7 to 12, inclusive, of Block 47;
Lots 7 to 12, inclusive, of Block 48;
Lots 7 to 12, inclusive, of Block 49; of
LINCOLN SUBDIVISION, according to the Plat
thereof, recorded in Plat Book 9, at page
69, of the Public Records of Dade County,
Florida, except the North 75 feet thereof;
AND
All of Lots 1 to 6, inclusive, of Block .;
Lots 1 to 7, inclusive, of Block 2;
Lots 1 to 7, inclusive, of Block 3; of
LINCOLN SUBDIVISION, "A", according to the
Plat thereof, recorded in Plat Book 34, at
page 66, of the Public Records of Dade County,
Florida, except the South 75 feet thereof;
AND
Lot 4 of Block 53 of PINE RIDGE SUBDIVISION,
according to the Flat thereof, recorded in
Flat Book 6, at page 34, of the Public Records
of Dade County, Florida, except the North 75
feet thereof.

SECTION 3. This ordinance shall go into effect immediately upon
its passage and posting as required by law.

THE LOCATIONS WHEREIN THE BUSINESS OF THE SALE OF LIQUOR, AS
HEREIN DEFINED, MAY BE CONDUCTED; PRESCRIBING PENALTIES FOR
THE VIOLATION HEREOF AND PROVIDING FOR THE ENFORCEMENT HEREOF. "
having been passed and adopted by the City Council of the City
of Miami Beach, Florida, has been posted by me in three conspicu—
ous places in the City of Miami Beach, Florida, one of which
was at the door of the City Hall in said City on the 16th day
of January, A. D. , 1946, and that the said Ordinance remained
posted for a period of at least thirty days in accordance with
the requirements of the City Charter of the said City of Miami
Beach.
