Ordinance 766 ORDINANCE NO. 766
AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, DESIGNATING THE LOCATION OF
BULKHEADS ALONG THE ATLANTIC OCEAN; PRO-
VIDING THAT NO MATERIAL SHALL BE EXCAVATED
FROM THE ATLANTIC OCEAN FOR THE PURPOSE OF
BACK-FILLING ANY BULKHEAD; LIMITING THE
EXTENT OF GROYNES; AND PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That no bulkhead shall be constructed or erected be-
tween the southerly line of Tract 1 of the Bath Club
Property as shown on plat thereof, recorded in Plat
Book 40, at page 14, of the Public Records of Dade County, Florida,
and the northerly line of Lot 43, Block 1 of Second Ocean Front
Property, as shown on Amended Plat thereof, recorded in Plat Book
28, at page 28, of the Public Records of Dade County, Florida;
which shall be east of a line described as follows:
Beginning at a point which is on the southerly line
of Tract 1 of the Bath Club Property as per plat re-
corded in Plat Book 40, at page 14, of the Public
Records of Dade County, Florida, and 395 feet east of
the easterly line of Collins Avenue; thence northerly
along a straight line to a point on the northerly line
of Lot 21-A, Block 1, of the Second Ocean Front Property
as per amended plat recorded in Plat Book 28, at page
2g, of the Public Records of Dade County, Florida, and
which is 240 feet east of said easterly line of Collins
Avenue; thence northerly along a straight line to a
point on the northerly line of Lot 21-H of said Block
1, of said Second Ocean Front Property, and which is
290 feet east of said easterly line of Collins Avenue;
thence northerly along a straight line to a point on
the northerly line of Lot 22 of said Block 1 of said
Subdivision, and which is 240 feet east of said easterly
line of Collins Avenue; thence northerly along a
straight line to a point on the northerly line of Lot
25 of said Block 1 of said Subdivision, and which is
260 feet east of said easterly line of Collins Avenue;
thence northerly along a line parallel and 260 feet
easterly of said easterly line of Collins Avenue to a
point on the northerly line of Lot 43 of said Block 1
of said Subdivision.
SECTION 2: That no material shall be excavated from the Atlantic
Ocean for the purpose of back-filling behind any
bulkhead.
SECTION 3: That no groyne shall be constructed or erected which
shall extend into the ocean a distance of more than
200 feet from the bulkhead line described in Section
1 of this ordinance, provided, however, that aroyne
may be constructed at the dividing line between Lots 39 and 40 of
Block 1 of Second Ocean Front Property, the subdivision referred to
in Section 1 hereof, which may extend a distance, not to exceed,
225 feet from said bulkhead line.
SECTION 4: Any person convicted of the violation of any of the
provisions of this ordinance shall, upon conviction,
be fined not exceeding $500.00 or be imprisoned in
the City Jail not exceeding Sixty Days (60) , or by both such
fine and imprisonment, in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute
a separate offense.

entitled: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA,
DESIGNATING THE LOCATION OF BULKHEADS ALONG THE ATLANTIC OCEAN;
PROVIDING THAT NO MATERIAL SHALL BE EXCAVATED FROM THE ATLANTIC
OCEAN FOR THE PURPOSE OF BACKFILLING ANY BULKHEAD; LIMITING THE
EXTENT OF GROYNES; AND PROVIDING PENALTIES FOR THE VIOLATION OF
THIS ORDINANCE, " having been passed and adopted by the City Council
of the City of Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, Florida, one of which
was at the door of the City Hall in said City on the 5th day of
June , A. D. , 1946, and that said Ordinance remained posted for a
period of at least thirty days in accordance with the requirements
of the City Charter of the said City of Miami Beach.
