Ordinance 890ORDINANCE No. 890 AN ORDINANCE AMENDING ORDINANCE 289 of THE CITY OF MIAMI BEACH FLORIDA, COMMONLY KNOWN AS THE "ZONING ORDIN- ANCE OF THE CITY OF MIAMI BEACH, FLORIDA" WHEREAS the safety and welfare of the public of the City of Miami B each, Florida, requires the provision of more adequate streets and thoroughfares, and WHEREAS the provision of such streets and thoroughfares will require the acquisition by the City of Miami Beach of additional lands for street widening purposes, and WHEREAS the City Council of the City of Miami Beach deems it to be to the best interest of said City to maintain the status quo with respect to areas available for such acquisition, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 16 of ordinance 289 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately preceding the last paragraph thereof, the following: "District No. 46, There shall be a front yard having a depth of notless than fifteen (15) feet when measured from any waterway, bay or ocean. There shall be a rear yard having a depth of not less than thirty (30) feet when measured from the street line. There shall be a side yard having a width of notless than ten (10) feet on either side of a building. "District No. 47. There shall be a front yard having a depth of notless than fifteen (15) feet when measured from any waterway, bay or ocean. There shall be a rear yard having a depth of not less than thirty-five (3 5) feet when measured from the street line. There shall be a side yard having a width of notless than ten (10) feet on either side of a building. "District No. 48, There shall be a front yard having a depth of notless than fifteen (15) feet when measured from any waterway, bay or ocean. There shall be a rear yard having a depth of not less than forty (+0) feet when measured from the street line. There shall be a side yard having a width of not less than ten (10) feet on either side of a building. "District No. 49. There shall be a front yard having a depth of notless than thirty (30) feet when measured from any waterway, bay or ocean. There shall be a rear yard having a depth of not less than sixty (60) feet when measured from the street line. There shall be a side yard having a width of notless than ten (10) feet on either side of a building. OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA "District No. 50. There shall be a front yard having a depth of not less than forty (40) feet when measured from any waterway, bay or ocean. There shall be a rear yard having a depth of not less than sixty-five (65) feet when measured from the street line. There shall be a side yard having a width of not less than five (5) feet on either side of a building." SECTION 2: That ordinance 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part hereof, be and the same are hereby amended so as to include in area District No. 46 as set forth and described in said ordinance the following described property situate in Dade County, Miami Beach, Florida, to wit: Lot 11 of Block 3 of amended plat of Second Ocean Front Subdivision, according to plat thereof, recorded in Plat Book 28 at page 28 of Public Records of Dade County, Florida. SECTION 3: That ordinance 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in area District No. 47 as set forth and described in said ordinance the following described property situate in Dade County, Miami Beach, Florida, to wit: Lot 12 of Block 3 of amended plat of Second Ocean Front Subdivision, according to plat thereof, recorded in Plat Book 28 at page 28 of Public Records of Dade County, Florida. SECTION 4: That ordinance 289 of the City of Miami Beach Florida, and the maps attached thereto and made aa part hereof, be and the same are hereby amended so as to include in area District No. 4$ as set forth and described in said ordinance the following described property situate in Dade County, Miami Beach, Florida, to wit: Lots 13 to 19, both inclusive of Block 3 of amended plat of Second Ocean Front Subdivision, according to plat thereof recorded in Plat Book 28 at page 28 of Public Records of Daae County, Florida. SECTION 5: That ordinance 289 of the City of Miami Beach, Florida,nd the maps attached therto and made a part hereof, be and the same are hereby amended so as to include in area District No. 49 as set forth and described in said ordinance the following described property situate in Dade County, Miami Beach, Florida, to wit: Lots 20 to 28, both inclusive of Block 3 of amended plat of Second Ocean Front Subdivision, according to plat thereof recorded in Plat Book 28 at page 28 of Public Records of Dade County, Florida. -2- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA SECTION 6: That ordinance 289 of the City of Miami Beach Florida and the maps attached thereto and made aa part thereof be and the same are hereby amended so as to include in area District No. 50 as set forth and described in said ordinance, the following described property situate in DadeCounty, Miami Beach, Florida, to wit: Lots 29 to 40, both inclusive of Block 3 of amended plat of Second Ocean Front Subdivision, according to plat thereof recorded in Plat Book 28 at page 28 of Public Records of Dade County, Florida. SECTION 7: That all ordinances or parts of ordinances in con- flict herewith are hereby repealed. SECTION 8: That the welfare of the City is imperiled and this ordinance is hereby declared to be an emergency measure and to be necessary for the immediate pre- servation of the public peace and safety, and the three readings thereof shall be had at one session, and this ordinance shall go into effect immediately upon its passage. D. 1949, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of said City of Miami Beach.
