AN ORDINANCE AMENDING SECTION 16 OF ORDINANCE
NO. 289 OF THE CITY OF MIAMI BEACH, FLORIDA,
COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE
CITY OF MIAMI BEACH, FLORIDA".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That that portion of Section 16 of Ordinance No. 289 of the
City of Miami Beach, Florida, reading as follows:
"DISTRICT NO. 42: There shall be a front yard having a depth of
not less than 90 feet when measured from the bulkhead line
described and established by Ordinance No. 832 of the City of
Miami Beach, Florida. There shall be a rear yard having a
depth of not less than five (5) feet and there shall be a side
yard having a width of not less than five (5) feet on either
side of a building."
be and the same is hereby amended to read as follows:
"DISTRICT NO. 42: There shall be a front yard having a depth of

SECTION 2: That that portion of Section 16 of Ordinance No. 289 of the
City of Miami Beach, Florida, reading as follows:
"DISTRICT NO. 45: In this District both Collins Avenue and the
Atlantic Ocean shall be considered as front.
There shall be a front yard having a depth of not less than
15 feet on lots facing Collins Avenue. There shall be a side
yard having a width of not less than 5 feet on either side of
a building. There shall be a rear yard having a depth of not
less than 5 feet. There shall be a front yard on lots facing
the Atlantic Ocean, the eastern and western boundaries of which
shall be the lines described as follows:
The Westerly boundary line shall be a line described as follows:
Beginning at a point which is on the northerly line of 33rd
Street extended easterly and 255 feet easterly of the easterly
line of Collins Avenue; thence run in a northerly direction
to a point on the southerly line of Lot 2, Block 19, extended
easterly of the Amended Map of the Ocean Front Property of the
Miami Beach Improvement Company and 253 feet easterly of the
said easterly line of Collins Avenue; thence run in a
northerly direction to a point on the northerly line of 34th
Street extended easterly and 254 feet easterly of the said
easterly line of Collins Avenue; thence run in a northerly
direction to a point on the northerly line of 41st Street and
241 feet easterly of said easterly line of Collins Avenue;
thence run in an easterly direction along said northerly line
of 41st Street for a distance of 16 feet; thence run in a
northerly direction to a point on the northerly line of 44th
Street extended easterly and 221 feet easterly of said easterly
line of Collins Avenue; as said Collins Avenue, Streets, Lot
and Block are shown on the Amended Map of the Ocean Front
Property of the Miami Beach Improvement Company, recorded in
Plat Book 5, at pages 7 and 8, of the Public Records of Dade
County, Florida, and as said Streets are named and designated
in City of Miami Beach Ordinance No. 232.

The Easterly boundary line shall be a line described as
follows:
Beginning at a point which is on the northerly line of 33rd
Street extended easterly and 345 feet easterly of the easterly
line of Collins Avenue; thence run in a northerly direction to
4 point on the southerly line of Lot 2, Block 19, extended
easterly of the Amended Map of the Miami Beach Improvement
Company and 343 feet easterly of the said easterly line of
Collins .Avenue; thence run in a northerly direction to a
point on the northerly line of 34th Street extended easterly
and 344 feet easterly of the said easterly line of Collins Ave-
nue; thence run in a northerly direction to a point on the
northerly line of 41st Street extended easterly and 325 feet
easterly of the said easterly line of Collins Avenue; thence
run in a northerly direction to a point on the northerly line
of 44th Street extended easterly and 311 feet easterly of said
easterly line of Collins Avenue, as said Collins Avenue, Streets,
Lot and Block are shown on the Amended Map of the Ocean Front
Property of the Miami Beach Improvement Company, recorded in
Plat Book 5, at pages 7 and 8, of the Public Records of Dade
County, Florida, and as said Streets are named and designated
in City of Miami Beach Ordinance No. 232."

SECTION 3: That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby repealed.
SECTION 4: That this ordinance shall go into effect immediately upon its
passage and posting as required by law.

Ordinance No. 910, entitled: "AN ORDINANCE AMENDING
SECTION 16 OF ORDINANCE NO. 289 OF THE CITY OF MIAMI
BEACH, FLORIDA, COMMONLY KNOWN AS THE "ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA", having been
passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, one of
which was at the door of the City Hall in said City on
the 21st day of December, A. D. 1949, and that said
Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the
City Charter of the said City of Miami Beach.
