Ordinance 862ORDINANCE NO. 862 AN ORDINANCE AMENDING ORDINANCE NO. 289 OF THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida, be amended by inserting therein, immediately preceding the last paragraph thereof, the following: "DISTRICT NO. 45: In this District both Collins Avenue and the Atlantic Ocean shall be considered as front. There shall be a front yard having a depth of not less than 15 feet on lots facing Collins Avenue. There shall be a side yard having a width of not less than 5 feet on either side of a building. There shall be a rear yard having a depth of not less than 5 feet. There shall be a front yard on lots facing the Atlan- tic Ocean, the eastern and western boundaries of which shall be the lines described as follows: The Westerly boundary line shall be a line described as follows: Beginning at a point which is on the northerly line of 33rd Street extended easterly and 255 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 253 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 254 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the norther- ly line of 41st Street and 241 feet easterly of said easterly line of Collins Avenue; thence run in an easterly direction along said northerly line of 41st Street for a distance of 16 feet; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 221 feet easterly of said easterly line of Collins Avenue; as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Im- provement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232. The Easterly boundary line shall be a line described as follows: (1) Beginning at a point which is on the northerly line of 33rd Street extended easterly and 345 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improve- ment Company and 343 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly di- rection to a point on the northerly line of 34th Street extended easterly and 344 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street extended easterly and 325 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 311 feet easterly of said easterly line of Collins Avenue, as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232." SECTION 2: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 45, and in "RE" Multiple - Family District, as said Districts are referred to and described in said Ordinance? those certain parcels of land situate, lying and being in Miami Beach, Dade County, Florida, describe. as follows, to -wit: "All of that certain parcel of land bounded on the West by the East line of Collins Avenue; bounded on the South by the Northerly line of 33rd Street and the extension thereof eastwardly; bounded on the North by the Northerly line of 44th Street ex- tended eastwardly; bounded on the East by a line described as follows: Beginning at a point which is on the northerly line of 33rd Street extended easterly and 345 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 343 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 344 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street extended easterly and 325 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 311 feet easterly of said easterly line of Collins Avenue, as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Im- provement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232, except those por- (2) tions thereof dedicated for use as public streets." D. 1948, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the .3ity of Miami Beach.
