AN ORDINANCE AMENDING SECTION 9 OF ORDINANCE
NO. 335, ENTITLED: "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF MIALI BEACH,
FLORIDA, REGULATING THE OPERATION OF TAXICABS
IN THE CITY OF MIAEI BEACH, FLORIDA, FIXING
THE RATES TO BE CHARGED FOR THE SERVICES OF
TAXICABS IN THE CITY OF MIAI'MI BEACH, FLORIDA;
PROVIDING FOR TI -IE INSTALLATION OF METERS UPON
TAXICABS IN THE CITY OF MIAMI BEACH, FLORIDA;
PROVIDING A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE, AND DEFINING TAXICABS FOR TILE PUR-
POSE OF THIS ORDIINIANCE."
BE IT ORDAINED BY THE CITY COUNCIL OF TIU CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: THAT Section 9 of Ordinance No. 335 of the City
of Miami Beach, Florida, be and the same is hereby
amended to read as follows:
"SECTIOII 9: Any person who shall violate any of
the provisions of this ordinance shall, upon convic-
tion thereof, be punished by a fine of not less than
Five W5.00) Dollars, nor more than Two Hundred
(200.00) Dollars, or by imprisonment for not more
than thirty (30) days, or by both such fine and im-
prisonment in the discretion of the Municipal Judge
of the City of Miami Beach; provided, however, that
any person who commits such violation in the presence
of any police officer of the City of Miami Beach may
be served by such police officer with a summons,
as provided for in Ordinance No. 258 of the City of
Miami Beach, to appear in person at the Traffic Bureau
of the City of Miami Beach not later than the time
which shall thereon he specified and at such time
and place such person may plead guilty to the charge
upon which he has been so summoned and pay a fine
according to the following schedule:
1st offense >3.00
2nd offense 5 00
3rd and subsequent offenses shall be
referred by the Traffic Bureau to the Muni-
cipal Court for disposition;
and provided, further, that the plea of guilty and
the payment of the fine as provided above shall be
deemed a legal conviction, and, upon such conviction,
or, upon conviction by the Municipal Judge of the
violation of any of the provisions of this Ordinance,
the City Manager may revoke or temporarily suspend,
for such period as said City Manager may fix, any
permit theretofore issued by the said City Manager
for the operation of the taxicab involved in said
violation, or any license or permit heretofore
issued the driver thereof."
S_]CTION 2: That this ordinance shall go into effect immediately
upon its passage and posting as required by law.

BEACH, FLORIDA; PROVIDING FOR THE INSTALLATION OF METERS UPON
TAXICABS IN THE CITY OF MIAMI BEACH, FLORIDA; PROVIDING A
PENALTY FOR THE VIOLATION OF THIS ORDINANCE, AND DEFINING
TAXICABS FOR THE PURPOSE OF THIS ORDINANCE", having been
passed and adopted by the City Council of the City of Miami
Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, ';lorida, one of which was
at the door of the City Hall in said City on the 5th day of
May, A. D. 1948, and that said Ordinance remained posted for
a period of at least thirty days in accordance with the require-
ments of the City Charter of the City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 14th day of June, A. D. 1948.
