Ordinance 957 ORDINANCE NO. 957 AN ORDINANCE AMENDING ORDINANCE NO. 289 OF THE CITY OF MIAMI BEACH, FLORIDA, COP- %IONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That that portion of Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida, reading as follows: "DISTRICT NO. 19. There shall be a rear yard having a depth of not less than five (5) feet; provided, however, on a lot whose rear abuts on a street, water- way or alley, no rear yard will be required, and pro- vided further that where any building is to be con- structed allowing no rear yard, adequate provisions shall be made within the building for the storage and handling of garbage cans and refuse, Lots zoned for business uses which adjoin lots zoned for residential use shall provide a five (5) ft. side yard on the side adjoining the residential lot. On the west side of Collins Avenue between 19th Street and 24th Street, there shall be a setback from Collins Avenue having a depth of not less than seven and one-half (n) feet. On the North side of 71st Street between Indian Creek and that certain alley running North and South through Block 6 of Normandy Beach South, a subdivision accord- ing to the Plat thereof, recorded in Plat Book 21, at pare 54, of the Public Records of Dade County Florida, and on the South Side of 71st Street between Indian Creek and a line running North and South through the middle of Block 11 of said Subdivision, there shall be a setback from 71st Street of not less than five ( 5) feet, and 71st Street shall be considered the front of the lots in said areas. " be and the same is hereby amended to read as follows: "DISTRICT NO. 19: There shall be a rear yard having a depth of not less than five (5) feet; provided, however, on a lot , the rear of which abuts on a street, waterway or alley, no rear yard will be required, and provided further that where any building is to be constructed allowing no rear yard, adequate provisions shall be made within the building for the storage and handling of gar- bage cans and refuse. Lots zoned for business uses which adjoin lots zoned for residential use shall provide a five (5) foot side yard on the side adjoining the resi- dential lot. On the 'Jest side of Collins Avenue between 19th Street and 24th Street, and on the {Nast Side of Collins Avenue between 19th Street and 21st Street, there shall be a setback from Collins Avenue having a depth of not less than Ten (10) Feet. On the north side of 71st Street between Indian Creek and that certain alley running North and South through Block 6 of Normandy Beach South, a subdivision according to the Plat thereof re- corded in Plat Book 21, at page 54, of the Public Records of Dade County, Florida, and on the South Side of 71st Street between Indian Creek and a line running North and South through the middle of Block 11 of said Subdivision, there shall be a setback from 71st Street of not less than five (5) feet, and 71st Street shall be considered the front of the lots in said areas." -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA SECTION 2: That that portion of Section 16 of Ordinance 1:o. 289 of the City of Miami Beach, Florida, reading as follows: • "DISTRICT NO. 41: There shall be a front yard having a depth of not less than 75 feet when measured from the bulkhead line described and established by Ordi- nance No. 832 of the City of Miami Beach, Florida. Adequate provisions shall be made within the building for the storage and handling of garbage cans and refuse." be and the same is hereby amended by adding thereto, at the end thereof, the following: "On the east side of Collins Avenue between 22nd Street and 24th Street there shall be a setback from Collins Avenue having a depth of not less than ten (10) Feet." D. 1950, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
