AN ORDINANCE AWIENDING ORDINANCE NO. 941
OF THE CITY OF MIAMI BEACH, FLORIDA,
ENTITLED: "AN ORDINANCE OF THE CITY OF
MIAMI BEACH, FLORIDA, PROVIDING CONDI-
TIONS UNDER WHICH PERMANENT CANOPIES
CAN BE ERECTED OVER CITY SIDEWALKS;
PROVIDING FOR CANOPY DISTRICTS; PROVI-
DING FOR ITS ENFORCEMENT; PROVIDING
FOR THE PROTECTION OF THE CITY AGAINST
CLAIMS RISING OUT OF SUCH CANOPIES;
PROVIDING TyAT THIS ORDINANCE SkALL TAKE
PRECEDENCE OVER OTHER CITY ORDINANCES;
AND PROVIDING FOR PENALTIES FOR VIOLA-
TIONS HEREOF."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLOR I DA:
SECTION 1: That Section 3 of Ordinance No. 941 of the City of Miami
Beach, Florida, reading as follows:
"SECTION 3: The City Engineer shall be responsible
for the enforcement of this ordinance, and all
building plans providing for such permanent cano-
pies shall be submitted to, andapproved by, him
before any building permit is issued by the build-
ing Department."
be and the same is hereby amended to read as follows:
"SECTION 3: The City Engineer shall be responsible
for the enforcement of this ordinance, and all
building plans providing for such permanent canopies
shall be submitted to, and approved by, him before
any building permit is issued by the building Depart-
ment ; provided, however, that no displays or signs of
any kind shall be erectedon or suspended from any
canopy provided for in this ordinance, except that
signs composed of open-faced letters, not more than
twenty-four inches in height and located not less
than six inches back from the open edge of such
canopy may be erected on the upper surface only,
said sign and the erection thereof being otherwise
subject to the provisions of Ordinance No. 460 of
the City of Miami Beach, Florida, commonly known as
"The Sign Ordinance". "
SECTION 2: This ordinance shall go into effect immediately upon
its passage and posting as required by law.

OF MIAMI BEACH, FLORIDA, ENTITLED: 'AN ORDINANCE OF THE CITY OF
MIAMI BEACH, FLORIDA, PROVIDING CONDITIONS UNDER WHICH
PERMANENT CANOPIES CAN BE ERECTED OVER CITY SIDEWALKS; PROVIDING
FOR CANOPY DISTRICTS; PROVIDING FOR ITS ENFORCEMENT; PROVIDING
FOR THE PROTECTION OF THE CITY AGAINST CLAIMS RISING OUT OF
SUCH CANOPIES; PROVIDING THAT THIS ORDINANCE SHALL TAKE
PRECEDENCE OVER OTHER CITY ORDINANCES; AND PROVIDING FOR

by the City Council of the City of Miami Beach, Florida, has been
posted by me in three conspicuous places in the City of Miami Beach,
one of which was at the door of the City Hall in said City on the
17th day of May, A. D. 1951, and that said Ordinance remained posted
for a period of at least thirty days in accordance with the require-
ments of the City Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and affixed
the official seal of the City of Miami Beach, Florida, on this
