AN ORDINANCE AMENDING SECTION 13.65 OF "THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 13.65 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby amended
to read as follows:
"SEC. 13.65. SAME - REGULATIONS CONCERNING PREMISES WHERE
FRESH FISH SOLD.
All stores or other places for keeping, handling or sale of
fresh fish, or fresh fish products, shall comply with the
following requirements:
a. Establishments where the handling or selling of
fresh fish, or fresh fish products is a principal business,
shall be in completely enclosed buildings. Doors shall not
exceed four feet (41-0") in width and shall be solid with
self-closing devices. Such buildings shall have hard,
smooth, impervious and washable floors, such as concrete,
terrazzo, or tile, and shall have floor drains properly
trapped, and connected to the city sewer. The walls and
ceiling shall be plastered with a hard coat plaster and shall
be wainscotted to a height of six feet (61-0") from the floor
with a hard, smooth, impervious washable material, such as
tile. Such establishments shall be equipped with air condition-
ing systems.
b. Establishments such as grocery markets, having the
sale of fresh fish, or fresh fish products, as an adjunct or
accessory feature, shall not be required to be totally en-
closed or air-conditioned, but those areas used for the selling
of fresh fish, or fresh fish products, shall meet the require-
ments of paragraph (a) as to floors, walls and ceilings, and
wainscotting, except that wainscott will not be required to
be more than fcur feet (41-0") high. In all such establish-
ments there shall be provided a separate preparation room
where all cleaning, dressing and preparation of fresh fish
for sale shall be done, and which shall be fully enclosed with
floors, drains, walls, ceiling and wainscotting provided as
specified in paragraph (a). Such preparation room shall be
equipped with hot and cold running water and an air condition-
ing system.
c. No false floors or treads shall be permitted unless
facilities to clean and dry them are provided within the
building.
d. All work tables and counters shall have stainless
steel, tile, or similar impervious, smooth and washable work
surfaces.
e. Display counters and other fresh fish storage places
shall be refrigerated and properly fitted with all necessary
drains connected to the sewer system.
f. Fresh fish wastes shall be kept in refrigerated
containers at all times, so located as to be readily access-
ible for garbage collection. In establishments where the
selling or handling of fresh fish is an accessory business,
there shall be provided an adequate enclosed space for the
storage of empty fresh fish barrels and boxes within the
preparation room, which space shall be accessible for the
collection of such trash.

g. Adequate toilet facilities shall be provided to-
gether with lavatories equipped with hot and cold
water, and a supply of disposable towels and soap
shall be kept available, at all times.
h. It shall be the duty of the Chief Building Inspector
to enforce the provisions of this section.
SECTION 2: All ordinances or parts of ordinances in,00nflict
herewith are hereby repealed.
SECTION 3: If any portion of this ordinance shall be declared
invalid, the remaining portions shall remain in
force and effect as though such invalidated portion had not
been included.
SECTION 4: This ordinance shall go into effect on June 1, 1953,
PASSED and ADOPTED this 4th day of February, A. D. 1953.

that Ordinance No. 1038, entitled: "AN ORDINANCE
AMENDING SECTION 13.65 OF 'THE CODE OF THE CITY OF
MIAMI BEACH, FLORIDA, 1950'", having been passed and
adopted by the City Council of the City of Miami Beach,
Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at
the door of the City Hall in said City on the 5th day
of February, A. D. 1953, and that said Ordinance remained
posted for a period of at least thirty days in accordance
with the requirements of the City Charter of the said
City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 18th day of March, A. D. 1953.
