AN ORDINANNCE AMENDING ORDINANCE NO. 289
OF THE CITY OF MIAMI BEACH, FLORIDA
CONmONLY KNOWN AS THE "ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 7 of Ordinance No. 289 of the City
of Miami Beach, Florida, be and the same is hereby
amended to read as follows:
"SECTION 7: USE REGULATIONS
"BA" Business District.
In the "BA" Business District no building or land shall be used
and no building shall be hereafter erected, constructed, re-
constructed or structurally altered which is designed, arranged
or intended to be occupied or used for any purpose, unless
otherwise provided for in this ordinance, excepting for one or
more of the following uses :
1. Any use permitted in the "BAA" Business District.
2. Grocery stores.
3. Meat Markets (except the handling of live poultry) .
4. Auction Sales Rooms, Galleries or Houses, provided that
passageways, corridors, aisles or other facilities for
public entrance to or exit from said establishment shall
for the purpose of this ordinance, be deemed a part of
said establishment; and provided, further, that no signs,
displays or advertising of any nature in connection with
said establishment shall be located on any land or build-
ing where the operation of the business is not permitted
by this ordinance.
5. Mortuaries, only upon approval and permit of the City
Council of the City of Miami Beach.
6. Night Clubs, only upon approval and permit by the City
Council of the City of Miami Beach.
7. Locksmith Shops, sharpening and grinding shops.
8. Shoe Repairing Shops, only upon special permit of the
City Council of the ity of Miami Beach.
9. Boats - Charter, Livery, and For-Rent, upon approval and
permit of the City Council of the City of Miami Beach.
10. Self-service Laundries: Provided only domestic type
dryers, having a capacity per unit not exceeding 32
pounds of dry clothing, are used, and the machines shall
be screened from the street by a reception room, office
space, or other suitable means, so that the machines shall
not be in view of the public.
11. Bowling Alleys in sound-proofed air-conditioned rooms on
the second floor of any building.
or any other similar enterprises or businesses, which are not
more obnoxious or detrimental to the welfare of the particular
community than the enterprises or businesses herein enumerated:'
SECTION 2: That Section 8 of Ordinance No. 289 of the City of
Miami Beach, Florida, be and the same is hereby
amended by deleting therefrom Item Number 15, said item reading
as follows:

"15. Auction sales shall be permitted only upon appro-
val and permit of the City Council of the City of
Miami Beach, in any portionof the "BB" Business
District which lies south of the northerly line of
Eighth Street in said City of Miami Beach."
SECTIOl : That Section 9 of Ordinance No. 289 of the City of
Miami Beach, Florida, be and the same is hereby
amended by deleting therefrom Item Number 24, said item reading
as follows:
"24. Auction sales shall be permitted, only upon appro-
val and permit of the City Council of the City of
Miami Beach."
SECTION 4: That this ordinance shall go into effect immediately
upon its passage, and posting as required by law.

994+, entitled: "AN ORDINANCE AMENDING ORDINANCE NO. 289 OF
THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY KNOWN AS THE
'ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA" ,
having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in three
conspicuous places in the City of Miami Beach, one of which
was at the door of the City Hall in said City on the 23rd day
of November, A. D. 1951, and that said Ordinance remained posted
for a period of at least thirty days in accordance with the
requirements of the City Charter of the said City of Miami
Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 9th day of January, A. D. 1952.
