AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, PROVIDING FOR THE TIME AND
METHOD OF QUALIFYING AS CANDIDATES FOR
THE OFFICE OF CITY COUNCILMAN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: Candidates for the office of City Councilman shall
qualify with the City Clerk not later than noon
April fifteenth of the year in which any general
municipal election is held.
SECLIOif 2: Candidates for the office of City Councilman shall
qualify by paying to the City Clerk a sum in cash
equal to three (3o) per cent of the annual salary
of said office, which said sum shall be deposited by the City
Clerk in the City Treasury for the purpose of helping to defray
the costs of such election, and by filing the affidavit herein-
after required.
SECTION 3: Candidates for the office of City Councilman must
be qualified electors of the City of Miami Beach,
Florida.
SECTION 4: Every candidate for the office of City Councilman is
required to take, sign and subscribe to an oath or
affirmation in writing, in which he will state (1)
the title of the office for which he is a candidate; (2) that
he is a qualified elector of the City of Miami Beach, Florida;
(3) his legal residence, by street and number; (1+) that he is
qualified under the ordinances andcharter of the City of Miami
Beach, Florida, to hold the office for which he is a candidate;
(5) that he has paid the qualification fee required by Section 2
hereof; (6) that he has not violated any of the ordinances or
laws of the City of Miami Beach or of the State of Florida re-
lating to the election or registration of electors; and (7) that
he is not a member of, nor does he subscribe to the principles
of any group that seeks to overthrow the Government or the
Constitution of the United States of America.
Such oath or affirmation shall be filed with the City Clerk
simultaneously with the payment of the required qualifying fee.
Such oath or affirmation shall be substantially in the following
form:

Before me, an officer authorized to administer
oaths, personally appeared , to
me well kno n, who, being sworn, says that he is a can-
didate for the office of City Councilman for the City of
Miami Beach, Florida; that he is a qualified elector of
said City; that his legal residence is (lumber)
(Street), Miami Beach, Dade County,
Florida; that he is qualified under the Ordinances and
Charter of said City to hold such office; that he has paid
to the City Clerk of said City a qualifying fee in cash
equal to three (3%) per cent of the annual salary of said
office of City Councilman; that he has not violated any of

the ordinances or laws of the City of Miami Beach or of
the State of Florida relating to the elections or
registration of electors; and that he is not a member of,
nor does he subscribe to the principles of any group that

SECTION 5: The City Clerk shall not accept any oath or
affirmation for filing unless the same is
accompanied by the payment of the required
qualifying fee.
SECTIOI' 6: All persons who have paid the qualifying fee and
filed the oath or affirmation, in accordance with
the provisions hereof, shall be qualified candi-
dates for the office of City Councilman at the next election
and the City Clerk shall print their names on the ballot in
alphabetical order.
SECTION 7: This ordinance shall go into effect immediately
upon its passage and posting as required by law.

I, C. W. TOMLINSON, City Clerk in and for the
City of Miami Beach, Florida, do hereby certify that Ordinance
No. 1035, entitled: "AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, PROVIDING FOR THE TIME AND METHOD OF QUALIFYING AS
CANDIDATES FOR THE OFFICE OF CITY COUNCILMAN", having been
passed and adopted by the City Council of the City of Miami
Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one cf which was at the
door of the City Hall in said City on the 24th day of December,
A. D. 1952, and that said Ordinance remained posted for a
period of at least thirty days in accordance with the require-
ments of the City Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 4th day of February, A. D. 1953.
