Ordinance 1100 ORDINANCE NO. 1100
AN ORDINANCE AMENDING ORDINANCE
NO. 289, COMMONLY KNOWN AS "THE
ZONING ORDINANCE OF THE CITY OF
MIAMI BEACH, FLORIDA" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 : That that portion of Section 16 of Ordinance
No . 289 of the City of Miami Beach, Florida
reading as follows :
"DISTRICT NO. 19 . There shall be a rear yard having
a depth of not less than five (5) feet; provided, how-
ever, on a lot, the rear of which abuts on a street,
waterway or alley, no rear, yard will be required, and
provided further that where any building is to be con-
structed allowing no rear yard, adequate provisions shall
be made within the building for the storage and handling
of garbage cans and refuse . Lots zoned for business uses
which adjoin lots zoned for residential use shall provide
a five (5) foot side yard on the side adjoining the re-
sidential lot . On the West side of Collins Avenue be-
tween 19th Street and 24th Street, and on the East Side
of Collins Avenue between 19th Street and 21st Street,
there shall be a setback from Collins Avenue having a
depth of not less than ten (10) feet . On the north
side of 71st Street between Indian Creek and that cer-
tain alley running North and South through Block 6 of
Normandy Beach South, a subdivision according to the
Plat thereof recorded in Plat Book 21, at page 54, of
the Public Records of Dade County, Florida and on the
South Side of 71st Street between Indian Creek and a
line running North and South through the middle of
Block 11 of said Subdivision, there shall be a set-
back from 71st Street of not less than five (5) feet,
and 71st Street shall be considered the front of the
lots in said areas . "
be and the same is hereby amended by adding thereto at the end
thereof the following :
"PROVIDED, HOWEVER, that no rear yard will be required
on Lots 1 to 22 inclusive and Lots 63 to 82 inclusive,
of Block 10 of Ocean Side Section of ' the Isle of Normandy,
according to the Plat thereof, recorded in Plat Book
25, page 60 of the Public Records of Dade County, Flo-
rida, nor on the lots lying on the North side of Lincoln
Road between Meridian Avenue and Jefferson Avenue . "
SECTION 2: That Section 21 of Ordinance No . 289 of the City of
Miami Beach, Florida be and the same is hereby amend-
ed to read as follows :

"SECTION 21 . CHANGES AND AMENDMENTS . Upon its
own initiative , or upon the petition of the own-
ers of a majority of frontage in any area, the
City Council may, after having held apublic
hearing following at least fifteen (15) days
notice of a time, place and object of such hear-
ing published in an official paper, or a paper
of general circulation in said City of Miami
Beach, amend, supplement, change, modify or re-
peal the regulations and boundaries herein es-
tablished, provided, however, that no amendment
shall become effective except by the favorable
vote of five-sevenths (5/7thsjof all the members
of the City Council . . Ana, provided further,
that if the hearing is to be on the question of
a change in the boundaries herein established
then such fifteen (15) days notice shall be
given by mail to the owners of record of land
lying within 375 feet of the land the boundaries
of which are proposed to be changed.
The provisions relative to public hearings and
official notices shall apply equally to all
changes or amendments . "
SECTION 3: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 4-: That this ordinance shall go into effect immedi-
ately upon its passage and posting as required
by law.

No. 1100, entitled: "AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS 'THE ZONING ORDINANCE OF THE CITY OF MIAMI
BEACH, FLORIDA", having been passed and adopted by the City
Council of the City of Miami Beach, Florida, has been posted
by me in three conspicuous places in the City of Miami Beach,
one of which was at the door of the City Hall in said City
on the 3rd day of December, A.D. 1953, and that said Ordinance
remained posted for a period of at least thirty days in
accordance with the requirements of the City Charter of the
said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 3rd day of February, A. D. 1954.
