AN ORDINANCE ADDING "THE CODE OF THE CITY
OF l`UATa BEACH, FLORIDA, 1950"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAN] BEACH,
'FE3O RI DA:
SECTION 1. That "The Code of the City of _:iami Beach, Florida
1950" be and it is hereby amended by adding thereto
immediately after Section 37.94 thereof the following:
SECTION 37.9)4.1_. The following words and phrases, when
used in Sections 37.94.1 through 37.94.4
of this Code shall, for the purposes of the aforesaid
Sections, have the meanings respectively ascribed to them,
as follows:
( a) "Truck" : The word "truck" shall mean any motor
vehicle designed or used principally for carrying
things other than passengers and includes a motor
vehicle to which has been added a cabinet box,
platform, rack or other equipment for the purpose
of carrying merchandise other than the personal
effects of the passengers; also, any unit consisting
of a tractor and trailer so constructed as to haul
merchandise or loads other than persons; also,
ambulances, hearses or automobile wreckers owned
and used by a garage in connection with its regular
business.
(b) "Tractor": The term "tractor" shall mean any motor
vehicle having four or more wheels designed or
used for drawing other vehicles, but having no
provision for carrying loads.
(c) "Trailer": The term "trailer" shall mean all
vehicles of four or more wheels coupled to, or
drawn by, or which are designed to be coupled to,
or drawn by, any motor vehicle,
(d) "Semi-trailer" : The word "semi-trailer" bhall mean
any two-wheel vehicle coupled to, or drawn b , or
which is designed to be coupled to, or drawn by,
any motor vehicle.
(e) "Net Weight" : The words "net weight" shall mean
the actual scale weight with complete catalogue
equipment.
SECTION 37.91 .2. It shall be unlawful for any person to
park, or cause to be parked, a truck,
tractor, trailer or semi-trailer, upon the public streets
in any area of the City of Miami Beach zoned as "RAA", "RA",
"RB", "RC" or "RD" Use Districts, as the said districts
are shown in Ordinance No. 289 of the City of Miami Beach,
Florida, except ( a) while loading or unloading property,
or (b) when such vehicle is parked in connection with, and
in aid of, the performance of a service to or on the
property in the block in which the vehicle is parked.

SECTION 37.9 ..3. It shall be unlawful for any person
to park, or cause to be parked, a
truck, tractor, trailer or semi-trailer, having a net
weight of more than 3,000 pounds, upon the public
streets in any area of the City of Miami Reach zoned
as "RDD", "RDE", "RE", or "REE ' Use Districts as the
said districts are shown in Ordinance No. 289 of the
City of Miami Leach, Florida, except ( a) while loadin,
or unloading property, or (b) when such vehicle is
parked in connection with and in aid of the performance
of a service to or on the property in the block in
which the vehicle is parked.
SECTION 37.9)4.)4. In any prosecution for the violation
of any of the provisions of Section
37.;)..3 hereof, proof that a truck bears a Florida
license tag of a series other than "G" or "GE" license
series, as prescribed in Section 320.08 Florida Statutes
1953 shall be prima facie evidence that the truck is in
excess of 3,000 pounds net weight.
SECTION 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held
to be unconstitutional, such decision shall not affect the
validity of the remaining portion of said ordinance.
SECTION 4. This ordinance shall take effect immediately upon
its passage and posting as required by law.

of Miami Beach, Florida, do hereby certify that Ordinance
No. 1119, entitled: "AN ORDINANCE AMENDING 'THE CODE OF THE
CITY OF MIAMI BEACH, FLORIDA, 1950' ", having been passed and
adopted by the City Council of the City of Miami Beach, Florida,
has been posted by me in three conspicuous places in the City
of Miami. Beach, one of which was at the door of the City Hall
in said City on the 8th day of July, 1954, and that said Ordinance
remained posted for a period of at least thirty days in accordance
with the requirements of the City Charter of the said city of
Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
