Ordinance 1148 ORDINANCE No . 1148 AN ORDINANCE AMENDING SECTION 13 .65 OF ' THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950'' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Section 13 .65 of ''The Code of the City of Miami Beach, Florida, 1950'' be and the same is hereby amended to read as follows : ''SEC . 13 .65 SAME-REGULATIONS CONCERNING PREMISES WHERE FRESH FISH SOLD. The operator or person in charge of any store or other place for keeping, handling or sale of fresh fish, or fresh fish products, shall comply with the following requirements : a. Establishments where the handling or selling of fresh fish, or fresh fish products is a principal business , shall be in completely enclosed buildings except where permitted otherwise herein. Doors shall not exceed four feet in width and shall be solid . Such buildings shall have hard, smooth, impervious and wash- able floors, such as concrete, terrazzo, or tile, and shall have floor drains properly trapped, and connected to the city sewer. The walls and ceiling shall be plastered with a hard coat plaster and shall be wains- cotted to a height of six feet from the floor with a hard, smooth, impervious, washable material , such as tile or glass, provided that it shall not be required that such wainscotting extend more than six (6) feet in front of the display counter or other barrier which separates the prospective customer from the work area . Such establishments shall be equipped with air condition- ing or mechanical ventilation systems . Doors in buildings equipped with air conditioning systems shall have self-closing devices . The mechanical ventilation system shall consist of ducts and exhaust fans for the removal of air from within the building. There shall be a complete change of air at least once per minute within the Thilding during business hours except when cleaning tables are provided with metal hoods connected to the duct system,in which event the change of air shall be at least every two minutes . Provisions for entrance of fresh air into the building may be made through a closeable transom above any outside door of the building. The main door of the building may be left open during business hours provided the mechanical ventilation system is operating and does not permit any of the air within the building to escape to the outside through the open door. All other outside doors shall remain closed. The mechanical ventilation system shall operate only during business hours . The air removed from within the building shall be discharged through the duct system which shall extend at least thirty inches above the roof of the building . The duct outlet shall be located not less than twenty feet from the front building line and any openable window of the same premises or any nearby building, except'where conditions make it impracticable to so locate the duct outlet, in which event it shall be located where directed by the Chief Building Inspector . Establishments such as grocery markets, having the sale of fresh fish, or fresh fish products, as an adjunct or accessory feature, shall not be required to be totally enclosed or air-conditioned, but those areas used for the selling of fresh fish, or fresh fish products, shall meet the requirements of paragraph (a) as to floors, walls and ceilings, and wain- scotting . In all such establishments there shall be provided a separate preparation room where all cleaning, dressing and preparation of fresh fish for sale shall be done , and which shall be fully enclosed with floors, drains, walls, ceiling and wainscotting provided as specified in paragraph (a) . Such preparation room shall be equipped with an air condition- ing or mechanical system as described in para- graph (a) . c . No false floors or treads shall be per- mitted unless facilities to clean and dry them are provided within the building . d. All work tables and' counters shall have stainless steel, tile, or similar impervious, smooth and washable work surfaces . All cleaning sinks shall be provided with hot and cold running water. e . Display counters and other fresh fish storage places shall be refrigerated and pro- perly fitted with all necessary drains connect- ed to the sewer system. f . Fresh fish wastes shall be kept in re- frigerated containers at all times, so located as to be readily accessible for garbage collect- ion. In establishments where the selling or handling of fresh fish is an accessory business, there shall be provided an adequate enclosed space for the storage of empty fresh fish barrels and boxes within the preparation room, which space shall be accessible for the collection of such trash. g . Adequate toilet facilities shall be pro- vided together with lavatories equipped with hot and cold water, and a supply of disposable towels and soap shall be kept available, at all times . h. It shall be the duty of the Chief Building Inspector to enforce the provisions of this section. SECTION 2 : That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
