Ordinance 1237 ORDINANCE NO. 1237 AN ORDINANCE AMENDING ORDINANCE NO. 289, COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof be and the same are hereby amended so as to include in the "Cabana and Swimming-Pool District" and in Area District No. 1 , as said districts are set forth and defined in said ord ninance, the following described parcel of land situate in Miami Beach, Dade County, Florida, as follows, to wit: The northerly sixteen (16) feet of that certain strip of land bounded on the westerly side by a line described as follows : Beginning at a point which is on the northerly line of 33rd Street extended easterly and 255 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 253 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 254 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street and 241 feet easterly of said easterly line of Collins Avenue; thence run in an easterly direction along said northerly line of 41st Street for a distance of 16 feet; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 221 feet easterly of said easterly line of Collins Avenue; as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232. • -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA bounded on the easterly side by a line described as follows: Beginning at a point which is on the northerly line of 33rd Street extended easterly and 345 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 343 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 341!_ feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street extended easterly and 325 feet easterly of the said easterly line of Collins Avenue ; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 311 feet easterly of said easterly line of Collins Avenue , as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, at pages 7 and 8 of the Public Records of Dade County, Florida, and as said streets are named and designated in City of Miami Beach Ordinance No . 232; Bounded on the northerly side by the northerly line of Block 35 of said Ocean Front Property Subdivision produced easterly; bounded on the southerly side by the southerly line of said Block 35 produced easterly; and so as to include the remainder of said strip of land in the "Two-Story Cabana District" and in Area District No. 1, as said districts are set forth and defined in said ordinance . SECTION 2: That Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida be and the same is hereby amended by adding thereto, immediately preceding the last paragraph thereof, the following: "District No. 68: There shall be a front yard having a depth of not less than fifteen ( 15) feet measured from Collins Avenue . There shall be a side yard having a width of not less than five ( 5) feet on either ( each) side of a building." SECTION 3: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and rade a part thereof, be and the same are hereby amended so as to include in "RE Multiple-Family District " and in Area District No. 68, as said districts are set forth and defined in said ordinance, that certain parcel of land situate in Miami Beach, Dade County, Florida, described as follows, to wit: - 2 - OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA All of Block 35 of Miami Beach • Improvement Company' s Ocean Front Property, according to the amended Plat thereof recorded in Plat Book 5, pages 7 and 8 of the Public Records of Dade County, Florida; except that portion thereof bounded as follows : bounded on the westerly side by a line described as follows : beginning at a point which is on the northerly line of 33rd Street extended easterly and 255 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 253 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 254 feet easterly of the said easterly line d Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street and 241 feet easterly of said easterly line of Collins Avenue; thence run in an easterly direction along said northerly line of 41st Street for a distance of 16 feet; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 221 feet easterly of said easterly line of Collins Avenue; as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232; bounded on the easterly side by a line described as follows : beginning at a point which is on the northerly line of 33rd Street extended easterly and 345 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 343 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 344 feet easterly of the said.easterly -3- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street extended easterly and 325 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 311 feet easterly of said easterly line of Collins Avenue, as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, at pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232; bounded on the northerly side by the northerly line of said Block 35, produced easterly; bounded on the southerly side by the southerly line of said Block 35, produced easterly. SECTION 4 : That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 5: That this ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 21st day of November , A.D. 1956.
