Ordinance 1345 ORDINANCE NO. 1345
AN ORDINANCE AMENDING SECTION 21.7 OF
"THE CODE OF THE CITY OF MIAMI BEACH,
FLORIDA, 1950" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 21.7 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Sec. 21.7. Exceptions to provisions of chapter.
The requirements of this Chapter shall not be
construed to prevent the operation of automobiles
or light delivery trucks at any time, or the
operation of powered lawnmowers or other powered
gardening equipment between the hours of seven
o'clock a.m. and six o'clock p.m. during Period "1"
and between the hours of seven o'clock a.m. and
eight o'clock p.m. during Period "2", as said
periods are defined in Section 21.4 hereof;
provided, however, that such motor vehicles, powered
lawnmowers or other powered gardening equipment
shall at all times be properly muffled and shall be
so operated as to create the least possible noise
or nuisance.
The City Manager shall have the right to waive any
or all the requirements herein, in cases of emergency
where the welfare of persons or property may be
jeopardized by their strict enforcement. "
SECTION 2: That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3 : This ordinance shall go into effect immediately upon
its passage and posting as required by law.

Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of
the City Hall in said City on the 1st day of April, 1959,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
