Ordinance 1425ORDINANCE NO. 1425 AN ORDINANCE AMENDING SECTION 1, AND SECTION 4 OF ORDINANCE NO. 789, BEING AN ORDINANCE OF THE CITY OF .oIAMI BEACH, FLORIDA, ESTABLISHING OFFICIAL CLASSIFICATIONS OF POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF i'iIANI BEACH, FLORIDA, AND PROVIDING COMPENSATION THEREFOR, PURSUANT TO THE PROVISIONS OF THE CIVIL SERVICE ACT, AND PROVIDING FOR THE ADMINISTRATION OF THIS ORDINANCE AND REPEALING ORDINANCES IN CONFLICT HEREWITH, AND FURTHER AMENDING SAID ORDINANCE NO. 789 BY ADDING NEW SECTIONS THERETO TO BE NUMBERED SECTION 1.1 AND SECTION 1.2 THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA SECTION 1. That Section 1 of Ordinance No. 789 be and the same is hereby amended to read as follows. "SECTION 1. The following titles shall constitute the Classification Plan, and the titles together with the prescribed pay schedules shall constitute the Compensation Plan, both as provided for in the Civil Service Act and the Personnel Rules, for the Classified Service of the City of Miami Beach, Florida. Compensation in the Classified Service as to those members who are paid on an hourly basis, after September 29, 1959 and as to those members who are paid on a monthly basis, after September 30, 1961 shall not be less than the prescribed minimums nor more than the prescribed maximums, except as otherwise provided herein. 1. In addition to the above set forth maximums, those laborers now having or hereafter completing four years of continuous employment, shall upon recommendation of their Department Head receive a minimum of $1.48 per hour; provided, however, that for those laborers who, on the 30th day of September, 1959, were receiving wages in excess of $1.41 per hour in accordance with Section 1 of this ordinance, the maximum shall be that amount so received, plus 5% thereof. 26. LABOR ADMINISTRATION .01 Superintendent of Streets and Waste Compensation Minimum Maximum 470.00 671.00 mo. SECTION 2. That Ordinance #789 be and the same is hereby amended by adding two new sections thereto to follow Section 1 thereof and to be numbered and to read as follows: "SECTION 1.1. Employees whose compensation is based on an hourly rate but who are paid on a monthly basis through administrative action, shall receive in addition to the compensation fixed by Section 1 of this ordinance, an amount equal to 3% thereof." "SECTION 1.2. Employees whose compensation under this ordinance is computed and paid upon a per hour basis, and whose normal total number of working hours per week are reduced by administrative order, shall continue to receive the same compensation received by them prior to and notwithstaonding such reduction in the total number of hours per week ther6rore normally required." SECTION 3. That Section 4 of Ordinance #789 be and the same is hereby amended to read as follows: "SECTION 4. (a) When an employee shall have completed ten (10) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 and Section 1.1 hereof, a sum equal to five per cent (5%) of the compensation so received. (b) When an employee shall have completed fifteen (15) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 and Section 1.1 hereof, a sum equal to seven and one-half per cent (71/2%) of the compensation so received. (c) When an employee shall have completed twenty (20) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 and Section 1.1 hereof, a sum equal to ten per cent (10%) of the compensation so received. 6 11 For provisions of this section, length of employment shall include all time spent as an employee in the Classified Service regardless of status for which compensation has been paid and time while on approved military leave for service in the Armed Forces of the United States, provided, however, that in the event an employee is absent from his duties because of service -connected injury, for which Workmen's Compensation is payable, is certified by the City Physician to be physically able to return to his duties, and fails so to do, the period between such certification and the employee's actual return to his duties shall not be deemed to be service time within the meaning of this sub -paragraph." SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5, That this ordinance shall become effective October 1, 1961.
