Ordinances 1360 ORDINANCE NO. 1360 AN ORDINANCE AMENDING ORDINANCE NO. 739 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING OFFICIAL CLASSIFICATIONS OF POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF MIAMI BEACH, FLORIDA, AND PROVIDING COMPENSATION THEREFOR, PURSUANT TO PROVISIONS OF THE CIVIL SERVICE ACT; AND PROVIDING FOR THE ADMINISTRATION OF THIS ORDINANCE AND REPEALING ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Ordinance No. 789 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "SECTION 1. The following titles shall constitute the Classification Play., and the titles together with the prescribed pay schedules shall constitute the Compensation Plan, both as provided for in the Civil Service Act and the Personnel Rules, for the Classified Service of the City of Miami Beach, Florida, Compensation in the Classified Service as to those members who are paid on an hourly basis, after September 29, 1959 and as to those members who are paid on a monthly basis, after September 30, 1959 shall not be less than the prescribed minimums nor more than the prescribed maximums, except as otherwise provided herein. 1 . In addition to the above set forth maximums, those laborers now having or hereafter completing four years of continuous employment, shall upon recommendation of their Department Head receive a minimum of $1 .40 per hour; provided, however, that for those laborers who, on the 30th day of SepteMber, 1959, were receiving wages in excess of $1 .41 per hour in accordance with Section 1 of this ordinance, the maximum shall be that amount so received, plus 5% thereof. 26. LABOR; ADMINISTaATION Compensation Minimum Maximum .01 Superintendent of Streets and Waste 456.00 651,00 mo. SECTION 2. The City Manager is hereby authorized to issue detailed regulations, not in conflict with this ordinance nor, with the Personnel pules, for the purpose of clarification and administration of this Ordinance. Upon recommendation of Department Heads, or upon his own initiative, the City Manager shall fix rates of compensation of individual employees within the limitations prescribed in this Ordinance, -7- SECTION 3 . The City Manager is hereby authorized to approve payments of Clothing Allowance for Detectives, and for other officers of the uniformed force who are regularly detailed to perform their duties in plain clothes, and who are specifically recommended for such allowance by the Police Chief. Such Clothing Allowance shall not exceed Fifteen ($15 .00) Dollars per month. SECTION 4. (a) When an employee shall have completed ten (10) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 hereof, a sum equal to five per cent (5%) of the compensation so received, (b) When an employee shall have completed fifteen (15) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 hereof, a sum equal to seven and one-half percent (71%) of the compensation so received. (c) When an employee shall have completed twenty (20) years employment he shall be paid, in addition to the compensation which he receives by virtue of the provisions of Section 1 hereof, a sum equal to ten percent (10%) of the compensation so received. For provisions of this section, length of employment shall include all time spent as an employee in the Classified Service regardless of status for which compensation has been paid and time while on approved military leave for service in the Armed Forces of the United States, provided, however, that in the event an employee is absent from his duties because of service- connected injury, for which Workmen's Compensation is payable, is certified by the City Physician to be physically able to return to his duties, and fails so to do, the period between such certification and the employee' s actual return to his duties shall not be deemed to he service time within the meaning of this sub-paragraph. SECTION 5 . The City Manager, upon recommendation of the Department Head and the Director of Personnel, may authorize compensation not more than twenty percent (20%) in excess of the maximums prescribed in Section 1 of this ordinance for those employees whose duties and responsibilities are clearly above and beyond the normal scope of their positions; and the City Manager may, upon the recommendation of the Department Head and the Director of Personnel, authorize compensation in excess of the maximums prescribed in Section 1 of this ordinance for those employees who are required to work substantially beyond the normal work hours of their positions . SECTION 5. The City Manager is authorized to approve rates of compensation less than the prescribed minimums for employees whose employment is on a part time basis, or whose duties and responsibilities are clearly less than normally attach to a position. SECTION G . The City Manager is hereby authorized to approve payments of salary under the terms and provisions of the Personnel aules of the City of Miami Beach, Florida, relating to leaves of absence, with pay, for military training or service, SECTION 7. It is declared to be the purpose of this ordinance to provide an orderly and fair means for the compensation of employees in the Classified Service of the City of Miami Deach, Florida, on the basis of the work they perform and their competence in its performance; and to further the principles and intent of the Civil Service Act in providing an equitable basis of compensation and reward for merit. Nothing herein shall be construed to prevent the withholding of pay increases or the reduction of pay rates for disciplinary purposes. SECTION O. Ordinance No. 604 as amended, Ordinance No. 577 as amended, and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 9. If any portion of this ordinance shall be declared invalid, the remaining portions shall have the same force and effect as though such invalid portion or portions had not been included. SECTION 10 . This ordinance shall become effective as of October 1, 1959.
