AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA AMENDING ORDINANCE NO. 88-2603 BEING
THE RETIREMENT SYSTEM FOR UNCLASSIFIED
EMPLOYEES AND ELECTED OFFICIALS BY AMENDING
ARTICLE 7, SECTION 7 . 02 BY PROVIDING THAT THE
CITY COMMISSION MEMBER OF THE BOARD OF
TRUSTEES BE APPOINTED BY THE CITY MANAGER;
REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR PASSAGE AS AN EMERGENCY
ORDINANCE TO GO INTO EFFECT IMMEDIATELY.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1. That Article 7, Section 7 . 02 , of Ordinance No. 88-
2603 be amended to read as follows:
7 . 02 The Board shall consist of seven (7) persons, each of whom
shall be designated as a trustee. The members of the Board shall
be as follows:
(a) One (1) City Commissioner appointed by the City Gantmi-s-5orr-
Manager.
(b) Six (6) appointed by the City Manager.
(c) A quorum shall consist of three (3) persons.
(d) Each trustee shall serve on the Board for a term of two
years.
SECTION 2 . All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
SECTION 4. This ordinance shall go into effect as an
emergency measure immediately upon its passage.
PASSED and ADOPTED this 20th day of April
1988 AS AN EMERGENCY MEASURE.

SUBJECT: ORDINANCE AMENDING ORDINANCE 88-2603 DEALING WITH THE RETIREMENT
SYSTEM FOR UNCLASSIFIED EMPLOYEES AND ELECTED OFFICIALS
The Proposed Ordinance modifies Article 7, Section 7.02 of the
existing Ordinance on this retirement system and strikes the one
City Commissioner appointed by the City Commission to the Board of
Trustees. The amendment provides that one City Commissioner shall
serve on the Board and be appointed by the City Manager. This
change is necessary because the Board was notified by their attorney
that State law precludes the appointment of a member of the Governing
Legislative Body to another Legislative Body under its control . Since
the Board of Trustees and their attorney felt that this might cause a
delay in the approval of this system by the Division of Retirement of
the State of Florida, the Board unanimously recommends that this
Ordinance be approved.
ADMINISTRATION APPROVAL:
The Administration recommends that the City Commission adopt this
change to the Unclassified Employees and Elected Officials Retirement
System as recommended by the Board of Trustees.
