AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,
AMENDING SECTION 9.03 OF ORDINANCE NO.
1901, BEING THE RETIREMENT SYSTEM FOR
GENERAL EMPLOYEES OF THE CITY OF MIAMI
BEACH, BY DELETING SUBSECTIONS 9.03 (D)
AND (E) WHICH REQUIRES THAT LEGAL
SERVICES CAN NOT EXCEED 100 HOURS
ANNUALLY AND THAT LEGAL FEES SHALL BE
PAID SOLELY FROM THE FUNDS OF THE
RETIREMENT SYSTEM; REPEALING ALL
ORDINANCES IN CONFLICT THEREWITH;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 9 . 03 of Ordinance No. 1901 is hereby
amended by deleting subsections (d) and (e) as follows:

SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.

SECTION 4. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its adoption
on September 17 1988

SUBJECT: DELETING SUBSECTIONS D AND E OF SECTION 9.03 OF ORDINANCE 1901
In 1982 the City Commission amended Ordinance 1901 to allow the
General Employees Retirement System to retain outside counsel
and set a maximum on hours and rates for the service. These
restrictions have become obsolete over time and are not consis-
tant with the like provisions included within both the Police
and Fire Retirement System and the Unclassified Employees and
Elected Officials Retirement System. The effect of this change
will be to allow the Board of Trustees to retain counsel and
negotiate fees as an administrative cost of the system. The
Board of Trustees has unanimously recommended this change to
the Commission.
ADMINISTRATIVE RECOMMENDATION:
The Administration recommends that the Commission approve this
Ordinace at first reading and schedule a Public Hearing at the
first meeting in September.
