AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA
AMENDING ORDINANCE NO. 1891 OF THE CITY OF MIAMI BEACH,
THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE,
SECTION 6-16 MU MUNICIPAL USE DISTRICT; PROVIDING THAT
THE CITY COMMISSION OF THE CITY OF MIAMI BEACH MAY
WANE DEVELOPMENT CRITERIA BY A FIVE-SEVENTHS
AFFIRMATIVE VOTE; REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That Section 6-16 of Ordinance No. 1891 is hereby amended as follows:
A. District Purpose. Upon ownership of any property by the City Commission
pursuant to Section 17, Changes and Amendments. Idewevetr the use and

B. Uses Permitted. The specific use shall be determined in accordance with the
City's Comprehensive Plan and Neighborhood Plan if one exists for the general
area. No land, water, air or structure may be used in whole or in part, except
for one or more of the following uses. Permitted uses that sell, serve or
otherwise distribute alcoholic beverages in this district shall comply with the
standards and regulations found in Section 14.
1. Publicly-owned and operated recreational facility, playground, playfield,
park and bench.
2. Public and governmental buildings, services and uses such as governmental
office, police headquarter, fire station, library, museum, auditorium.
3. Municipal parking areas, parking structure, vehicle and equipment storage,
maintenace and service areas.
4. Public utilities or public service structures or appurtenances.
5. Private use, or joint City and private use of property owned by the City or
the Miami Beach Redevelopment Agency, including air-rights.
6. Any use similar to those listed above and in accordance with the
Comprehensive Plan for the specific area under consideration.
7. Accessory uses for the above uses.
a. Any accessory use in the area located between the established
Bulkhead Line and the Erosion Control Line shall be in accordance
with Section 18-2 Dune Overlay Regulations.
C. Development Standards. Following a public hearing, the below standards may be
waived by a five-sevenths (5/7) vote of the City Commission for developments
pertaining to Municipal buildings, uses and sites which are wholly used by, open
and accessible to the general public. In all other cases involving the lease and/or
air rights use of municipal property by the private sector,, architectural plans
shall conform to the below regulations in addition to applicable sections
contained in the Zoning Ordinance and be reviewed under the Conditional Use
process.
E: 1. Minimum Lot Area. None.

Er 3. Minimum Yards. Shall he determined by the adjacent use district or
districts and consistent with yard regulations of similar uses as designated
in this Ordinance.
Pr 4. Maximum Building Height. None.
G. 5. Minimum Floor Area. None.
fir 6. Maximum Floor Area Ratio. Shall be determined by the adjacent use
district or districts and consistent with Floor Area Ratios of similar uses as

I= 7. Maximum Density. Applies only to residential uses and shall be determined
by the adjacent use district or districts and consistent with maximum
densities of similar uses as designated tH this r' Fdthahee allowed in said

SECTION 2: REPEALER
All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 3: SEVERABILITY
If any section, part of sections, paragraph, clause, phrase, or word of this Ordinance is
declard invalid, the remaining provisions of this Ordinance shall not be affected.
SECTION 4: INCLUSION IN ZONING ORDINANCE
It is the intention of the City Commission, and it is hereby ordained that the provisions of
this ordinance shall become and be made a part of the City of Miami Beach Zoning
Ordinance No. 1891 as amended; that the sections of this ordinance may be renumbered or
relettered to accomplish such intention; and that the word "ordinance" may be changed to
"section" or other appropriate word.
SECTION 5: EFFECTIVE DATE
This Ordinance shall take effect ten (10) days after adoption on Oct• 29 , 1988.
