AN ORDINANCE AMENDING SECTION 14A-12 OF THE CODE OF THE
CITY OF MIAMI BEACH, FLORIDA, SO AS TO PROVIDE FOR AN
INCREASE IN THE SCHEDULE OF FEES FOR COLLECTION AND
DISPOSAL OF GARBAGE AND TRASH; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA:
SECTION 1: That a portion cfSection 14A-12 of the Code of the City of Miami
Beach be and the same is hereby amended to read as follows:
Sec. 14A-12. Schedule of fees for collection and disposal of
garbage and trash.
A. Residence (single-family) $ 4; b $ 21 .57 per month
B. Duplex 0 21 .57 per month
per unit
C. Apartments 11 .74 13.50 per month
with less than 9 dwelling units per dwelling
unit
D. Hotels 4.70 5.41 per month

SECTION 2: REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 3: SEVERABILITY.
If any section, part of section, paragraph, clause, phrase, or word of this
ordinance is declared invalid, the remaining provisions thereof shall not
be affected.
SECTION 4: EFFECTIVE DATE.
The ordinance shall become effective 10 days after adoption on
December 31 , 1988.

SUBJECT: AN ORDINANCE AMENDING SECTION 14-A-12 OF THE CODE OF THE CITY OF
MIAMI BEACH, FLORIDA, PROVIDING FOR A 15% INCREASE IN THE SCHEDULE
OF FEES FOR COLLECTION AND DISPOSAL OF GARBAGE AND TRASH.
The sanitation operations for the City of Miami Beach have historically operated
at a significant deficit, in excess of $2 million each year. In 1985, these
operations were transferred from the General Fund to an Enterprise Fund, to
provide for increased accountability of the operating revenues and expenditures.
Improved and separate fiscal accounting confirmed a preliminary FY 1987/88
operating deficit of $2,441,706 with a contribution from the General Fund of
$2,202,018 resulting in a net loss of $238,403; this deficit has been projected
at $2,048,948 for the current year. Any deficit in the Sanitation Enterprise
Fund is offset by a contribution from General Fund revenues.
Solid waste legislation (FS Ch 88-130 Sec 403-702) sets as an objective, a self-
supporting, Enterprise Fund with emphasis on recycling. To accomplish some of
this, a 15% across-the-board increase to the Sanitation Fee Schedule is being
requested, at this time.
The 15% increase would result in a $196,500 revenue increase to the Sanitation
Fund, for the remainder of FY 1988/89. The current fee for residences and
duplexes is $18.76 per month and would increase by $2.81 to $21 .57 per month;
apartments would go from $11.74 to $13.50 per month.
The last sanitation fee increase of 10% was on October 11, 1986; the residential
fee went from $17.05 to $18.76 per month. Prior to that, there was a 9.7%
increase on October 12, 1985; residentials went from $15.54 to $17.05. The
overall increase from 1985 would be 26.5%.
In comparison, Dade County's disposal and transfer fees increased from $22.50
to $32.00 (42.2%) on October 1, 1985 and one year later, on October 1, 1986, from
$32.00 to $36.00 (12.5%) ; the overall increase, for the same period, is 60%.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt on first reading
the attached Ordinance amending Section 14-A-12 of the Code of the City of Miami
Beach, providing for a 15% across-the-board increase to the schedule of fees for
the collection and disposal of garbage and trash.

RESOLUTION NO. 79-15942
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH AMENDING THE CONTRACT BETWEEN THE CITY
OF MIAMI BEACH AND JOHN AND JOHANNA BASS WHICH PRO-
VIDED FOR THE ESTABLISHMENT OF THE BASS MUSEUM OF
ART.
WHEREAS , the parties desire to enter into an Agreement for
the purpose of amending the Agreement passed and adopted by the Miami
Beach City Commission on July 8 , 1963, authorizing execution of
Contract with John and Johanna Bass for the purpose of establishing
the Bass Museum of Art; and
WHEREAS , the City Administration has recommended that the
proposed Contract changes as submitted by the Board of Trustees of
the Bass Museum be accepted; and
WHEREAS , the City Attorney has approved the proposed
Contract changes and the Amendment to the Agreement as to form,
and the City Manager has recommended that the City Commission
accept said proposed Contract changes and authorize entry into
same; and
WHEREAS , the City Commission of the City of Miami Beach
is familiar with the provisions of said Amendment to Agreement;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk
be and they are hereby authorized and directed to execute the
Agreement amending the Contract between the City of Miami Beach
and Melvin J. Richard, as Testamentary Devisee under the Will of
John Bass in the name of and on behalf of the City of Miami Beach,
Florida.
