2017-30001 ResolutionRESOLUTION NO. 2017 -30001 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE CITY MANAGER'S RECOMMENDATION AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AMENDMENT NO. 2 TO THE CITY'S STANDARD SOFTWARE MAINTENANCE AGREEMENT WITH TYLER TECHNOLOGIES INC., TO PURCHASE CITIZEN REPORTING INTERFACE SOFTWARE FOR THE POLICE DEPARTMENT, IN AN AMOUNT NOT TO EXCEED $35,440. WHEREAS, the City's Police Department, Fire Department, and Office of Emergency Management rely heavily on effective Computer -Aided Dispatch ( "CAD ") systems to perform both their planning and operational activities; and WHEREAS, on March 9, 2016, the Mayor and City Commission adopted Resolution No. 2016 - 29333, accepting the City Manager's recommendation by 5 /7ths vote to waive the competitive bidding requirement, and authorizing the Administration to finalize negotiations with Tyler Technologies, Inc. ( "Tyler ") and, if such negotiations were successful, approving and authorizing the City Manager and City Clerk to execute a Standard Software Maintenance Agreement ( "SSMA ") for a term of two years, with up to three one -year renewal options, in an amount not to exceed $1,739,796; and WHEREAS, the City and Tyler subsequently finalized and executed the SSMA; and WHEREAS, on May 11, 2016, the Mayor and City Commission adopted Resolution No. 2016 - 29387, authorizing the Administration to execute an Additional Services Agreement with Tyler to provide custom Effective Response Force ( "ERF ") software enhancements to the City's CAD system, in an amount not to exceed $45,000 ( "ERF Agreement"); and WHEREAS, on November 9, 2016, the Mayor and City Commission adopted Resolution No. 2016 - 29630, authorizing the Administration to execute Amendment No. 1 to the City's SSMA with Tyler, in an amount not to exceed $131,814 ( "SSMA Amendment "), and further authorizing the City Manager and City Clerk to execute an amendment to the ERF Agreement ( "ERF Amendment "), to provide that Tyler shall deliver the ERF upgrade within twelve (12) months of the date that the SSMA Amendment is executed; and WHEREAS, the Police Department now desires and is requesting a Citizen Reporting Interface ( "CRI ") be added to the City's existing CAD system, in order to enable the general public to self- report both non- violent crimes and crimes for which no suspect has been identified; and WHEREAS, the CRI will require a one -time, initial purchase cost of $20,320 for Tyler to incorporate the CRI into the City's CAD system, and an increase in the annual maintenance cost in the amount of $3,780 for each remaining year of the term of the SSMA. ANALYSIS On March 9, 2016, the Mayor and City Commission adopted Resolution No. 2016 - 29333, accepting the City Manager's recommendation by 5 /7ths vote to waive the competitive bidding requirement, and authorizing the Administration to finalize negotiations with Tyler Technologies, Inc. (Tyler) and, if such negotiations were successful, approving and authorizing the City Manager and City Clerk to execute a Standard Software Maintenance Agreement (SSMA) for a term of two years, with up to three one -year renewal options, in an amount not to exceed $1,739,796. On November 9, 2016, the Mayor and City Commission adopted Resolution No. 2016 - 29630, authorizing the Administration to execute Amendment No. 1 to the SSMAwith Tyler, in an amount not to exceed $131,814 (including the ERF cost of $45,000). This amendment included an upgrade of the CAD to the Enterprise CAD platform in order to protect the City's investment in building the ERF module and to ensure compatibility with future technology upgrades, including Text -to -911, upgraded maps, and Office 365. The Amendment also authorized the City Manager and City Clerk to execute an amendment to the ERF Agreement to provide that Tyler deliver the ERF upgrade within twelve (12) months of the date of execution of the SSMAAmendment. This amendment raised the total cost of the SSMA over the full term of the contract to $1,871,610. The Miami Beach Police Department (MBPD) is now requesting Citizen Reporting Interface Software (CRIS) from Tyler in an effort to allow the general public to self - report both non - violent Page 651 of 2353 crimes and crimes for which no suspect has been identified. The CRIS will allow the MBPD to re- allocate valuable officer resources for higher priority duties and to shift focus to the MBPD's various strategic goals. The CRIS will work hand -in -hand with the MBPD's recent sole source purchase of a Desk Officer Reporting System (DORS) from Lexis Nexis. CONCLUSION The proposed amendment will significantly enhance the services provided by the Miami Beach Police Department. KEY INTENDED OUTCOMES SUPPORTED Enhance Public Safety and Emergency Preparedness FINANCIAL INFORMATION The cost for Amendment No. 2 for the CRIS, professional installation, and yearly maintenance and support fees will be for an amount not -to- exceed $35,440 for the life of the existing contract, including optional renewals. This will consist of $20,320 to incorporate the CRIS into the existing system, and an increase in the annual maintenance costs of $3,780 for each year remaining of the SSMA. WHEREAS, on May 5, 2016, the City and Tyler entered into the SSMA, which incorporated the terms of the 2008 SSMA between the City and Tyler; and WHEREAS, Tyler and the Client desire to amend the SSMA in order to add the Coplogic interface software; and WHEREAS, Tyler and Client now desire to amend the Agreement; NOW THEREFORE, in consideration of the mutual promises hereinafter contained, Tyler and the Client agree as follows: 1. The software and /or services set forth in Exhibit 1 to this Amendment are hereby added to the Agreement. 2. The following payment terms, as applicable, shall apply: a. Additional software fees will be invoiced 100% on the Amendment Effective Date. b. Associated maintenance and support fees to begin January 1, 2018 at the end of the no- charge maintenance period and thereafter in a lump sum amount together with Client's then - current maintenance and support fees for previously licensed software. c. Additional Implementation and other professional services (including training) are billed and invoiced as delivered, at the rates set forth in the investment Summary. d. Fixed price services are invoiced upon complete delivery of the service. 3. This Amendment shall be governed by and construed in accordance with the terms and conditions of the Agreement. 4. All other terms and conditions of the Agreement shall remain in full force and effect.
