AN ORDINANCE AMENDING CHAPTER 14A OF
"THE CODE OF THE CITY OF MIAMI BEACH,
FLORIDA".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Chapter 14A of "The Code of the City
of Miami Beach, Florida" be, and the same
is hereby amended by adding new sec -idylls thereto immediately
following Section 14A.12, to be numbered and to read as follows:
"Section 14A.12.1
The Supervisor of the Refuse Division of the
Public Works Department is hereby authorized
and directed to enforce all the provisions of
this chapter regulating and governing the ac-
cumulation, removal and disposition of garbage,
trash and industrial waste. The Supervisor of
the Refuse Division of the Public Works Depart-
ment shall have the power to delegate powers
and assignments to subordinate employees working
under his authority in the enforcement of said
provisions of this chapter.
Upon presentation of proper credentials, the
Supervisor of the Refuse Division of the Public
Works Department may enter, at any reasonable
time, any building, structure or premises for
the purpose of inspection, or to prevent
violations of Chapter 14A of the Code pertaining
to the accumulation, removal and disposal of
garbage, trash and industrial waste.
Whenever such garbage, waste, trash or industrial
wastes creates a health hazard or nuisance offensive
to any of the senses, the Supervisor of the Refuse
Division shall order the violations to be corrected
forthwith or within a reasonable period of time by
notice in writing served on the person or persons
causing or creating such health hazard or nuisance,
and such persons shall immediately cease or abate
such violation.
Such notice shall be served personally upon the
owner or upon the person in lawful possession of
the premises involved. If the person or persons
addressed with such notice cannot be Found after
diligent search, then such notice shall be sent by
certified mail to the last known address of such
person, and a copy of the notice shall be posted
in a conspicuous place on the premises, and such
procedure shall be deemed equivalent of personal
service.
Upon refusal, failure or neglect of the person or
persons served with a notice to comply with the
requirements of the order to abate the condition
specified, the Supervisor of the Refuse Division
shall report the condition to the Public Works
Director, who shall thereupon forthwith request

the City Attorney to proceed to prosecute
the person or persons notified, under the
provisions of Sections 14A.12.2 and 14A.12.3 of this chapter."
"Section 14A.12.2
Any person convicted of violating any pro-
vision of Section 14A.12.1, for his first
offense, shall be punished by a fine not
exceeding $200.00, or by imprisonment in the
City Jail for a term not exceeding ten (10)
days; any person convicted of violating any
provision of Section 14A.12.1, for such second
offense, shall be punished by a fine not ex-
ceeding $500.00, or by imprisonment in the
City Jail for a term not exceeding thirty (30)
days; any person convicted of violating any
provision of Section 14A.12.1, for a third
offense, shall be punished by a fine not ex-
ceeding $1,000.00, or by imprisonment in the
City Jail for a term not exceeding ninety
(90) days.
"Section 14A.12.3
In addition to the foregoing penalties, if the
owner or occupant of any land within the City
shall fail to comply with the requirements of
Section 14A.12.1, the City Manager shall cause
such work to be done, and keeping an account of
the costs thereof, whereupon such costs shall be
a charge and lien against the property so cleaned,
of the same extent and character as liens of
special assessments provided for in the Charter
of the City."
SECTION 2. That Section 14A.13, of the Code of the
of Miami Beach, Florida, be and the same
hereby amended to read as follows:
"Any person found guilty of violation of any
of the provisions of this chapter, other than
Section 14A.12.1, shall be punished as pro-
vided by Section 1.8."

SECTION 3. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4. This ordinance shall go into effect immediately
upon its passage and posting as required by law.

Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 2nd day of March, 1972,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
