A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO ENTER
INTO NEGOTIATIONS WITH THE CITY'S CURRENT DISASTER RECOVERY
SERVICES CONTRACTORS: ASHBRITT, INC., CERES ENVIRONMENTAL
SERVICES, INC., D & J ENTERPRISES, INC., PHILIPS AND JORDAN, INC.,
AND TAG GRINDING SERVICES, INC. FOR DEBRIS REMOVAL RESULTING
FROM HURRICANE IRMA; FURTHER AUTHORIZING THE CITY MANAGER
TO EXECUTE AMENDMENTS, PENDING SUCCESSFUL NEGOTIATIONS BY
THE ADMINISTRATION AND THE CITY ATTORNEY'S OFFICE.
WHEREAS, pursuant to Section 26 -35, of the City Code, the City Manager may declare
an emergency during an event that might affect the health, safety and welfare of the city; and
WHEREAS, pursuant to Section 2 -396, of the City Code, upon the declaration of an
emergency, the City Manager has certain emergencies power during an event that might affect
the health, safety and welfare of the city, and Hurricane Irma was such an event and may make
procurement purchases relating to the emergency, with ratification thereafter by the City
Commission, of purchases over 50,000; and
WHEREAS, on September 4, 2017, the City Manager exercised his state of local
emergency powers, in response to Hurricane Irma; and
WHEREAS, on September 13, 2017, Resolution No. 2017 -29971 authorized the City
Manager to continue to exercise his state of local emergency powers, through and including the
City Commission Meeting of Monday, September 25, 2017; and
WHEREAS, on September 25, 2017, the Mayor and City Commission extended the
emergency powers of the City Manager through October 18, 2017; and
WHEREAS, as a result of the hurricane and as authorized by the state of local
emergency, the City engaged disaster recovery services; and
WHEREAS, the City pre - negotiated the disaster recovery services contracts included
rates that should be eligible by FEMA for reimbursement; and
WHEREAS, Hurricane Harvey hit the State of Texas resulting in significant flooding
which required similar disaster recovery services; and
WHEREAS, presently, due to Irma sweeping across the entire State of Florida, all 67
counties have activated their FEMA debris recovery contracts as well as hundreds of
municipalities; and
WHEREAS, the City of Miami Beach and Miami Dade County are now competing for the
same vendors, the later of which has entered into contracts at double the price provided under
our existing contract with the same providers; and
WHEREAS, it is imperative that the City renegotiate with current vendors, as high as the
county rate, to maintain the vendor's presence and responsiveness with regards to the
necessary debris clearing equipment; and
WHEREAS, FEMA has already issued a letter in the State of Texas allowing jurisdictions
to increase to a higher rate, which it is anticipated that this will also become available to the
State of Florida; and
WHEREAS, the increased cost above the competitively bid price may not be FEMA
eligible, but the public need to remove the debris and restore the vitality of the City is
paramount; and
WHEREAS, therefore it is recommended that the Mayor and the City Commission
authorize the Administration to negotiate with the City's current disaster recovery services
contractors: Ashbritt, Inc., Ceres Environmental Services, Inc., D & J Enterprises, Inc., Philips
And Jordan, Inc., and Tag Grinding Services, Inc. for debris removal resulting from Hurricane
Irma; and
WHEREAS, the City Manager had procurement disaster recovery services at a price in
excess of the existing contracts with said providers due to the above circumstances.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission authorize the Administration to negotiate with the City's current disaster recovery
services contractors: Ashbritt, Inc., Ceres Environmental Services, Inc., D & J Enterprises, Inc.,
Philips And Jordan, Inc., and Tag Grinding Services, Inc. for debris removal resulting from
hurricane Irma; further authorizing the Mayor and City Clerk to execute the change amendments
pending successful negotiations by the City Administration and the City Attorney's office.
