Resolution 1185 `s r+ Y u : z r, w + RESOLUTION NO. 1185 BE IT RESOLVED;D BY TIE CITY COUNCIL OF TEE CITY OF MIAMI BEAOA, FLORIDA: SECTION 1: That this City Council by its Resolutions Nos. 1070 and 1164 has ordered that that portion of Alton goad from the North line of Seventeenth Street to the North line of Eighteenth Street be repaved and that curbs and gutters be constructed on each side thereof, and that that portion of Dade Boulevard from the West line of Alton Road to the ;ast line of Michigan Avenue be repaved and that curbs and gutters be constructed on each side thereof, and that said City will undertake said improvements beginning on or about November 1st, 1925. SECTION 2: That the Miami Beach Railway Company, the grantee named in Ordinance No. 205 of said City Council passed and adopted April 9th, -1924, be and it is hereby ordered to make such repairs or replacements as to ballast, ties or other track facilities, and provide such, if any, additional ballast as in the opinion of said City Council will be reeuired to put said tracks which the City Council hereby determines are located within the area to be improved by repavement and the construction of curbs and gutters as hereinbefore set forth, as to preclude the probability of damage to said paving or improvement during the reasonable life thereof due to deterio- ration of said grantee ' s tracks maintained pursuant to said Ordinance No. 205 and that in the opinion of said City Council the repairs, replacements as to ballast, ties, or other track facilities which will put said tracks in such condition as to preclude the probability of damage to the paving or improvement during the reasonable life thereof due to deterioration of said grantee 's tracks are : That said track be constructed of seven inch grooved- girder rails properly secured to 6" x 8'T x 8' creosoted ties, the latter to be spaced not more than eighteen inches on centers at rail joints and not more than forty inches on centers at rail centers. That brace tie plates be installed between the rails and ties of said track at a maximum spacing of six feet. That catch basins of a design approved by the City Engi- neer be installed under said track at all sumps in the grade line thereof. That creosoted combined trolley and feeder line poles be installed where poles are reouired and that said poles be of sufficient height to provide proper supports for street lights to be suspended therefrom over the center lines of said Road, Street and avenue. That said track be lined and surfaced to the lines and grades established by the City Engineer on a bed of crushed stom eight inches in depth after thorough compaction. That crushed stone be thoroughly �atnped either by hand or machine tampers under and around each tie and the base of each rail, traffic beiniosidipanwhile maintained on sip** track. *iii'' That said tamping be continued until each and all of said rails and ties are firmly and solidly settled and bedded into their predetermined position and free or movement of any kind. That from vibration said track be gone over and re-tamped as is required until the above condition is obtained to the satisfac- tion of the City Engineer. That all rock for the above purposes lying below the plane of the centers of the ties be furnished and com- pacted in place by the said Railway Company. That all rock lying between the center of the ties and the base of the rail be furnished by the paving Contractor but that the same be compacted in place by the said Railway Company. That all rock and other paving materials lying between the base and tIle top of the rail be fur- nished and compacted in place by the paving contractor, except that the said Railway Company will be reouired to tamp suitable filler material -ander the rail heads on each side of each rail of each track until this space is filled to the satisfaction of the City EngirD er. Any defects which may develop at any time in said track construction or in said pavement because of such defects in said track construction shall be. promptly remedied at the expense of the said Railway Company. SECTION 3: That if this order of this City qouncil is not complied with within time to enable said City to pave that portion of said streets , that is, that portion of Alton Road and Dade Boulevard in which said tracks are maintained at the same time it is enabled to pave and improve the re- mainder of said portions of said Alton road and Dade Boulevard, which said paving and improvement said City will begin to make on or before November 1st , 1925, and complete on or about January 15th, 1926, which this City Council deems a reasonable time Within which said grantee may comply herewith, then the City Council will do said work hereby ordered done by said grantee and assess the cost of such paving or improvement between the rails of said railway and to the end of the ties on each side thereof to said Railway Company, including a proportionate part of the incidental expenses and such costs at the in- tersection of highways, that is, at the intersection of said Alton _ oad and Dade Boulevard, and said Boulevard and I,iichigan Avenue. SECTION 4: That a copy of this resolution be transmitted to the Miami Beach .railway Company by the City Clerk. SECTION 5 : That this Resolution shall 'be effective immediately upon its passage and adoption. PASSED AND ADOPTED this 14th day of October, A. D. , 1925.
