RESOLUTION NO 2017 -30020 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AMENDMENT NO. 1 TO THE DESIGN /BUILD AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA, AND RIC -MAN CONSTRUCTION, INC., FOR THE PURCHASE AND INSTALLATION OF A PERMANENT EMERGENCY GENERATOR FOR THE STORMWATER PUMP STATION ON 19TH STREET BETWEEN CONVENTION CENTER DRIVE AND MERIDIAN AVENUE PROJECT; FOR A NOT -TO- EXCEED AMOUNT OF $720,000, PLUS OWNER'S CONTINGENCY IN THE AMOUNT OF $40,000 FOR A TOTAL OF $760,000; AND AUTHORIZATION OF THIS AMENDMENT NO. 1 BEING SUBJECT TO FINAL FUNDING APPROPRIATION PURSUANT TO THE CITY COMMISSION'S ADOPTION OF THE FY17/18 CAPITAL BUDGET. WHEREAS, on January 17, 2017 the City entered into a Design /Build Agreement with Ric- Man Construction, Inc. (Ric - Man), to develop, design, and construct the Stormwater Pump Station on 19th Street between Convention Center Drive and Meridian Avenue; and WHEREAS, in April 2017, the Public Works Department identified the need to incorporate a permanent emergency generator for this pump station in the event of a power failure during a storm event in the neighborhood; and WHEREAS, Ric -Man was requested to add, as part of its Design /Build services, the design, purchase, and installation of a permanent emergency generator and to be placed at the southwest quadrant of the City's Botanical Garden; and WHEREAS, the Executive Director of the Botanical Garden is in agreement with the proposed location of the generator; and WHEREAS, on August 31, 2017, Ric -Man submitted a proposal in the amount of $719.978, for a permanent power generator that operates all four pumps for a period of forty -eight (48) consecutive hours at capacity; and WHEREAS, the proposed pump station is designed to include four (4) 20,000 gpm pumps to operate at design capacity of two pumps at a time; and WHEREAS, the Public Works Department recommends operating at the pump's full capacity; and WHEREAS, Ric -Man has also submitted a proposal in the amount of $674,978 for a second permanent power generator option that operates two pumps for a period of 48 consecutive hours at capacity; and WHEREAS, the City Manager recommends approval of this Amendment No. 1, to the Design /Build Agreement with Ric -Man. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve and authorize the City Manager to negotiate and execute Amendment No. 1 to the Design /Build Agreement between the City of Miami Beach, Florida, and Ric -Man Construction, Inc., for the purchase and installation of a permanent emergency generator for the stormwater pump station on 19th Street between Convention Center Drive and Meridian Avenue Project; for a not -to- exceed amount of $720,000, plus owner's contingency in the amount of $40,000 for a total of $760,000; and authorization of this Amendment No. 1 being subject to final funding appropriation pursuant to the City Commission's adoption of the FY17/18 Capital Budget. RECOMMENDATION The Administration recommends adopting the Resolution. ANALYSIS On January 17, 2017 the City entered into a Design /Build Agreement with Ric -Man Construction, Inc. (Ric -Man), to develop, design, and construct the Stormwater Pump Station on 19th Street between Convention Center Drive and Meridian Avenue. In April 2017, the Public Works Department identified the need to incorporate a permanent emergency generator for this pump station in the event of a power failure during a storm event in the neighborhood. The proposed pump station is designed to include four (4) 20,000 gpm pumps to operate at design capacity of two pumps at a time. The Public Works Department recommends operating at the pump's full capacity. As such, Ric -Man was requested to add, as part of its Design /Build services, the design, purchase, and installation of a permanent emergency generator. It is anticipated that the generator is to be placed at the southwest quadrant of the City's Botanical Garden. The Executive Director of the Botanical Garden is in agreement with the proposed location of the generator. On August 31, 2017, Ric -Man submitted a proposal in the amount of $719.978, for a permanent power generator that operates all four pumps for a period of forty -eight (48) consecutive hours at capacity. Reference literature for the proposed power generator is attached as Exhibit A. Ric -Man has also submitted a proposal in the amount of $674,978 for a second permanent power generator option that operates two pumps for a period of forty- eight (48) consecutive hours at capacity. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve and authorize the City Manager to negotiate and execute Amendment No. 1 to the Design /Build Agreement between the City of Miami Beach, Florida, and Ric -Man Construction, Inc., for the purchase and installation of a permanent emergency generator for the stormwater pump station on 19th Street between Convention Center Drive and Meridian Avenue Project; for a not -to- exceed amount of $720,000, plus owner's contingency in the amount of $40,000 for a total of $760,000; funding subject to the adoption of the FY17/18 Capital Budget.
