Ordinance 86-2523 ORDINANCE NO. 86-2523 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE COMPREHENSIVE ZONING ORDINANCE NO. 1891; PROVIDING FOR AN AMENDMENT TO SECTION 20-3, B PERTAINING TO THE COMPOSITION OF THE PLANNING BOARD ELIMINATING THE ENGINEER'S POSITION AND REPLACING SAME WITH A PERSON WHO HAS EDUCATION AND/OR EXPERIENCE IN HISTORIC PRESERVATION ISSUES; PROVIDING FOR A DEFINITION OF THE TERM "EDUCATION AND/OR EXPERIENCT IN HISTORIC PRESERVATION ISSUES" BY ESTABLISHING CRITERIA TO QUALIFY CANDIDATES FOR THIS POSITION ON THE PLANNING BOARD; PROVIDING FOR INCLUSION WITHIN THE COMPREHENSIVE ZONING ORDINANCE; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA; Bashed Wes = Deleted Language Underlined Words = New Language SECTION 1: That Section 20, Subsection 20-3, B of Zoning Ordinance No. 1891 is hereby amended to read as follows: 20-3 Composition B. All regular voting members of the Board shall have considerable experience in general business, land development practices or land use issues; however, the Board shall at a minimum be comprised of one registered architect, erae eer:# ed eRg+ReeF, one developer, and one attorney who has considerable experience in land use and zoning issues, and one person who has education and/or experience in historic preservation issues and whose appointment shall become effective on December 17, 1987. For purposes of this section, the term "education and/or experience in historic preservation issues" shall be a person who meets one or more of the following criteria: 1. has earned a college degree in historic preservation; or 2. is responsible for the preservation, revitalization or adaptive reuse of historic buildings; or 3. is recognized by the City Commission for contributions to historic preservation, education, or planning. SECTION 2: INCLUSION IN ZONING ORDINANCE NO. 1891. It is the intention of the City Commission, and it is hereby ordained that the provision of this ordinance shall become and be made a part of the City of Miami Beach Zoning Ordinance No. 1891 as amended; that the sections of this Ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other appropriate word. SECTION 3: REPEALER. All Ordinances or parts of Ordinances' in conflict herewith be and the same are hereby repealed. s SECTION 4: SEVERABILITY. If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independant provision and such hold shall not affect the validity of the remaining portions of this Ordinance. SECTION 5: EFFECTIVE DATE This ordinance shall become effective ten (10) days after adoption on November 29, 1986.
