Ordinance 87-2539 ORDINANCE NO. 87-2539 AN ORDINANCE AMENDING SECTION 45-20.2 OF THE CITY CODE TO INCREASE THE SANITARY SEWER SERVICE CHARGE IMPOSED BY THE CITY UPON ALL PREMISES CONNECTED TO OR USING THE CITY'S SANITARY SEWER SYSTEM, FROM NINETY-FIVE CENTS PER THOUSAND GALLONS TO NINETY-EIGHT CENTS PER THOUSAND GALLONS, PROVIDING FOR AN EFFECTIVE DATE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION I: That Section 45-20.2 (Sanitary Sewer Charges)(second sentence) of the Code of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "Such Sanitary Sewer service charge shall be in an amount equal to 95( 98( per thousand gallons of water delivered to the consumer as shown by the water bills rendered in accordance with this chapter." SECTION 2: That the sanitary service charges as set forth in Section 1 of this Ordinance is to be applied to all accounts on or after April 1, 1987. SECTION 3: All other ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such hold shall not affect the validity of the remaining portions of this Ordinance. SECTION 5: This ordinance shall become effective 10 days after adoption on March 14 , 1987. PASSED and ADOPTED this 4th day of March , 1987.
