Ordinance 87-2554 ORDINANCE NO. 87-2554 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 18 OF THE MIAMI BEACH CITY CHARTER ENTITLED "APPOINTMENT OF CITY MARSHAL OR CHIEF OF POLICE; DUTIES GENERALLY" DELETING THEREFROM TITLE OF CITY MARSHAL AND FURTHER DELETING PROVISION CONCERNING ELECTION OF CITY MARSHAL OR CHIEF OF POLICE; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 18 of the Miami Beach City Charter entitled "Appointment of city marshal or chief of police; duties generally" is hereby amended to read as follows : Sec. 18. Appointment of eity marshal er chief of police; duties generally. There shall be appointed by the city manager , by and with the consent of the city commission; er eIeeted by the a+ty eemm.iss en ander the eend t4ens and n the manner set tenth n seet4en 13 hereefT a e ty marshal er chief of police; whose duties shall be such as are fixed by ordinance and by this Charter . SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance.
