ORDINANCE NO. 87-2556 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REPEALING SECTION 24 OF THE MIAMI BEACH CITY CHARTER ENTITLED, "SUSPENSION AND REMOVAL OF OFFICERS" , SAID SECTION HAVING BEEN SUPERSEDED BY SECTION 13 OF THE MIAMI BEACH CITY CHARTER ESTABLISHING THE POWERS AND DUTIES OF THE CITY MANAGER; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 24 of the Miami Beach City Charter , which reads as follows : Bee.- 24T Suspension and: remeval of a€€leers- The e}ty manager e€ sa4d e}ty shall have the right to suspend any e€€leer of said e4ty7 exeept members of the elty eemm}sslen; prevlded= that at the next meeting o€ the e}ty eemmisslen after sueh suspenslen there shall be submitted to the elty eemm4ss4en; In wrlting; the eause e€ sueh suspenslen; whereupon the said elty eemmisslon may lnqulre 4nte the eause of sueh suspenslen; 1€ a majerlty e€ the e4ty eemmisslen shall sustain the eharges pee€erred; the e€€leer shall be dlsmissed; etherw4ee he shall be reinstated- The elty manager shall have the right to appelnt seine person to per€erm the duties of said suspended e€€leer until the elty eemmiss}en shall have passed upon sueh suspenslen- I€ sueh suspenslen is sustained by the elty eemm}sslen a sueeesser shall be appe}nted and een€lrmed er eleeted as herein prevlded- The elty eemmisslen shall a}se have the right by reselutlen adapted by the favorable vete of at least €lve members, and wltheut aetlen en the part e€ the a+ty manager; to summarily remove €rem e€€lee any elty e€€leer emeept members e€ the elty eemm4sslon7 Prev4ded; the elty eemmisslen shall also have the right by reselutlen adapted by the favorable vete of €eur members; and wltheut aetlen en the part e€ the elty manager; to suspend any e€€leer e€ the elty; exeept members e€ the elty eemmisslen; for a perled e€ net mere than s4mty days; and to appelnt some person to perform the duties e€ sa4d suspended e€€leer during the perled of sueh suspens4en7 is hereby repealed in its entirety having been superseded by section 13 of the Miami Beach City Charter establishing the powers and duties of the City Manager . -1- SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 4. EFFECTIVE DATE. This ordinance shall take effect ten (10) days after its adoption, on A ; l 25 _ , 1987 .
