ORDINANCE NO. 2017 -4129
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING THE LAND DEVELOPMENT REGULATIONS
OF THE CITY CODE, BY AMENDING CHAPTER 130, "OFF- STREET PARKING,"
ARTICLE II, "DISTRICTS; REQUIREMENTS," AT SECTION 130 -33, "OFF - STREET
PARKING REQUIREMENTS FOR PARKING DISTRICTS NOS. 2, 3, 4, 5, 6, AND 7,"
TO AMEND THE REGULATIONS FOR PARKING DISTRICT NO. 7 TO MODIFY THE
PARKING REQUIREMENTS FOR OFFICE USES ON PROPERTIES FRONTING
STREET AND LINCOLN ROAD;
PROVIDING FOR CODIFICATION; REPEALER; SEVERABILITY; AND AN
EFFECTIVE DATE.
WHEREAS, the City of Miami Beach has the authority to enact laws which promote the public
health, safety and general welfare of its citizens; and
WHEREAS, the City has reviewed the conditions of Washington Avenue and the concerns
raised by residents, property owners, and businesses as it relates to the condition of Washington
Avenue; and
WHEREAS, the City has studied various mechanisms for improving the quality of life and
quality of business improvements within the area; and
WHEREAS, the City of Miami Beach Land Development Regulations ( "LDRs ") provides for the
regulation of land within the City; and
WHEREAS, the Planning Board, at its meeting dated June 27, 2017, by a vote of 4 -0,
recommended in favor of the Ordinance; and
WHEREAS, the amendments set forth below are necessary to accomplish the above
objectives.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA:
SECTION 1. That Chapter 130, "Off- Street Parking," Article II, "Districts; Requirements," of the Land
Development Regulations of the Code of the City of Miami Beach, Florida is hereby amended as
follows:
Sec. 130 -33. - Off- street parking requirements for parking districts nos. 2, 3, 4, 5, 6, and 7.
(d) Except as otherwise provided in these land development regulations, when any building or
structure is erected or altered in parking district no. 7, off - street automobile parking spaces
shall be provided for the building, structure or additional floor area as follows. For uses not
listed below, the off- street parking requirement shall be the same as for parking district no. 1
or parking district no. 2, as applicable.
(1) Hotel: No parking requirement. For accessory uses to a hotel, the minimum parking is
as set -forth in parking district no. 1.

(2) Office: No parking requirement provided a facility with publicly accessible parking
spaces is located within 500 feet. One (1) space per 500 square feet of floor area.
(3) Retail: Retail existing as of the date of adoption of parking district no. 7 shall have no
parking requirement. For new retail construction, one (1) space per 300 square feet of
floor area.
(4) Cafe, outdoor: No parking requirement.
(5) Approved parklets shall have no parking requirement.
(6) Any building or structure erected in parking district no. 7 may provide required parking
on site as specified in parking district no. 1. Such required parking, if provided, shall be
exempt from FAR, in accordance with the regulations specified in chapter 114 of these
land development regulations.
The parking requirements in this subsection 130- 33(d)(1)(2)(3)(4) and (5) shall only apply to
projects that have obtained a full building permit or business tax receipt by September 1, 2020.
SECTION 2. REPEALER.
All ordinances or parts of ordinances and all section and parts of sections in conflict herewith
be and the same are hereby repealed.
SECTION 3. CODIFICATION.
It is the intention of the City Commission, and it is hereby ordained that the provisions of this
ordinance shall become and be made part of the Code of the City of Miami Beach as amended; that
the sections of this ordinance may be renumbered or relettered to accomplish such intention; and that
the word "ordinance" may be changed to "section" or other appropriate word.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE,
This Ordinance shall take effect ten days following adoption.

RECOMMENDATION
The Administration recommends that the City Commission adopt the Ordinance.
ANALYSIS
BACKGROUND
On March 1, 2017, at the request of Commissioner Michael Grieco, the City Commission referred a
discussion item to the Land Use and Development Committee to add "office space use" to the
Washington Avenue incentives (Item C4H).
On April 19, 2017, the Land Use Committee discussed the item and recommended that the City
Commission refer an Ordinance to the Planning Board. On May 17, 2017, the City Commission
referred the Ordinance to the Planning Board for consideration and recommendation (Item C4 B).
PLANNINGANALYSIS
A proposal has been put forward by a property owner on Washington Avenue to encourage the
development of office uses along Washington Avenue. This would provide activation during daytime
hours and provide Miami Beach residents with access to jobs without have to commute to the
mainland.
The attached draft ordinance would amend Chapter 130 of the City Code, pertaining to the parking
requirements for Parking District No. 7, which covers Washington Avenue from 6th Street to Lincoln
Road. Currently, in Parking District 7 offices have a minimum parking requirement of "One space per
500 square feet of floor area." Parking District 7 was established as part of the Washington Avenue
Zoning Incentives that were adopted on October 24, 2015. The original incentives reduced the
parking requirement for office uses somewhat from the previous requirement of "1 space per 400

square feet of floor area; however, medical offices and clinics or offices located on the ground floor
shall provide 1 space per 300 square feet."
As recommended by the Land Use and Development Committee, the draft ordinance that was
transmitted to the Planning Board contained two separate options for further incentivizing office uses
in Parking District No. 7, as follows:
OPTION A: Office: No parking requirement.
OPTION B: Office: No parking requirement provided a facility with publicly accessible
parking spaces is located within 500 feet.
A map indicating the current boundaries of Parking District 7, the location of public off- street parking,
and 500 foot buffers around those public parking locations is attached. In analyzing the locations of
public parking, most of the properties within Parking District 7 are located within 500 feet of a
publically accessible off- street parking location. The exception to this is the Feinberg Fisher K -8
Center and the properties in close proximity of Espanola Way.
PLANNING BOARD REVIEW
On June 27, 2017, the Planning Board discussed options 'A and 'B' above, recommended option 'A
as the preferred alternative and transmitted the proposed Ordinance Amendment pursuant to option
'A above to the City Commission with a favorable recommendation.
SUMMARY /UPDATE
The City Commission approved the subject Ordinance at First Reading on July 26, 2017, pursuant to option 'B'
above. The revised ordinance for Second Reading has been updated to reflect option 'B'. Based on the attached
map showing most of the properties within Parking District 7 are located within 500 feet of an off - street parking
location, the Administration had previously recommended option 'A', noted above.
CONCLUSION
The Administration recommends that the City Commission adopt the Ordinance.
