Ordinance 87-2567 ORDINANCE NO. 87_ s 7 AN ORDINANCE AMENDING THE 1980 COMPREHENSIVE DEVELOPMENT PLAN OF THE CITY OF MIAMI BEACH AND THE MAPS ATTACHED THERETO BY AMENDING THE DEFINITION OF THE TERM "PUBLIC/INSTITUTIONAL", AS IT APPEARS IN THE CITY'S COMPREHENSIVE PLAN, TO INCLUDE FACILITIES, THE USE OR OWNERSHIP OF WHICH IS SHARED BETWEEN MUNICIPAL GOVERNMENT AND PRIVATE PARTIES, INCLUDING AIR RIGHTS DEVELOPMENTS OVER MUNICIPAL PROPERTY AT THE FOLLOWING LOCATIONS: PROPERTY WITHIN THE CIVIC AND CONVENTION (CCC) ZONING DISTRICT, PARKING LOTS DIRECTLY ADJACENT TO THE C-3 (LINCOLN ROAD) ZONING DISTRICT, TWO PARKING LOTS AT 13TH STREET AND COLLINS AVENUE, AND CITY-OWNED NON-OCEANFRONT PROPERTY IN THE SOUTH POINTE REDEVELOPMENT AREA; REPEALING ALL ORDINANCES IN CONFLICT; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: The Definition of the Term "Public/Institutional", as it appears in the 1980 Comprehensive Development Plan of the City of Miam Beach shall include facilities, the use or ownership of which is shared between municipal government and private parties, including air rights developments over municipal property at the following locations: 1) property within the Civic and Convention (CCC) Zoning District (including the area bounded by Dade Boulevard, Lincoln Lane, Meridian Court, 17th Street, and Meridian Avenue, but not including the C-2 zoned parcel on the northeast corner of Meridian Avenue and 17th Street), 2) parking lots directly adjacent to the C-3 (Lincoln Road) Zoning District (south of Lincoln Road, a) the lot between Euclid and Meridian Avenues, Block 50A, Lots 6, 7 of the Lincoln Road Subdivision; b) the lot between Meridian and Lenox Avenues, Block 47, Lot 6, Block 48, Lots 5, 6, 13, Block 49, Lot 13 of the Lincoln Subdivision; c) the lot between Alton Court, south of Lincoln Road, Block 45, Lots 13, 14, 15 of the Alton Beach Realty Company Subdivision; d) the lot east of Washington Avenue north of 16th Street, Block 54, Lots 21, 22 and the eastern 150 feet of lots 19 and 20 of Fisher's First Subdivision of Alton Beach; e) the lot east of West Avenue and south of Lincoln Road, Block 45, Lots 13-15 of Alton Beach Realty Subdivision, and north of Lincoln Road; f) the parking lots north of Lincoln Road and south of 17th Street, from Meridian to west of Lenox, Block 39, lots 9-13, Block 38, lots 7-9, and 18-20, Block 37, lots 7-10 and 16-20 of Palm View Subdivision, and Block. 36, lots 2-4 and 11-15 of the Amended Golf Course Subdivision); 3) two parking lots at 13th Street and Collins Avenue (municipal parking lots at the southwest corner of Collins Avenue and 13th Street, Block 28, lots 1-3 of Ocean Beach Addition /12 Subdivision, and the northeast corner, Block 18, lots 9-12 of Ocean Beach Addition #2 Subdivision); and 4) City-owned non-oceanfront property in the South Pointe Redevelopment Area (all City-owned land south of 6th Street, west of Ocean Drive, north of Biscayne Street, and east of ,Alton Road). (See Attachment #1) SECTION 2: REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: SEVERABILITY. If any section, sub-section, sentence, clause phrase, or portion of this Ordiance is, for any reason, held invalid or unconstitutional by any court of "any competent jurisdiction, such portion shall be deemed a separate, distinct and • independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 4: EFFECTIVE DATE. This Ordinance shall take effect ten days after adoption on June 13, 1987. PASSED and ADOPTED this 3rd day of June , 1927.
