AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA AMENDING THE FOLLOWING SECTIONS OF
THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION
• 14A-1 DEFINITIONS; AND SECTIONS 14A-5-1 DEFINITIONS AND
14A-5-2(C) DISPOSAL OF GARDEN TRASH, TREE AND SHRUBBERY
TRASH AND SPECIAL HANDLING TRASH, BY PROVIDING THAT ALL
PERSONS ENGAGED IN THE PROFESSIONS OF GARDENER ,
LANDSCAPER, OR RELATED FIELD, SHALL BE REQUIRED TO
OBTAIN AN ANNUAL CITY DECAL AND TO PRESENT CITY COUPONS
TO THE STASH GUARD IN ORDER TO DISPOSE OF TRASH ;
PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH ; AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1 : That Section 14A-1 of the City Code, DEFINITIONS, be
amended to include the following :
SANITATION DEPARTMENT. The City department responsible for
the collection and disposal of garbage and trash within
the city limits of Miami Beach. The operation of the
city stash area is also under the sole authority of
this department .
SECTION 2 : That Section 14A-5-1 , DEFINITIONS, be amended to
include the following:
DUMPING PERMIT DECAL. A non-transferable, numbered
decal, issued by the Sanitation Department every fiscal
year (October 1) to holders of specific occupational
licenses ( gardeners , landscape firms and others) for
the purpose of authorizing their use of the city stash
area.
CODED DUMPING COUPONS . Non-transferable , coded ,
numbered coupons issued free to all holders of a
dumping permit decal . One coupon shall be given to the
proper authority at the city stash area each time the
decal holder dumps garden trash.
SECTION 3 : That Section 14A-5 . 2 (c) of the Code of the City of
Miami Beach, Florida is hereby amended to read as follows:
Sec. 14A-5 . 2 Disposal of garden trash, tree and shrubbery
trash and special handling trash.
( c ) Use of regulated stash areas by property owners ,
occupants eft. and their landscape firms , or licensed
gardeners.
( 1) Regulated stash areas are restricted to use for trash
generated within the city limits by property owners or
occupants and their landscape firms or licensed gardeners
doing business within the city boundaries holding a city
dumping permit . In addition all persons engaged in the
professions of gardener , landscaper, or related field shall
be required to obtain a city decal and to present city

coupons to the Stash Guard in order to dispose of trash.
( 2 ) Dumping of any material other than garden trash and
tree and shrubbery trash in city regulated stash areas is
prohibited. Dumping of any or all garden trash generated
outside the city limits is prohibited.
( 3) Loitering , salvaging, artd vandalism, and unauthorized
trash dumping by any person at regulated stash areas is
prohibited.
( 4) Special handling trash is prohibited from being dumped
at regulated stash areas . Special handling trash generated
by property owners or occupants will be scheduled for pick-
up by the sanitation department . Special handling trash
generated by landscape firms shall be disposed of by such
firm at a suitable disposal site outside the city limits.
( 5) Any single commercial dumping of garden trash and tree
and shrubbery trash in excess of five cubic yards is
prohibited.
( 6) A regulated stash area dumping permit decal is required
by any gardener or landscape firm utilizing regulated stash
areas. Application for dumping permit decal is to be made
to the city' s sanitation department . Decal permits will be
issued free of charge on a crtrart -r-I-y yearly basis. The
decal permits shall be conspicuously affixed to all vehicles
used by landscape firms or licensed gardeners in
transporting trimmings and cuttings to regulated stash
areas .

Vehicles without current permits (decal ) are prohibited from
the use of city stash areas. The sanitation department of
the City of Miami Beach will issue free dumping coupons to
each licensed gardener based on the number of accounts and
frequency of service calculated on a monthly basis . Each
decal permit application shall require the following
information:
a) Name of owner , address and phone number
b) City of Miami Beach occupational license (copy)
c) Dade County occupational license (copy)
d) Make, model and color of vehicle
e) Copy of vehicle registration, that matches the name of
licensee
f) Copy of liability insurance
g) List of active accounts with address and frequency of
monthly service
Upon acceptance of the application, one numbered decal will
be issued for each license and shall be affixed by
Sanitation Department to the front windshield of the
vehicle . Numbered and coded coupons will be issued and
provided to cover all the calculated dumpings for a period
of six months, after that another set will be issued. One
coupon per dumping will be given to the Stash Area Guard who
will log it with the daily dumping report . No dumping of

garden trash will be permitted without the permit decal and
dumping coupon.
( 7 ) Landscape firms are required to dispose of all garden
and related trash generated by them while doing business in
the city at either a regulated stash area or at a disposal
site outside the city, dependent of the nature of garden and
related trash generated. (Ord. No. 78-2117, Sec. 1 . )
( 8 ) The City of Miami Beach reserves the right to refuse
the dumping of certain materials if they require special
handling or are hazardous in nature. Such materials shall
include but not be limited to the following:
a) Construction materials
b) Appliances, furniture, mattresses, box springs
c) Used and worn tires
d) Old chain link fences, gates etc.
e) Discarded machinery
f) Carton board boxes
SECTION 4 : Severability. If any section, part of section,
paragraph, clause, phrase or word of this ordinance is declared
invalid, the remaining provisions of this ordinance shall not be
affected.
SECTION 5: Repealer . All ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 6 : Effective Date . This ordinance shall take
effect ten ( 10) days after its adoption on September 26
1987 .
