AN ORDINANCE AMENDING ARTICLE I,
CHAPTER 20, OF THE CODE OF THE CITY
OF MIAMI BEACH, FLORIDA, REGULATING
OCCUPATIONAL LICENSES AND PERMITS,
FIXING THE AMOUNT OF SAME AND PRO-
VIDING PENALTIES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1. That Article I, Chapter 20, of the Code of
the City of Miami Beach, Florida, be and the
same is hereby amended to read as follows:
"Sec. 20-1. Occupational licenses required.
No person shall engage in or manage any business,
privilege or occupation mentioned in this chapter in
the city unless a city license shall have been procured
from the city clerk as is provided by this article, which
license shall be issued to each person upon the receipt
of the amount herein provided for or as may otherwise
be provided by this Code.
Sec. 20-2. State license tax to apply in certain instances.
In every case not provided for in this article
or Code, a city license tax, equal in amount to the state
license tax imposed by the state, is hereby levied and
imposed upon such businesses, professions or occupations
not otherwise specifically named in this article or Code,
and all of the penalties prescribed by this article or
Code for the nonpayment of license tax or for doing
business without a license, shall extend and apply to
such other cases not specifically mentioned herein.
Sec. 20-3. Duration and expiration date; transferability.
No license shall be issued for more than one
year. All licenses, and any bond required as a condition
precedent to the issuance thereof, shall expire on the
last day of September of each year, unless otherwise
provided in this article or Code. All business licenses
may be transferred with the business for which they are
taken out when there is a bona fide sale and transfer
of the property used and embraced in the business sold
or transferred, but such transfer of license shall not
be held good for any period longer than that for which
it was originally issued; provided, that such license
may be transferred to another location; and provided
further, that the original license shall be submitted
to the city clerk, who shall make note thereon of the
transfer, and the new location, if any, of the business
so licensed. All business licenses may be transferred
to a new owner when there is a bona fide sale of the
business upon payment of a transfer fee of three dollars
($3) and presentation of evidence of the sale and the
original license.
Upon written request and presentation of the
original license, any license may be transferred from one
location to another location in the same municipality
upon payment of a transfer fee of three dollars ($3).

Sec. 20-4. Date license tax payable; pro rata
payments; license fees for businesses
declared unlawful.
All licenses shall be payable on or before
the first day of October of each year. No license
shall be issued for any fractional portion of the
year; provided, however, that those persons operating
businesses or occupations covered by this article
who establish permanent places of business in the
city after May 1st may obtain a license for the re-
maining portion of the fiscal year upon the payment
of one-half the fee provided for in this article;
provided further, if any occupation or business there-
tofore lawfully carried on or lawful to be carried on
in the city shall have been heretofore or shall here-
after at any time be prohibited and made unlawful
by any ordinance of the city, then the city clerk
shall, upon application for license by or for any
such business or occupation, issue a license for the
fractional part of the year from October first, of
the year during which application shall be made to
the effective date of such ordinance, if such ef-
fective date falls between October first of such
year and September thirtieth of the succeeding calen-
dar year, and shall collect that proportion of the
license tax for such occupation or business which
shall bear the same relation to the total license
tax for a whole year for such occupation or business
as the fractional period for which license is issued
shall bear to an entire license year. In the event
a license tax for the period of a whole year shall
have been or shall hereafter be collected from any
person whose occupation or business has been or shall
thereafter have been so prohibited and made unlawful
as of a date during such year for which license tax
has been collected, the city clerk is hereby authorized
to retain such part of the license tax so collected
as shall bear to the total amount so collected the
same relation as the period from October first of the
year of the license so issued to the effective date
of such prohibitory ordinance shall bear to the entire
license year of twelve months, and is hereby authoriz-
ed to refund the balance thereof to the person who
shall have paid the same. Upon making such refund
the city clerk shall require the production of such
license and shall endorse thereon the effective date
of such prohibiting ordinance as the expiration date
of such license.
Sec. 20-4.1. Penalty for late payment.
All licenses shall be sold by the city clerk
beginning September 1 of each year and shall be due
and payable on October 1 of each year and shall expire
on September 30 of the succeeding year. Those licenses
not renewed by October 1 shall be considered delin-
quent and subject to a delinquency penalty of ten
percent (10%) for the month of October, plus an ad-
ditional five percent (5%) penalty for each month
of delinquency thereafter until paid; provided that
the total delinquency penalty shall not exceed twenty-
five percent (25%) of the occupational license fee
for the delinquent establishment.
Any person engaging in or managing any business,

occupation or profession without first obtaining an
occupational license, required hereunder, shall be
subject to a penalty of twenty-five percent (250) of
the license determined to be due, in addition to any
other penalty provided by law or ordinance.
Sec. 20-5. License tax based on property valuation.
It shall be the duty of the city clerk, before
issuing a license based upon property valuation or
any other condition, to require the parties applying
for such license to file under oath, duly authenti-
cated, a statement of the value of the property, or
other contingency, which statement shall be kept per-
manently on file. A failure on the part of the city
clerk to require their written oath shall be cause
for suspension from office. Any person who shall make
a false statement, application or oath under this sec-
tion shall, upon conviction thereof, be punished as
provided by section 1-8.
Sec. 20-6. Licenses for agents.
Each individual who acts as agent, and each
individual who acts as business or sales agent for
a corporation engaged in any business mentioned in
section 20-17, when his principal has not paid a li-
cense in accordance with this article, shall be re-
quired to take out a license as agent in his own name.
This section shall apply to every person who seeks,
negotiates or transacts, for himself or for any other
person or corporation mentioned in this section, but
not to inactive stockholders in corporations or mem-
bers of agencies who do not attempt to transact any
business for such agency.
Sec. 20-7. Regulations concerning music boxes,
mechanical phonographs, marble machines
and other coin operated machines, etc.,
Every music box, mechanical phonograph, con-
sole, juke box, marble machine device of skill, auto-
matic coin game or other similar machines, games or
devices operated for profit, the maintenance and
operation of which is licensed by this article, shall
at all times have posted thereon conspicuously and legi-
bly the name, address and telephone number of the person
selling, leasing or renting such machine or device.
The city clerk is hereby authorized and directed to take
immediate possession of any machine or device, licensed
or unlicensed, which does not conform to the require-
ments of this section or which does not have affixed
thereto the serially numbered metal tag provided for and
required by section 20-17, and to cancel the license for
the same, if it is licensed, and to sell same at public
auction after one publication of notice of such sale,
which notice shall be published in a local newspaper at
least ten days prior to the holding of such sale. The
proceeds of such sale shall be paid by the city clerk into
the city treasury. At any time prior to the holding of
such sale, the person selling, leasing or renting such
machine or device may, upon proof of ownership as evidenc-
ed by bill of sale or other evidence satisfactory to the
city clerk, obtain such machine or device upon payment to
the city clerk of a sum equal to the annual license tax
for such machine or device, together with a fee of twenty-
five dollars, in addition to all costs and expenses in-
curred by the city clerk for the transportation, stor-
age and publication of notice, if any, in connection

with the confiscation of such machine or device, which payment shall also entitle
such owner to a license for the machine or device for the remainder of the current
license year.
It shall be unlawful and a violation of this article for any person to use
or operate or permit to be used or operated, within his place of business any such
machine, game or device which does not have affixed to the said machine, game or
device the serially numbered metal tag provided for and required by section 20-17.
Sec. 20-8. Statements as to employers required of
insurance agents.
Any person conducting the business, occupation or profession of an insurance
agent shall file a sworn statement with the city clerk, listing the name of each
insurance company, as defined by section 20-17, for which he is acting. For his
willful and intentional failure to do so, he shall, upon conviction, be subject
to the penalties provided in section 1-8.
Sec. 2i-9, Penalty for operation of business without license.
Any person who shall carry on or conduct any privilege, business, occupation
or profession for which a license is required by this article, without first
obtaining such license shall, upon conviction, be punished as provided by section
1-8.
Sec 20-9.1. Application.
Any applicant for any license required by the provisions of this Code shall
make application therefor under oath or before a notary public or other person duly
authorized to administer oaths, to the city clerk on forms provided by the city
clerk for that purpose. Such application, if made at the instance of an individual
shall set forth the name, the occupation or business, and the location of such
place of business, and such other information as may be reasonably required. If
the application be made on behalf of a firm or partnership, the application shall,
in addition, set forth the name and address of each member of the firm or partner-
ship. If the application be made on behalf of a corporation, the same may be made
on its behalf by a bona fide officer thereof, and the application shall set forth
the name of the corporation, its business and the location thereof, and shall set
forth the names and addresses of its president, vice-presidents, secretary and
treasurer, together with such further information as may be reasonably requirec.
Sec. 20-10. Each day's operation without license considered
separate offense.
Each day that a privilege is exercised or a business, occupation or profession
conducted or followed without first having procured a license therefor, shall be
an individual offense punishable as is hereinbefore set forth; provided, that if
a person, however defined, is punished for one such offense and pays the penalty,
and procures a license before further conducting or carrying on such a privilege,
business, occupation or profession, then he shall not be fined for each day's
failure or ommission to have a lipense for the conducting of such a privilege,
business, occupation or profession.
Sec. 20-11. Duties of officers and agents of corporations
to comply with article.
It shall he the duty of all officers and agents of any corporation to set:
that 'such corporation complies with the provisions of this article, and all officers
or agents of any corporation required by this article or Code to be licensed who
shall do business without having paid the license tax imposed and procured such
license, shall be subject to the penalties imposed by the foregoing sections upon
persons and members of firms and corporations violating this article.

Sec. 20-12. Investigation to determine compliance with article;
penalty for refusal to allow investigation;
enforcement of article.
The city clerk shall investigate persons engaged in any of the businesses,
ucrur,ations or professions listed in this article and make such inquiry and inves-
tHatip.n as shall be necessary to determine whether or not they have procured a
litensr: as required by this article. Any person refusing to allow the city clerk
tr, investigate for the purpose of determining whether such person has such license
shall, upon conviction, be punished as provided by section 1-8. The city clerk
and his deputies are hereby vested with the power and authority to make arrests
for violations of this article.
Sec. 20-13. Posting.
Any person exercising the privilege of conducting a business, occupation or
profession for which a license is required by this article shall post his license
in a conspicuous place in or about his place of business where it may be seen
upon inspection by any official of the city. For his failure to do so, he shall,
upon conviction, be fined or imprisoned, or both, as if he had never procured such
licens
20-14. Payment of license tax does not authorize
commission of crime.

legalize in any manner whatsoever the commission of any offense or crime against
the city, the county, the state or the United States of America.
Sec. 20-15. Licenses to be issued in conformance with
Zoning Ordinance.
No license shall be issued except in conformity with the Zoning Ordinance.
Sec. 20-16. Construction of article.
1.11 of the provisions of this article shall be construed liberally in behalf

issued to any canvasser, itinerant solicitor or
other person named above, a permit therefor must
be secured from the city manager, application

Each person engaged in the business of a pawnbroker
or conducting a pawnbroking shop in the city shall

to the chief of police or his representative of
every article or thing pawned to or purchased by
him or them. Such record and report shall specify
the article or thing, such as number, mark and all
other such details as will make identification of
such article or such articles or things, clear and

upon refusal of any pawnbroker at any time to submit
to such visitation or inspection, his shop shall be
immediately closed by order of the mayor.

SECTION 2. If any section, subsection, paragraph, or other
provision of this ordinance or its application to
any person or circumstance shall be held invalid co:- uncon-
stitutional, such holding shall not affect the validity of any
other section, subsection, paragraph, or other provision, or
its application to other persons or circumstances. The City
Council hereby expresses the intent that it would have enacted
the other provisions of this ordinance as if the invalid or
unconstitutional provision was not contained therein.
SECTION 3.
That all ordinances or parts of ordinances in con-
flict herewith be and the same is hereby repealed.
SECTION 4. That this ordinance shall go into effect upon its
passage, posting and publication which is required
by law.
