AN ORDINANCE AMENDING ARTICLE V, SECTION 5.01(a)
OF ORDINANCE NO. 1901 PROVIDING FOR THE CREATION
AND MAINTENANCE OF A RETIREMENT SYSTEM FOR GENERAL
EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 - That Section 5.01(a) of Article V of Ordinance
No. 1901 of the City of Miami Beach, Florida, be
and the same is hereby amended by adding the following para-
graph thereto:
"Provided, however, that in the event that the depart-
ment head shall fail or refuse to recommend an Employee
Member for a deferment of mandatory retirement, such
Employee Member shall have the right of appeal to the
City Manager. Such appeal shall be filed not less than
thirty (30) days following the failure or refusal of
the department head to make such recommendation. Such
appeal shall be filed with the City Manager who shall
thereupon set a time and place for the hearing of such
appeal, within ten (10) days, or such later date as
shall be determined by the City Manager. Said appeal
shall be administrative in nature, and all parties
directly interested shall be permitted to produce
witnesses and to submit evidence. Following the con-
clusion of said appeal, the City Manager shall make
his finding and determination as to whether the action
of the department head shall be sustained and shall
advise the department head and Employee Member forth-
with. The determination of the City Manager shall be
final and determinative of the matter."
SECTION 2 - All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3 - This Ordinance shall go into effect immediately upon
passage and posting as required by law.

EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA "
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 21st day of September, 1972,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
