A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, GRANTING FLORIDA POWER AND LIGHT
COMPANY AN UNDERGROUND UTILITY EASEMENT FOR INST ALLA TION
OF ELECTRICAL POWER SUPPLY DUCTS AT THE SOUTH SIDE OF PINE
TREE PARK, LEGALLY DESCRIBED AS LOT B OF AMENDED PLAT OF THE
INDIAN BEACH CORPORATION'S SUBDIVISION AS RECORDED IN PLAT
BOOK 8, PAGE 61 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A GRANT OF
EASEMENT SUBJECT TO NEGOTIATION BY THE ADMINISTRATION AND
REVIEW BY THE CITY ATTORNEY1S OFFICE.
WHEREAS, an increase in the power demand on Collins Avenue, north of 41st Street,
is anticipated due to construction of the Diamonds Condominium; and
WHEREAS, Florida Power and Light Co.(FPL) has to provide the required power to the
area from its substation on West 40th Street and Sheridan Avenue; and
WHEREAS, FPL has determined that the best available routing with the least impact on
traffic and the environment to supply the required power is through Pine Tree Park ;and
WHEREAS, as the City owns Pine Tree Park, FPL has requested that the City grant it
an underground utility easement at the south side of the park, for installation of the required
electrical power supply ducts, as more specifically described in the attached Exhibit "A"; and
WHEREAS, the Administration would recommend that the Mayor and City Commission
approve said grant of easement to FPL, subject to negotiation of a mutually beneficial Grant of
Easement Agreement, to be negotiated by the Administration and reviewed by the City Attorney I s
office.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein agree to grant an underground utilities easement to FPL as specifically
described in the attached Exhibit "A", for the installation of electrical power supply ducts, to be
located on the south side of Pine Tree Park. The Mayor and City Clerk are herein authorized to
execute a Grant of Easement Agreement subject to negotiation by the Administration and review
by the City Attorney 1 s Office.

ADMINISTRATION RECOMMENDATION:
To approve the Resolution.
BACKGROUND:
FPL needs to increase feeder capacity to the area north of 41st Street on Collins Avenue due to
the anticipated electrical load after the completion of the Diamonds Condominiums.
FPL engineers have investigated multiple options for the routing of the additional duct banks
necessary to feed this area, but have been unable to obtain any easements to reach the Indian
Creek Waterway from the substation on West 40th Street and Sheridan Avenue.
FPL has found that the best route, which will make use of their empty ductbanks on Pine Tree
Drive and have the least impact on traffic and the environment, was to run their ducts across the
City's Pine Tree Park and across Indian Creek Waterway. This could be accomplished only if
the City grants FPL an east-west easement along the City-owned Pine Tree Park.

ANALYSIS:
The City's Engineering and Construction Management Department has coordinated with the Parks
and Recreation Department and reviewed the Master Plan for Pine Tree Park, in recommending
the best possible location of this easement. The easement will also be restricted for the exclusive
use of this underground ductbank by FPL.
CONCLUSION:
The Mayor and City Commission should grant Florida Power and Light Company an underground
utility easement for installation of electric power supply ducts at the south side of Pine Tree Park,
legally described as Lot B of Amended Plat of the Indian Beach Corporation's Subdivision as
recorded in Plat Book 8, page 61 of the Public Records of Dade County, Florida.
