A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE FIRST AMENDMENT TO THE POLICE CONFISCATION
TRUST FUND FOR FISCAL YEAR 1996/97, IN THE
AMOUNT OF $114,589 TO BE FUNDED FROM THE
PROCEEDS OF CONFISCATED FUNDS ($76.464 FROM
STATE FUNDS AND $38,125 FROM FEDERAL FUNDS)
WHEREAS, Section 932.705, Florida Statutes, addresses the
purposes and procedures to be utilized for the appropriation and
expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has
determined that the need for expenditures and appropriation exists
and the expenditure or appropriation of forfeiture funds is in
compliance with Section 932.705, Florida Statutes and with Federal
guidelines; and
WHEREAS, such funds are available in the Police Confiscation
Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby adopt the First Amendment to the 96/97
Police Confiscation Trust Fund Budget for the City of Miami Beach,
in the amount of $114,589 as reflected in Exhibit "A".

I, Richard Barreto, Chief of Police, City of Miami Beach, do hereby
certify that the aforementioned proposed request for expenditures
from the City of Miami Beach Police Confiscation Trust Fund, for
the 1996/97 fiscal year providing funds for the purchase of police
vehicles and equipment complies with the provisions of section
932.704(3) (a), Florida statutes and with federal guidelines.

ASSISTANCE TO TOURIST/VICTIMS OF CRIME
This project will assist tourist/victims of Crime during the
hours/days after they have been victimized. Funds will be
used on "an as needed basis" for tourist victims, to cover
transportation (cabs, airline ticket re-issuance), hotel/motel
rooms, food, clothing, medicine, etc. Each tourist/victim
will be screened to determine if any other resources can be
used. Tourist/victims will be asked to pay back any funds
they are furnished.
CONTRIBUTION TO THE POLICE CHAPLAINS
CONFERENCE TO BE HELD IN MIAMI BEACH,
JAN 14 - 16, 1997
CONSULTANT WORK AT PSCU to review current
procedures, analysis of procedures and prepare new
Standard Operating Procedures for unit. Covers cost of
travel and per-diem. Consultant work to be done at
no cost
DONATION TO THE MIAMI BEACH SENIOR mGH FOR
LUNCH TIME ACTIVITIES - To keep disruptions from
developing on campus during lunch hour, the school is planning to
provide time for clubs to meet; athletic intramural activities; etc.
STRATEGIC PLANNING SESSION FOR MBPD STAFF
Follow up to the November 1995 session where departmental
goals were established for 1996. Session will review progress
in achieving goals for 1996 and set new goals for 1997.

This system could prevent serious injury or death to officer. The heat
sensor also protects the K-9 from serious injury or death. It also protects
the City's investment in the cost and training of the K-9.

The Administration requests authorization to adopt the First
Amendment to the operating Budget for the Police Confiscation Trust
Fund for FY96/97 in the amount of $114,589 ($76,464 from state
Confiscated funds and $38,125 from Federal confiscated funds) to be
used to provide funds for the law enforcement expenditures listed
in Exhibit "A".
ADMINISTRATION RECOMMENDATION
Approval of the Resolution.
BACKGROUND
Expenditure of forfeiture funds for law enforcement purposes under
the federal guidelines is a proper expenditure.
Florida statute 932.705 provides for, but is not limited to,
expenditure of forfeiture funds for crime prevention and other law
enforcement purposes.
The Chief of police of the City of Miami Beach has determined that
the need for expenditures and appropriation exist and the
expenditure or appropriation of forfeiture funds is in compliance
with Section 932.705, Florida Statutes.
CONCLUSION
The proper procedure has been complied with in accordance with
Florida State Statute 932.705.
In accordance with Florida Statute 932.705, forfeiture

Agreements with various Federal agencies pursuant to 18 USCA
