A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ESTABLISHING A UNIFORM MONTHLY
COMMERCIAL PARKING RATE FOR MUNICIPAL GARAGES AND SURFACE
LOTS, AT THE RATE OF $50.00 PER MONTH, PLUS TAX, WITH AN
EFFECTIVE DATE OF MAY 1, 1997; ESTABLISHING A LIMIT ON ALL SITE
SPECIFIC MONTHLY PARKING PERMITS AT ANY MUNICIPAL PARKING
FACILITY, AND ADOPTING THE LINCOLN ROAD PERMIT REDISTRIBUTION
PLAN.
WHEREAS, the City has never established a uniform monthly commercial parking rate i 1
off-street municipal parking facilities; and
WHEREAS, there is a need to establish a limit on the number of parking permits issued pe r
off-street municipal parking facility; and
WHEREAS, there is a need to redistribute existing parking permits in the Lincoln Roa 1
area; and
WHEREAS, the Parking Department recommends a rate of $50.00 for monthly commelci, I
parking in all off-street municipal facilities, with the exception of the 7th Street Garage and o:he r
facilities where existing conditions or agreements preclude from doing so; and
WHEREAS, the Parking Department recommends limiting permits in most off-stree t
municipal locations at 35% of the total number of spaces; and
WHEREAS, the Parking Department recommends a redistribution of all existing permit;
based on a 35% limit per off-street municipal parking facility; and
WHEREAS, the City of Miami Beach Parking and Transportation Committee supports th .~
recommendations contained herein.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITv
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and Cit I

BACKGROUND:
Since 1992, parking concessions have been used as economic development incentives in the City ofMiarri
Beach. Parking permits, reserved spaces and preferential rates previously granted now seriously encumb~r
municipal parking facilities in commercial areas of the City. There is a need to establish a policy to addre~ s
the price of monthly commercial permits, and to further establish limits on the number of permits that the
City can issue per facility. To standardize fees charged for monthly parking in municipal facilities, the
Administration recommends a $50.00, plus tax, monthly parking rate. To assure that there remain
unencumbered parking spaces for the public in municipal parking facilities, the Administration furtht:r
recommends adoption of the Lincoln Road Permit Parking Redistribution Plan, and a 35% permit occupancy
cap on permits issued at any Municipal facility, unless previous conditions or agreements preclude us from
doing so.
The Lockheed Parking Report of March 1995 specifically addressed the issue of monthly permits in the
Lincoln Road area:
. Section 4,0 on Permit Parking states: " The design of the permit program, with the tlexibili y
provided to the permit holders in their use of the City's lots, creates a parking demand that Chn
severely impact the general public's access to conveniently located, off-street parking. . . In genewl,
the practice of providing permit holders with relatively unlimited parking privileges is placing an
irreversible strain on the City's parking supply, particularly in areas of high demand, and creating
a public perception of unfair practices."
. Section 6,0 - Off-Street Parking states, "The use of off-street permit parking has had a significant
impact on the availability of off-street spaces for short-term parkers. Parking permits have not bel~n
lot-specific and thus, the City has been unable to project the impact they will have in a given lot;
and because some lots are inherently more convenient than others, the impact has be,:n

disproportionate. Some lots fill with permits and make it difficult for short term parkers to filld 1
space."
There is currently no established policy or procedure in place to address monthly parking rates in municipc I
facilities, and parking penn its and spaces have been doled out without a comprehensive look at the mallnE :
in which reserved and permitted spaces affect public parking,
ANAL YSIS:
Today, in the Lincoln Road area, three surface parking lots, 10X, 108 and 1 OC, together totaling 348 pu bli ;
parking spaces, have 318 permitted and reserved parking permits. On any given day, there are onl:; 3 )
parking spaces available to the public in the Lincoln Road area, between Alton Road and Meridian Avellut.
The existing monthly parking permits, when coupled with Citywide decals and Municipal parking permit~,
eliminate the availability of public parking in the commercial area.
To establish limits on the number of parking permits per municipal facility and implement the propose I
plan, it is necessary to redistribute the existing 563 monthly parking penn its in the Lincoln Road area, Th:
Parking Department has developed a redistribution of existing permits based on a 35% limit on permit;
issued per parking facility, The proposed plan redistributes all existing permits at a cap 000% per facilit ;
in the surface lots and municipal parking garage north of Lincoln Road,except where previous condit on;
or agreements preclude us from doing so, The proposed plan reserves 5% in each lot for future permit~,
and leaves the 142 spaces in the surface lots south of Lincoln Road unencumbered by permits. (Se:

The Administration recommends the adoption and implementation of the $50.00 per month plus ta),
monthly commercial parking rate, and a lot-specific monthly permit parking program. These tools wi I
enable the Parking Department to effectively and efficiently manage the City's parking supply, and wi I
allow the department to track all penn its, assuring that no one municipal parking facility is encumbered b;
more than 35%, while maintaining access to convenient off-street parking to the public. offices. Th:
proposed monthly rate of $50,00 equates to $1.67 per day (when pro-rated for a 30 day month), and $:~.5)
per day for a 5 day work week (pro-rated for 20 days per month).
The City of Miami Beach Transportation and Parking Committee unanimously endorsed the propose I
$50.00 monthly commercial parking rate and lot specific program, and the Lincoln Road Pe'm t
Redistribution Plan at their meeting of Monday, December 9, 1996. Lincoln Road merchants an 1
professionals attended this meeting and emphasized that the use of perm its for all-day "front row" parl;in ,~
in the Lincoln Road has virtually eliminated available parking for patrons of stores, restaurant, c r
professionals. The permit parking redistribution plan was also presented to the Lincoln Road Intt:rir I
Council in early February 1997, and received the council's full support.
Acting Parking Director, Jacqueline Gonzalez, has met with MTV Latino, Post Edge, and Sony Discos
the three largest single users of monthly parking permits in the area, and has presented the recommer de I
redistribution and monthly pricing plan. All three businesses, when deciding to move their businesses tc' th,~
City of Miami Beach, were offered parking concessions for a five-year period as economic developmer t
incentives, Two and three years remain on the 5-year parking incentive programs offered to tiles,~
businesses; therefore, the Administration proposes to honor the number of spaces contained in the Le:tel;;
of Intent for Agreement. All these permits will be redistributed according to the proposed plan, Tiles;
businesses have agreed to the increase in rates and redistribution plan, and have expressed the r
understanding of the necessity to unencumber the Lincoln Road commercial area. MTV Latino, Post E dg ,:
and Sony Discos were given specified rates tied to the annual CPI increase in the letters of intent, and a I
have agreed that a 10% increase in their existing monthly rates of $15 and $20 to $16.50 and $22.00 i;
reasonable. Beginning May 1, 1997, a rate of $50.00 per month, plus tax, will be charged for all 1e' (

The Parking Department will notify all current monthly permit holders of the change in location of th:
parking permits that will be made available.
The recommended $50 per month commercial parking rate will not be available at the 7th Street Gamg:
due to restrictions contained in the Parking and Development Agreement entered into between the City c f
Miami Beach and the Ballet Valet Corporation for the public-private development ofthis parking facilit~,
CONCLUSION:
To effectively manage the public parking supply in the City of Miami Beach, it is imperative that w,:
establish and adopt specific rates for monthly parking, and that limits are set on the number of spaces p~ r
lot that can be encumbered by monthly parkers, The proposed rate of $50.00, plus tax, per month, i>
reasonable. The proposed cap for permits of35% per parking facility, and the redistribution of all existin.~
permits, is sound management of a limited public resource.
